Mukasey Confirmed 53-40. : Schumer does "the stump!"

Schumer:  "When Judge Mukasey came before the Senate judiciary committee last month he refused to state waterboarding as torture. That was unsatisfactory, that was wrong. That will be a blemish on judge Mukasey's distinguished career for as long as he lives. But he has made it clear that if Congress passed further legislation in this area, the President would have no legal authority to ignore it...

Thanks Chucky for clearing that up for us...

And people wonder why Congress' approval rating is abysmal.
Sad, just plain sad.

May i be the first to say i don't care where my first comment shows up?

Are you sure they wonder?

Um.. I think the blemish is on your career there Senator. Good luck gettin' that law through you useless sack of crap.

Schumer is a total fucking embarrassment.

Feinstein is a total fucking embarrassment.

Every Democrat who voted to approve this torturemonger is a total fucking embarrassment.

Democrats 2008!!!

YAY!!!

We're. So. Fucked.

So he was unsatisfactory, but was good enough to be confirmed?

Sorry Senator, I think it's the other way around.

Democratic leadership pukes.

...

At least Congress stood up to Bush on water projects. Another Bush, another oil spill...
Gates says Japan should fend for itself against N. Korea.

thanks chucky you fucking moron, there already is legislation that make
torture a crime. whose butt did/do you have your head up?

this is just another example of the corporate whores fucking the American public.

Oh, the irony.

You are consistantly the most prolific information spreader on these threads. Thank you.

In other words, Schumer is just a more slippery version of Alan Dershowitz , a shyster who claims to be in favor of civil rights, but supports torture. Schumer is already on record trying to excuse torture and now he insinuates that if Congress should pass a law describing water torture as torture, then water torture would be illegal and Mukasy would abide by the law. Hey fuckwit! Water torture and every other form of torture is already illegal! The Constitution itself outlaws torture as do any number of laws and treaties passed by Congress. What Schumer is implying is the water torture is in fact legal now.

Schumer supports torture, and not just with his votes in the Senate. What a complete scumbag.

This isn't a surprise, this just confirms Congress is useless. They're willing to give Dumbya whatever he wants and at the same time allow the right wingnut media hate machine to slander them to no end.

I gotta be honest.

As a Jew, I simply cannot believe Finestain and Shittmer allowed this modern Torquemada through.

Those who refuse to learn from history are doomed to repeat it.

Guess I'm moving to Canada.

Nice of Obama to miss the vote just like the last vote on Iraq. He isn't doing himself any favors.

I hope their crosses fit.

Stick around, America needs all the concientious Jews and Gentiles it can get.

The law (US and International treaties and conventions which the US is party to)
already say that torture is immoral and illegal. BUsh and his buddies went ahead and authorized tortur anyway - they have broken the law. Case closed - IMPEACH, indict, convict and incarcerate.

A majority of the House -- in effect -- were motivated to vote for an impeachment investigation. That means Pelosi does not have total control over her Caucus. The majority of the House do not support the Speaker's position on impeachment. On the table is whether that majority can be motivated to withdraw their support for the Speaker herself. Until a State Proclamation hits the House forcing a vote on removing the Speaker from office, we do not know the answer.

It's time to find out. I would encourage all readers to consider these links; and this proclamation to remove one impediment to impeachment: Lawfully removing from office an important roadblock before the 2008 election. The is similar to the House Rule 603 effort, of state legislators calling for impeachment. This time, it focuses on removing Nancy Pelosi as Speaker.

It appears, if we include all the GOP in the vote with enough DNC members who supported this Kucinich bill to investigate Cheney, that there are enough votes to remove Pelosi. Please contact Congressman Wexler if he has any trouble getting the Cheney impeachment on the House Judiciary Calendar; and let him know the States have proclamations drafted to remove one last stumbling block to an impeachment investigation: The Speaker herself. Nothing is stopping any Member of Congress from introducing this privileged motion to directly challenge the Speaker.

Either Cheney and Bush are confronted; or the Speaker must first be confronted. Either way, the Constitution shall prevail over the President, Vice President, and Speaker. Time for the Speaker to choose.

To say Mukasey would be independent, after he had altered his stance on waterboarding overnight............ Schumer is in a bind, having promoted Mukasey for the job, but who would have thought Feinstein would turn into a Lieberman.

