Unfortunately, while I know he would be required to resign his judgeship upon taking office in the Executive Branch, I don't think he would have to step down just to run. He might have to recuse himself from various elections-based cases or to refrain from taking part in deliberations during his campaign, but I have a feeling he'd be allowed to keep his seat on the Court up until he took the oath of office for the vice presidency.
Meaning, we'd be stuck with him no matter what. He'd either resume his judicial duties upon losing, or President McCain would appoint his successor upon winning.
In the case that he was just dumb enough to resign (or in the case that I'm wrong about this), surely the Oval Office Orangutan would appoint nominate another Thomas. And then we'd really see who the Democrats are in the Senate. It would mark the perfect -- absolutely perfect -- opportunity to give Bush the finger, and reject any nominee until Bush himself has left office. Sadly, I'm not even sure they'd do that. They'd come up with some "gotta do what's best for the country" argument, and give Bush another win.
The Court may proceed with 8 justices, and very often does. It may proceed with less than 8, and very often does. Justices sometimes can't take part in a case for one reason or another. They're sick; they recuse themselves for conflicts of interest; etc.
Conceptually, this poses no problem except how to interpret the law in the case of a tie vote. But even quasi-tie votes happen when there is an odd number of justices sitting. Don't write me off as crazy just yet. ;)
The most prominent example in recent history concerned affirmative action in the 1980s. 4 Justices wanted to strike down the law in question based on a statute. 4 other Justices wanted to uphold the affirmative action law on Constitutional principles. And that left Justice Powell, who didn't agree with either side.
Powell came up with the construction that we now all know. That certain kinds of affirmative action are Constitutional, but absolute racial quotas are not.
Powell's decision of one then became the law. It was the most narrow and constrained of the three decisions drafted, and lower courts tend to favor such decisions in the cases of tie votes like this one. Had one of the 4-judge decisions been the most narrow, they'd probably have gone with that one when deciding later cases.

It is precisely because the Thomas appointment was an act of manipulation by a racist President, not only of perceived black folks attitudes, but on the perceived lack possibilities of refusal of the confirmation committee that I used the word cynical. The confirmation committee couldn't deal with it. It is the same use of the word as in the sentence: 'Hitler had struck a cynical deal with Stalin'.
The Thomas appointment was meant to look like one thing, but be something entirely different. That is entirely cynical. I believe the appointment was improper. I believe my use of the word was proper.
As far as 'race' as a social construct. Half of my neighbors are of African heritage (more recent than my own). I am a good neighbor to them, they are good neighbors to me, I learn as much as I am able about the world as they see it. We all know it is far from perfect. I don't treat anyone differently. I respect everyone unless they disrespect me. You can never put yourself entirely in someone else's shoes. It is said that privilege is invisible to those that possess it. But one can learn. From an economic standpoint I am not in a position of privilege. None of us are here.
My hope is that we can stop talking about race and instead begin to focus on the economic plight of the people on the bottom. Whatever they look like. All of them. The way this society is going, a lot of people are going in reverse.

I don’t know how one can be congratulated for a demonstration of leadership and competence when the enemy has been bribed not to attack U.S. troops.
How does an intellectually and morally challenged follower like Clarence Thomas become the most impressive conservative in American public life? It doesn’t say very much about other conservatives.

They are fighting a war that should not have been fought.
They interpret laws in ways that were not intended.
Their decisions are arbitrary and self-serving.
They have turned the Supreme Court into a political joke.
They have preverted the purpose of the Department of Justice.
They pray to a god that by all appearances they do not believe in.
They are cynical about and callous toward the American people.
They have elevated being self-serving to a virtue.
They surround themselves with people who tell them what they want to hear.
They believe their own lies.
They use propaganda against Americans as if we are the enemy.
Their system of patronage elevates cronies without the competence or integrity to be in the positions given.
They claim that they do not have a clue where billions of dollars went when billions of dollars require helicopters to carry it.
They claim to be interested in national security when the only security they are interested in is their own.
If one gave them a penny to tell the truth and a dime to lie, they would take the dime every time.
Conservative perception is not equal to the task of participating in the new global economy without resorting to violence to accomplish goals that could have been achieved through negotiation.
Their lack of respect for human life is revealed in the death tolls on both sides for an unnecessary war.
Their objectivity is compromised by their coziness with certain individuals who are motivated by personal interest rather than U.S. national security.
Until they change their ways, they should not be elected to dog-catcher due to the unnecessary harm they have caused to our reputation, our economy, and our sense of community.

Wouldn't Thomas be forced to resign from the Supreme Court? Charles Evans Hughes was an Associate Justice when he ran for President in 1916 and he resigned his seat. Herbert Hoover later renominated him to the Court making him Chief Justice.
Kristol last year believed that Dick Cheney would be the nominee. Is he ever right? Just once would be nice. He'd probably have a meltdown of some kind.

I love it. What a beautifully elegant way to get him off the court. Is there a way to nominate the other four repugs on the bench as well. Wouldn't it be lovely for Obama to replace all five during his presidency?

I can just see him in the VP debate not saying a word the entire election. That may not be such a bad thing as he is one of the worst justices we've ever had.
It says a lot about the state of the repuublicans when Clarence Thomas or a military general would be considered as the viable candidates for McCain's VP
A conservative guy I know insisted Kristol was a liberal (after I torpedoed his NYT's are all liberals simple talk). I can totally see him as a liberal know. I mean Clarence Thomas...the most liberal guy on the Supreme Court.

How does McSame acknowledge Bush's mistakes and at the same time run on a platform that promises more of the same? Oh yeah, I forgot Republican doublespeak. By all means, Clarence Thomas is definitely V.P. material. He has really impressed me; especially all those precedent setting majority opinions he has written. I thing McSame and the Black Albatross would make one helluva ticket. Go for it!
