Glenn Greenwald, who's a former constitutional attorney, is very unhappy with this move from the Justice Department:

[...] Late Friday afternoon, the Obama DOJ filed the government's first response to EFF's lawsuit (.pdf), the first of its kind to seek damages against government officials under FISA, the Wiretap Act and other statutes, arising out of Bush's NSA program. But the Obama DOJ demanded dismissal of the entire lawsuit based on (1) its Bush-mimicking claim that the "state secrets" privilege bars any lawsuits against the Bush administration for illegal spying, and (2) a brand new "sovereign immunity" claim of breathtaking scope -- never before advanced even by the Bush administration -- that the Patriot Act bars any lawsuits of any kind for illegal government surveillance unless there is "willful disclosure" of the illegally intercepted communications.

In other words, beyond even the outrageously broad "state secrets" privilege invented by the Bush administration and now embraced fully by the Obama administration, the Obama DOJ has now invented a brand new claim of government immunity, one which literally asserts that the U.S. Government is free to intercept all of your communications (calls, emails and the like) and -- even if what they're doing is blatantly illegal and they know it's illegal -- you are barred from suing them unless they "willfully disclose" to the public what they have learned.

There are several notable aspects to what happened here with this new court filing from Obama:

(1) Unlike in the prior cases where the Obama DOJ embraced the Bush theory of state secrets -- in which the Obama DOJ was simply maintaining already-asserted arguments in those lawsuits by the Bush DOJ -- the motion filed on Friday was the first response of any kind to this lawsuit by the Government. Indeed, EFF filed the lawsuit in October but purposely agreed with Bush lawyers to an extension of the time to respond until April, in the hope that by making this Obama's case, and giving his DOJ officials months to consider what to do when first responding, they would receive a different response than the one they would have gotten from the Bush DOJ.

That didn't happen. This brief and this case are exclusively the Obama DOJ's, and the ample time that elapsed -- almost three full months -- makes clear that it was fully considered by Obama officials. Yet they responded exactly as the Bush DOJ would have. This demonstrates that the Obama DOJ plans to invoke the exact radical doctrines of executive secrecy which Bush used -- not only when the Obama DOJ is taking over a case from the Bush DOJ, but even when they are deciding what response should be made in the first instance. Everything for which Bush critics excoriated the Bush DOJ -- using an absurdly broad rendition of "state secrets" to block entire lawsuits from proceeding even where they allege radical lawbreaking by the President and inventing new claims of absolute legal immunity -- are now things the Obama DOJ has left no doubt it intends to embrace itself.

(2) It is hard to overstate how extremist is the "sovereign immunity" argument which the Obama DOJ invented here in order to get rid of this lawsuit. I confirmed with both ACLU and EFF lawyers involved in numerous prior surveillance cases with the Bush administration that the Bush DOJ had never previously argued in any context that the Patriot Act bars all causes of action for any illegal surveillance in the absence of "willful disclosure." This is a brand new, extraordinarily broad claim of government immunity made for the first time ever by the Obama DOJ -- all in service of blocking EFF's lawsuit against Bush officials for illegal spying.

As EFF's Kevin Bankston puts it:

This is the first time [the DOJ] claimed sovereign immunity against Wiretap Act and Stored Communications Act claims. In other words, the administration is arguing that the U.S. can never be sued for spying that violates federal surveillance statutes, whether FISA, the Wiretap Act or the SCA.



Remember how Republicans insisted that a president deserves to have the advisers he chooses? When it's a Democrat in office - not so much.

Scott Horton in The Daily Beast says the Republicans are holding hostage two Obama nominations to keep the torture memos from being released:

Senate Republicans are now privately threatening to derail the confirmation of key Obama administration nominees for top legal positions by linking the votes to suppressing critical torture memos from the Bush era. A reliable Justice Department source advises me that Senate Republicans are planning to "go nuclear" over the nominations of Dawn Johnsen as chief of the Office of Legal Counsel (OLC) in the Department of Justice and Yale Law School Dean Harold Koh as State Department legal counsel if the torture documents are made public. The source says these threats are the principal reason for the Obama administration's abrupt pull back last week from a commitment to release some of the documents. A Republican Senate source confirms the strategy. It now appears that Republicans are seeking an Obama commitment to safeguard the Bush administration's darkest secrets in exchange for letting these nominations go forward. (...)

The Justice Department source confirms to me that Brennan has consistently opposed making public the torture memos -- and any other details about the operations of the extraordinary renditions program -- but this source suggests that concern about the G.O.P.'s roadblock in the confirmation process is the principle reason that the memos were not released. Republican senators have expressed strong reservations about their promised exposure, expressing alarm that a critique of the memos by Justice's ethics office (Office of Professional Responsibility) will also be released.

"There was no 'direct' threat," said the source, "but the message was communicated clearly -- if the OLC and OPR memoranda are released to the public, there will be war." This is understood as a threat to filibuster the nominations of Johnsen and Koh. Not only are they among the most prominent academic critics of the torture memoranda, but are also viewed as the strongest advocates for release of the torture memos on Obama's legal policy team.