On the other hand, the House Judicial Commitee has Kucinich' impeachment bill. Do we dare hope it results in a massive investigation? (If so, the Republicans shot themselves in the foot, or some other part of the anatomy.) Nixon was not brought down by a floor fight, but by Congressional commitees.

assholes 'я' us

Removing Pelosi is ON the table!

I like it!

I hope that every one of the democrats who voted for this douche lose their seat the next time around. Feinstein lost my vote a long time ago. Are there any democratic challengers out there???

this is off subject - kind of - John - down below I just posted that here on the East Coast they posted that Bhutto was just arrested- on BBC- NO Media is covering...have you all heard anything ? ( in an odd way it is revelant to this issue...erosion of Justice ...?)

Do we have a rollcall on the votes yet?

Remove Pelosi, make Kucinich the Speaker of the House, Impeach Chaney then Bush and finally elect the Speaker of the House to the White House.

Mukasey confirmed. The criminality will continue. Feistein and Schumer need to lose their jobs. They have betrayed America.

The only headline I can think of as depressing as 'Mukasey Confirmed', is

'Bush, Schumer, Feinstein Still Alive'.

This is an open thread. You can't be off topic.

By the way, the self-inflicted shitstain on Schmuer's honor will outlast Schumer. what a scumbag.

I'm dissappointed in the Jewish crowd in the Senate. I mean, not only are they not acting in America's best interest, they aren't even acting in Israel's best interest.

But there's still that guy (I think like from Wisconsin or somewhere around there) who we wish would run for President. He said he wasn't gonna run because he looked forward to accomplishing things in Congress. But since nothing good seems to be getting accomplished (maybe there's hope for Kucinich's resolution), maybe he should go ahead and run for President.

On removing Pelosi? IMPEACH HOYER FIRST!!!!

Tom Berry @ 338:

The sad thing is that if Congress passes a law to confirm and /or make
Waterboarding "torture", then the Executive branch will be off the hook
because of the arguement of ambiguity implied necessitating
Congressional action to resolve.

And if Congress doesn't pass a law, then the issue remains unresolved with the Executive branch free to go on its merry path with an Attorney General who won't challenge the issue he wouldn't answer during his confirmation questioning.

This is pathetic. The door is closed and the horses are gone!

There's already a fucking law against torture. I don't know why we have to pass another one, unless we need to do this:

Dear Presidents:

Dont tortur ppple ples. btw waterb0rding 1s t0rtur3.

kplsthks, Congr3ss.

And maybe we can then hire a Congressperson to stand in front of Bush with a fucking bullhorn and read it REAL LOUD IN HIS STUPID FACE.

Then he might hear. I don't know.

I love how Schumer waxes poetic about Mukasey's record, then says 'this one item, even though it differs from my views' does not cancel out the good that Mukasey has done.

Hey, Chuckie-boy, torture is wrong. Period. There's no 'gray space' where it's okay under certain places.

Idiot.

next they are gonna pass a law stating that the president must follow the law.
then issue 9-10 harshly worded letters when he doesnt.
then pass another law that the president must pay attention to laws that say he must follow the law.
then issue 12-15 harsly worded letters when he doesnt.

repeat.

what's with these cowards. don't they know it's not a fringe element anymore calling for impeachment and drastic change. muckasey may well be a great appointment, but he bears the stamp of approval of the bush admin and as such any good has been negated. the american people by large majority have said they want change. the repubs know that and they essentially are running scared, looking for the talking heads to give them the topics of the day, looking for the media whores of talk radio to support them. problem is they have no base. when they chose to support bush, they destroyed any chance for relevance. they're toast. still some dems choose to side with them. these dems will surely disintegrate with them. the right doesn't care about them and they are surely burning bridges with their left base. you know what i say, Oh Well.

kucinich and impeachment, that's the ticket.

Lou Dodds had an interesting article recently where he stated that the American public is so disgusted with the choices for President vis a vie there is so little difference taht an Independent will come out of the wings and sweep the vote. He states this is the year it could happen. I tend to agree. Any thoughts? And whom that would be?

No it's not that at all. Most employees do not do things their boss does not want them to do. The reason the Dems always appear either stupid, spineless, or both is because they rather successfully obscure the fact that like the Republicans they work for the highest bidder, and all too often they work for the same bidder. Our democracy depends on dollars, great big dollars.

