Republicans have no Heart, confirmed:
Ann and Nancy Wilson are pissed at the Republican Party and have fired off a cease and desist letter to the McCain/Palin campaign.
Specifically, the Heart women are upset that the GOP has used their classic "Barracuda" as a theme song for Sarah Palin. TMZ obtained a statement from Heart's rep, who says "The Republican campaign did not ask for permission to use the song, nor would they have been granted that permission."[..]
UPDATE: Twenty minutes after we posted this story, the GOP ended the evening after McCain's speech with the song, "Barracuda."
Gotta love these "Rule of Law" Republicans. And not the first time for McCain either. He has been sued by Jackson Browne for using his song, served with a Cease and Desist for using a Frankie Valli song, used footage of the Wayne and Garth characters from Wayne's World without permission, and used the Theme from Rocky without permission. You know, the first time you make this mistake, I can write it off as a honest error. But over and over and over, especially using songs from known Democrats like the Wilson sisters and Jackson Browne. That just goes over the abyss into complete arrogance.

You act surprised. As long as the gains are better than the consequences, they will break the law. So in this instance, creating the impression that they're tough is worth much more than the $250k or so they'd have to pay if Heart actually went through with their suit (which they won't). Preventing democratic GOTV efforts in a swing-state by jamming their phone lines is worth more than a few months of jail time for a mid-level operative. Even engaging in election fraud is worth it as long as it gets they don't reverse the results (which no court would do).

They're doing what a landscape mentor of mine once told me: "Sometimes it is easier to apologise than to ask permission." Of course the caveat is that if the action goes wrong, you don't try to sneak something past the customer again and again, then say oops sorry again. (If you're good though, it doesn't go wrong).

I think a better choice of songs for Palin would have been the theme song to the movie Jaws. Palin may have been a barracuda on a high school basketball court but she is in the shark's tank now. Just a note on republican openness to ideas other than their own - Last night when I left work I was told my work was "beautiful". My first thought was that I was dismay that the Wilson sister supported John McCain by allowing to use their song at the end of the convention. This news restored my faith in them, and they are rightly to be piss about this. Now not only were they rip off for usage rights, but also seemingly force to declare their belief which should have been a personal matter. Everyone now knows that the Wilson sister are not republican.
They just got a notice from Jackson Browne and just to keep doing it after making one mistake to make another, really exemplify that this is how they will be in if they get into the executive branch.

Other than displaying a lack of understanding of copyright law, you haven't accomplished much here. You don't need specific permission before you play a song at a public event. So long as they sent a check to ASCAP to cover the licensing fee, they are free and clear. They would probably agree to a cease and desist order because it sure as hell isn't worth taken this has-been group to court. Nevertheless, Heart would be in no position to sue. If McCain/Palin bothered to fight, they'd assuredly win.

And it's funny that the lyrics to "Barracuda" target people exactly like McCain, since the Wilson's wrote it (if I remember correctly) because an unscrupulous manager or public relations director kept feeding salacious sex scandal lies about them to the press to titillate the public: "If the real thing don't do the trick, you better make up something quick. You gonna burn to the wick, Barracuda!" In other words, "if the truth isn't good enough for you, you start lying. You're gonna pay!" How appropriate for McCain that the song is essentially the Wilson sisters confronting someone in power about lying.

This really isn't surprising. From the same thugs who wadded up the constitution and used it as toilet paper.
Since "celebrities" are all subhumans in their eyes, they feel they can do as they please. With the exception of rightwing nutjobs like Ted Nugent, all they're doing is losing the musician, artist and actor votes.

I was wondering that when I heard it played, are they allowed to use a song like that. Not sure, I mean, restaurants are paying royalties on every song played but this is different as it's being aired on television...but if you interview me on the street and a car radio has a song playing in the background do you have to pay them royalties...at least all these considerations would have me consulting a lawyer to see what was allowed.
Maybe they did, maybe they're allowed...maybe not.
So that's a lot of nothing on my part!

I have been a Heart fan for decades (am I that old now?!) and the second I heard "Barracuda" in the background at the convention, I knew my girls would be furious. Go Ann and Nancy with your cease & desist!
Not to mention, other than the title, the song is completely wrong, being about men not treating women in their profession right and trying to screw them out of what is theirs....oh, wait....hmmmm