A Republican Senate staffer further has confirmed to me that the Johnsen nomination was discussed at the last G.O.P. caucus meeting. Not a single Republican indicated an intention to vote for Dawn Johnsen, while Senator John Cornyn of Texas was described as "gunning for her," specifically noting publication of the torture memos.

This was a deeply cynical policy, cast as concern for the surviving family members. Just another way the Bush administration covered up the real cost of war:

DOVER, Del. — For the first time since an 18-year ban on news coverage of returning war dead was lifted, the media witnessed the arrival Sunday night of a soldier killed overseas.

After receiving permission from family members, the military opened Dover Air Force Base in Delaware to the press. An eight-member team wearing white gloves and camouflage battle fatigues carried the body of 30-year-old Air Force Staff Sgt. Phillip Myers of Hopewell, Va., off a military jet in a solemn ceremony on a cool, clear night.

Myers was killed April 4 near Helmand province, Afghanistan, when he was hit with an improvised explosive device, the Department of Defense said.

The ceremony under the yellowish haze of airport floodlights took about 20 minutes with Myers' wife and other family members in attendance.

Myers was a member of the 48th Civil Engineer Squadron with the Royal Air Force in Lakenheath, England, one of the bases the U.S. Air Force uses in the country. He was awarded a Bronze Star for bravery last year in recognition of his efforts in support of Operation Enduring Freedom, the Department of Defense said.

The new Pentagon policy gives families a choice of whether to admit the press to ceremonies at Dover, home to the nation's largest military mortuary and the entry point to the U.S. for service personnel killed overseas.

The rescue efforts are being hampered by strong aftershocks:

L’AQUILA, Italy — More than 90 people died and tens of thousands were left homeless when an earthquake with a magnitude of 6.3 shook central Italy early Monday morning, seriously damaging buildings in the mountainous Abruzzo Region east of Rome, officials said.

The Italian news agency, ANSA, quoted rescue workers in mid-afternoon as saying the death toll had reached 92. A spokesman for Italy’s Civil Protection Agency said on national television that an estimated 40,000 to 50,000 people had been left homeless.

The epicenter was in L’Aquila, a picturesque Medieval fortress hill town, where most of the deaths occurred, officials said. Aftershocks shuddered through the area, hampering rescue efforts as people clawed through the debris by hand, frantically seeking survivors.

“Some towns in the area have been virtually destroyed in their entirety,” Gianfranco Fini, speaker of the lower house of Parliament, said in Rome before the chamber observed a moment of silence.

And here's a perfect example of why you should question authority:

ROME (Reuters) - An Italian scientist predicted a major earthquake around L'Aquila weeks before disaster struck the city on Monday, killing dozens of people, but was reported to authorities for spreading panic among the population.

The first tremors in the region were felt in mid-January and continued at regular intervals, creating mounting alarm in the medieval city, about 100 km east of Rome.

Vans with loudspeakers had driven around the town a month ago telling locals to evacuate their houses after seismologist Gioacchino Giuliani predicted a large quake was on the way, prompting the mayor's anger.

Giuliani, who based his forecast on concentrations of radon gas around seismically active areas, was reported to police for "spreading alarm" and was forced to remove his findings from the Internet.

Italy's Civil Protection agency held a meeting of the Major Risks Committee, grouping scientists charged with assessing such risks, in L'Aquila on March 31 to reassure the townspeople.

"The tremors being felt by the population are part of a typical sequence ... (which is) absolutely normal in a seismic area like the one around L'Aquila," the civil protection agency said in a statement on the eve of that meeting.

"It is useful to underline that it is not in any way possible to predict an earthquake," it said, adding that the agency saw no reason for alarm but was nonetheless effecting "continuous monitoring and attention".

As the media asked questions about the authorities' alleged failure to safeguard the population ahead of the quake, the head of the National Geophysics Institute dismissed Giuliani's predictions.

On "This Week", George Stephanopoulos asks Susan Rice, our U.N. Ambassador, about which avenues the U.S. will pursue after North Korea's missile launch:

STEPHANOPOULOS: Is the United States prepared to pressure China?

RICE: We're working very closely with China. China shares the same goal that we do, which is a de-nuclearized Korean Peninsula. China also is very proximate, on the border with North Korea, and shares our desire not to see this situation escalate, and to ensure that we can achieve, George, the long-term goal, which is de- nuclearization of the Korean Peninsula through the six-party talk process.

STEPHANOPOULOS: But because China is right on the border of North Korea, they've been reluctant to really pressure North Korea. They're afraid that if you turn the screws too hard on North Korea, the regime is going to collapse and there's going to be chaos.

And is that why they are not going along with tougher sanctions?

RICE: Well, I think they have multiple concerns. They are looking at the large long-term goal of ensuring that we don't have a nuclearized Korean Peninsula. There have been times when we have differed as to the best means of achieving that.

But we are unified with China and others in the six parties towards the goal, George, of ensuring that we roll back this nuclear program that North Korea is pursuing.