Unfortunately you and I only get to buy a ticket to the show when we vote. We have no affect on the actual production. We're all scratching our heads after something like this because if the Dems work for us, the actions of Schumer and DiFi as well as many others, don't make any sense. But if you think of Dems as agents of America's largest insurance companies, banks, mortgage lenders, hospital corporations, oil companies, and the whole military industrial complex, then this is pretty much in step with expectations.

Don't feel bad, we'll be doing this again tomorrow and every day after until the money is drained from the system we call democracy.

Lollimom @ 68:

Something is very wrong with the government of the United States. It's a government that is in the early stages of a dictatorship.

Did anybody hear Debbie Wasserman on The Ed Shultz Show today? I've heard disgusting, arrogant congresspeople before, but this woman took the cake. Appalling. Democrat?

She believes impeachment is a waste of time; she says that most of the country doesn't care about impeachment; she believes the timeline for the 2008 elections will take care of Cheney/Bush. Based on her words, she doesn't believe she has a duty to uphold the Constitution or to investigate the crimes of Cheney/Bush. She's too busy with more important matters.

Randi Rhodes: What exactly do you see in Debbie Wasserman, to praise her as you did today? She came across as a proverbial DICK HEAD on Shultz's show.

I heard it and I strongly agree with Ed Shultz's position, but Wesserman made a strong argument as to why she doesn't want to go down that road. I disagree with her, but overall I believe she's a very good congressperson.

This vote is but one of a countless number of examples that the U.S. in the early 21st Century lacks true leaders that value the Constitution and the people at large. They are motivated merely by narrow self-interests. What doesn't Schummer and Feinstein understand about "We the people?"

Disgusting. That someone so obviously morally ambiguous and ready to lie for his lord and masters in the shrub co. crime family would be so easily added to the payroll. Someone probably should have demonstrated waterboarding to madam feinstein. Perhaps she would have reconsidered.

Interesting how so many of Bush policies and appointments have to be achieved under cover of darkness, secrecy, or through devious means.

When historians review the Mukasey confirmation, what they will find shocking is not that some Democrats voted for him, but that no Republicans voted against him. The Republican Party's decay is fully evident in this simple statistic. The Republican Party (not just their hapless leader) has become the Party of torture (among other things).

You are so right Dennis, the very first indication that someone is wrong about something is the old Nobel Peace Prize Early Warning System. The Nobel Committee has been warning us for years. Okay, 7 Democrats proved that they were traitors to their party and to their country when they voted for Mukasey. (Schumer, Feinstein, Landrieu, Nelson(Nebraska), Bayh, Carper and Lieberman. Biden, Dodd, Clinton and Obama did not bother to vote.

But every damned Republican voted for Mukasey. Every damned one. Now tell me again how there is no difference in the parties. Cause that vote alone proves that there are.

It amuses me that Mukasey claims he doesn't know enough about waterboarding to declare it torture, but he finds it personally repugnant. Excuse me, but if you know enough about it to find it repugnant, you know enough to know it's torture.

Interesting how so many of Bush policies and appointments have to be achieved under cover of darkness, secrecy, or through devious means.

they’ve done it right in your face.

the question is: shouldn’t someone be reporting this?

Yes! THAT is the what's so amazing -- it's all being done in the light of day, and still, Congress goes along with it all!

My take on this “Writers Guild Strike” it’s simple. Every thing any thing written should defend the Constitution of America.

There is so much “Sedition Practiced” in everyday political, commercial and history programming it is shameful, disgusting, pitiful, and dangerous to the very fabric of American culture. Writers have practiced openly to shimmy, bounce and redirect compress, deviate, and confuse the American electorate to this point it’s no wonder writers have lost the personal growth they know they should rightly have. All of a sudden there is awareness not only by the writers but by the American electorate, and hopefully we can all help each other. The writers are key players to build a great America. To watch them fall pray to the culture of corruption is worse than the terror, the fear of any Bin Laden.

The primer disconnect is the continuous divisiveness currently in motion in Mainstream Media News. Especially the ability to take “Out Of Context” debate and serious political discussions writers have the capability to do, but find them self’s “IMUS’ed into contractual agreements” that are geared to achieve controversy for political ends, instead of a good faith path to truth and an affinity to build a great America.

We are forced to watch News that leverage television Journalist send them selves to leadership, like Colbert, Dobbs, or worse Evangelist like Pat Robertson. The best of the worst Robert Novak, and Limbaugh like other radio and television Journalist churn their computers with classified documents fed information by Cheney and Company to deliberately manufacture and shift pole umbers to manipulate the vote. So, what do we do? Pay them more, for the same?

As Cher said” The beat goes on a la di a da di dee a la did a da di day”. Cher had a message way back but many didn’t understand it, the system is broken, we need to fix it. I’m a boomer, married , and a male and still think the Democrats have a good chance to change the course. Hopefully the Democrats will take the theme of “John Denver” a real country conservative and show America how to be real Americans. "Take Me Home, Country Roads" that’s real country I remember not the stupid stuff IMUS plays.

Yep, the neoconmen are still goose-stepping in unison with Busholini. The pussycrats, well, my nickname for them says it all.

Sadly for Schumer and the American people, Congress in 2005 already passed a law express forbidding waterboarding and other interrogation techniques amounting to torture. And President Bush already issued a signing statement declaring he would ignore it.

For the details, see:
"Waterboarding the Constitution: Mukasey and Bush's 2005 Signing Statement."

Schumer - Feinstein - Hellerstein - Silverstein - Mukasey

Once you connect the dots they all point to 9/11. You heard it here first.

Wait til some kids get the bright idea to try waterboarding on their friends and someone dies. Are we then gonna claim he wasn't tortured to death?

A dark time in American history.

Anyone who looks at this situation and cannot understand why it is happening is a dumbfuck. It is all totally unexplainable why two Dems would vote to send the confirmation to the senate floor. Right? Wrong. Anyone who is willing to put emotion aside and look at things logically would tell you that the big money brokers, the corporations have gotten to Schumer and Feinstein. Nuff said. If Dubya goes down for all his administrations illegal practices so do alot of corporate power brokers. Why do you suppose impeachment is off the table? Come on people cast off all this emotional turmoil that you are getting from your dissappointment in the Dems and look at what is happening. We dont have checks and balances even when the ruse is on and they want us to believe we have checks and balances.

Schumer: ”When Judge Mukasey came before the Senate judiciary committee last month he refused to state waterboarding as torture. That was unsatisfactory, that was wrong. That will be a blemish on judge Mukasey’s distinguished career for as long as he lives. But he has made it clear that if Congress passed further legislation in this area, the President would have no legal authority to ignore it…

This is simply Schumer and Specter trying desperately to give Bush and all his cronies immunity from all the illegal crap that they have attempted to justify in the name of the "war on terra". Why do you think they are trying like hell to pass through immunity for telecoms. Because they know what they did is illegal. Waterboarding is torture. It has been considered such for all of american history. NOW they want to pass a law? NOW? Give me a break.

Schumer and Feinstein et al. gave them cover to appear nice and vote against him because it was a foregone conclusion that Mukasey would get through anyway. Simple math: Had all Dems voted with instead of against their party (including the four chickenshit pres candidates who didn't vote at all) Mukasey would still be helping Silverstein cash in on 9/11. But nooo.......

I'll take advice from you on the beauty of life and the cruelty of death when I blow my own fucking head off.

Troll: guaranteed. Just trying to give Marx and Lenin a bad name.

Thanks, Chuck -- for reminding me why I'm not voting for you in the next election.

Just who in the hell do you think your shittin here Shumer???
When has a law or congressional decree of any kind got in the way of Chimpy doing whatever he damn well wants.... Just for instance, did you forget about those 'signing statements' Bush has abused for seven years???? Well I haven't... You can kiss my ass with you phony placating bullshit Chucky......JD

No Senator Schumer, a blemish on your record is when you got caught stealing a Playboy from the convenience store down the block as a teenager. This is so far beyond blemish, but hey, it's not like he'll actually be torturing people right Senator? Why doesn't Congress just have a big picture with Cheney where they give America the finger and say "Go **** Yourselves!" to the camera?

I trust that the names of the fake Democrats who confirmed Mukasey have been duly noted in the ScandalBase.

He should just STFU.

Feinstein is no longer a Democrat. She is a Bush Democrat. I'm sick of her. How dumb can this new attorney general be if congress has to pass a law every time he has to make a decision. I watched the whole thing. Schumer made a good point. If they didn't confirm him Bush would pick someone in the dept. to run things. We would definitely have another Alberto Gonzales, this way we at least have a chance that Mukasey is better.

Those voting YEA are now potentially war criminals. They are undeniably enablers. Can we request the Hague to make a pre-emptive strike on US before these ass-clowns stir up some really serious sh*t that they also cannot handle?

Remember the elections of '06 when we need 6 democratic senators elected to tip the balance of power and this was supposed to be highly unlikely? And we all watched and listened to the election coverage and when it was over, 6 democratic senators had been elected? And we all thought this was so wonderful and amazing that now we had enough people to stop the congressional rubber stamp? Remember that? That was a long time ago. Apparently we still have a lot of work to do.

Yes...

We need a roto-rooter...

A clue as to why Feinstein voted the way she did? Maybe she didn't have the right issue in mind. Like many I wrote her to express my disgust with her vote on Mukasey. Today I got this in my mailbox. I've included just the first couple of paragraphs but rest assured, there was not one work about her Mukasey vote anywhere in the whole long email.

Dear Mr. Xxxxx:

Thank you for writing to express your concern about the conflict in Darfur. I appreciate hearing from you on this very important issue and welcome the opportunity to respond.

As a steadfast supporter of human rights, I share your concern about the situation in Darfur. According to United Nations (UN) and U.S. officials, since the killing began in 2003, more than 400,000 people have lost their lives and more than 2 million have been displaced by Khartoum's systematic campaign to eliminate the non-Arab tribal groups in Darfur.

It would appear that the good senator has a problem remembering which issue she's dealing with.

listening to feinstein and schumer, all i could think of is they sound like battered people. i have to do what bush says or it will be worse for me. why are they so afraid of a coward who advanced to the rear when it was his turn to serve this country? how soon can we have a recall?

I truly believe that this ilegal wire taping has allowed the Bush Administration to collect enough embarrassing information on its opponents that they can manipulate them at their will.

You've got a good point there, xdC. I would not be surprised if the demoquacks in the Congress (House and Senate both, of course) bring forth a motion to cancel the 2008 elections so that fuhrer bush can continue his glorious reign over what once was a functioning democratic republic.

The illegal domestic surveillance performed by the neofascists in our government, perhaps since before the 2000 election, may well do in our country. Remember that Gore virtually caved without much of a fight - "for the sake of the country". They probably had the goods on him too.

No doubt, Kucinich works for us.

Unfortunately, I meant someone who matters.

What a ridiculously inappropriate remark. A man of small staure and great courage goes for broke in our behalf, stands before the entire world and states the painfully obvious for the whole world to hear that "We the People" do not march to the drum of this Administration, and you say, " I meant someone who matters." I submit to you that a remark like that marginalizes his efforts to stand for us even more than his treatment by the MSM. It is not only inappropriate, it is damned unappreciative of a fine man's effort. One damned Congressman stands up and does his job, and he gets, "I meant soneone that matters?" I am so tired of hearing he is unelectable. By God, if every swinging dick that said he is unelectable got off their sofa and turned off the damned "reality show du jour" and voted for him, it would be a freaking landslide! America needs to wake the Hell up, and elect a leader, not a freaking GQ model. I need a President, not freaking make-up tips.

1-I will vote for an INDEPENDANT in a heart beat for president- BRING EM ON!!!

2-I will not vote for Billory, Obama or Edwards - none of them wants to or would impeach, all of them have stated that very clearly.

3-I will vote Rep if necessary, I will not vote for any Dem this time around- maybe in 2012-13

4- These people do not deserve a vote and a vote for a Rep is the same anyway, they all want the Iraq war and they are all in favor of attacking Iran.

watch wait and see a Dem white house will keep the Iraq war, and more than likely support easily a war in Iran- cause they are doing nothing to stop one now.

GET RID OF EM- THEY SUCK

NO DIFFERENCE = NO DIFFERENCE

In other words, Mukasey is saying that signing statements have NO legal validity. So let's just do what we can to hold him to that.

Pointless, Alito - under Reagan - defined using signing statements to redefine legislation. Alito is now on the supreme court - or did you wonder why Bush wanted him so badly.

Democrats voted to give Bush all the money he wants to continue the war in Iraq. Democrats voted to give Bush and invasion mandate by officially labeling the Iranian army terrorists. Democrats voted to kill the impeachment of Cheney. Today, Democrats caved in to Repugs and voted to confirm a torture advocate as Attorney General. The Democrats repeatedly bend over and take it up the ass from the Republicans in a manner of abject submission reminiscent of a prison rape scene. Dems should now be washing the underwear of Republicans; plus braiding their hair and cooking them eggs for breakfast.

Once upon a time, the U.S. did not condone torture. And once upon a time, I did not have to account for myself when I approach a federal courthouse with a camera... The security guard asks me for my ID, and I have the feeling he will not accept "Madison Guy" as an answer. Before we're through, I discover that the pillars that hold up our temple of justice aren't nearly as solid as they seem.

I just saw on the 700 Club News (while I was scrolling through the channels - believe me I don't watch that channel) that Kucinich's Impeachment Resolution was struck down in Congress today. Is this true? Then they interviewed Lynn Cheney and she laughed about it . . . right-wing bitch . . . She went on to say Kucinich is a "non-person" and can't be taken seriously.

I keep reading you all saying we need to Impeach Cheney but it doesn't look like it's gonna happen. We can''t even get an Impeachment Resolution to even stick.

Congress is utterly and completely useless. There is no way that impeachment or any resolution to hold Bush and Cheney accountable for their crimes will go through with this congress. How the hell they continue to placate Bush and Cheney is beyond me. What a bunch of wimps.

Redacted portions of Court filing show FBI threats. Possible insights into state secrets-rendition-related activity. Remember, once something is disclosed -- even inadvertedly -- it is admissible. Even for a war crimes prosecution against US government officials in the judiciary.

2) You say that the Congress needs to create a bill that say Waterboarding is torture.

3) Bill passes by slim majority because most of the congress are schmucks like you

4) Bush vetoes bill

5) Chickenshit congress can['t override bill

6) Chickenshit Dems in congress throw up their hands and say Well we tried.

I think we may all be in for a big surprise.

Just received this in response to my letter to Senator Mikulski regarding FISA. I actually sent the letter a few months ago and just received the response yesterday.

Dear Mr. "Chip":

Thank you for getting in touch with me to express your concerns about the Foreign Intelligence Surveillance Act (FISA). I appreciate learning of your views about this important matter .

As a member of the Senate Intelligence Committee, I am very aware that terrorists plan and intend to harm the United States and the American people. I hear about these threats every day - and I take them very seriously. Yet I agree with you - that even as our nation faces new threats, Constitutional protections must be safeguarded.

The FISA Act was created in 1978 to regulate how electronic surveillance was conducted in the United States . This law needs to be updated to account for changes in communications technology over the last thirty years.

As you know , Congress passed a temporary revision of FISA. I had preferred an alternative written by Senators Rockefeller and Levin. That legislation did not have the votes to pass, so I supported a temporary bill that would improve intelligence collection, while enabling Congress to modernize FISA responsibly and comprehensively. Recently , I voted for bipartisan legislation passed by the Senate Intelligence Committee that fixes a number of pr oblems with the previous bill.

This new legislation strengthens national security while protecting civil liberties. The bill strengthens the role of the FISA Court by requiring greater judicial review. The bill also improves oversight and accountability of the entire FISA proces s. While the Bush Administration wanted full immunity for the telecommunications companies and anyone else who assisted the government after September 11, the Senate Intelligence Committee bill provides more narro w, focused immunity. As an added safeguard, the bill sunsets in six years to enable a full evaluation of the laws governing electronic surveillance .

I understand that you may still have concerns about some of the provisions of the FISA reform bill. Yet I feel it is essential that this law is updated to ensure that we prevent terrorist attacks against our country.

Thank you for getting in touch with me. Knowing your views will be helpful to me as the full Senate considers the FISA bill.

Sincerely,
Barbara A. Mikulski
United States Senator

Mikulski was my Senator since before i could Vote until the end of August when i moved out west.

She sucks,

It was sent to the Judiciary, and Conyers hasn't ruled sending it to the full House. In fact, he (in response to it being sent to the judiciary) spoke more positively about impeachment than he's talked since the Dems regained the majority.