Obama: Security Council Should Punish N. Korea

This story dominated the talking bobblehead shows this morning:

PRAGUE — President Obama said that North Korea violated international rules when it tested a rocket that could be used for long-range missiles, and he called on the United Nations Security Council to take action.

“This provocation underscores the need for action, not just this afternoon at the Security Council but in our determination to prevent the spread of these weapons,” Mr. Obama said. “Rules must be binding. Violations must be punished. Words must mean something.”

The United States Northern Command issued a statement that North Korea’s Taepodong 2 missile flew over Japan, with its payload landing in the Pacific Ocean.

“No object entered orbit and no debris fell on Japan,” the assessment said.

White House officials said that the failure of the launch would not stop the United States from taking the matter to the Security Council. “I think there have been a number of instances now where the North Koreans have failed in these attempts,” White House Spokesman Robert Gibbs said. “The launch itself was a violation,” he said, adding that the fact that the launch failed did not make a difference in pursuing punitive sanctions.

It's very unlikely now that direct talks with N. Korea will take place after such a provocative action:

American diplomats and their partners in east Asia privately regarded the launch as a fait accompli. U.S. President Barack Obama's special envoy, Stephen Bosworth, has said that launch or no launch, Washington hoped to push on with talks aimed at getting the North to give up its nuclear weapons program — even hinting that the direct U.S.-North Korean talks Pyongyang has always wanted were possible.

The launch complicates that diplomacy. Tokyo in particular is furious at Pyongyang — it had earlier in the week threatened to shoot the missile down — and immediately after the launch asked for an emergency session of the U.N. Security Council to take place on Sunday. Both Tokyo and the South Korean government believe the rocket launch was an explicit violation of a 2006 U.N. resolution that insisted the North "not conduct any further nuclear test or launch of a ballistic missile." The North for its part insists it has the right to place communications satellites in orbit, which it claims was the purpose of Sunday's launch, just as the Iranian government did earlier this year.



Hundreds of Thousands About to Lose Unemployment Benefits

I've sent out more than a hundred resumes since last year, and I've gotten exactly one callback. And it's not as if I'm being fussy, either. Yeah, it's pretty ugly out there:

WASHINGTON - In the coming weeks and months, hundreds of thousands of jobless Americans will exhaust their unemployment benefits, just when it's never been harder to find a job.

Congress extended unemployment aid twice last year, allowing people to draw a total of up to 59 weeks of benefits. Now, as the recession drags on, a rolling wave of people who were laid off early last year will lose them.

Precise figures are hard to determine, but Wayne Vroman, an economist at the Urban Institute, estimates that up to 700,000 people could exhaust their extended benefits by the second half of this year.

Some will find new jobs, but prospects will be grim: Layoffs are projected to go on, and many economists expect the jobless rate, already at 8.5 percent, to hit 10 percent by year's end.

"It's going to be a monstrous problem," Vroman said.

U.S. employers shed 663,000 jobs in March, and the jobless rate now stands at its highest in a quarter-century. Since the recession began in December 2007, a net total of 5.1 million jobs have disappeared.

Those who know that their unemployment aid is about to run out are counting the days, taking on odd jobs, moving in with relatives and fretting about the future.

"My biggest fear is we'll lose the house," said Hernan Alvarez, 54, an Orlando, Fla., construction worker who lost his job in July and whose benefits will end in four weeks. "The only thing I can do is keep looking for work and hope tomorrow will be better than today."

That so many people have remained on jobless aid for more than a year underscores the depth and duration of the recession, which began in December 2007. If the downturn extends into May, it will be the longest recession since the Great Depression.

Problem could get worse

The jobs crisis it has created has proved worse than most economists forecast — not to mention what lawmakers expected when they extended jobless benefits last year.

In March, nearly a quarter of the unemployed had been without work for six months or more, the highest proportion since the 1981-82 recession.

And the problem will probably get even worse. Employers typically remain reluctant to hire even months after a recession has officially ended. In the 1990-91 and 2001 recessions, the jobless rate peaked more than a year after the recovery began.

"What comes next, I'm afraid, will be the mother of all jobless recoveries," said Bernard Baumohl, chief global economist at the Economic Outlook Group, a consulting firm. "While we may emerge from recession from a statistical standpoint later this year, most Americans will be hard-pressed to tell the difference between a recession and a recovery the next 12 months."



You know how we voters love it when we're being placated! So stories like this are leaked to make Obama look like he's taking a strong stand - but actions are so much louder than words:

The Obama administration is engineering its new bailout initiatives in a way that it believes will allow firms benefiting from the programs to avoid restrictions imposed by Congress, including limits on lavish executive pay, according to government officials.

Administration officials have concluded that this approach is vital for persuading firms to participate in programs funded by the $700 billion financial rescue package.

The administration believes it can sidestep the rules because, in many cases, it has decided not to provide federal aid directly to financial companies, the sources said. Instead, the government has set up special entities that act as middlemen, channeling the bailout funds to the firms and, via this two-step process, stripping away the requirement that the restrictions be imposed, according to officials.

Although some experts are questioning the legality of this strategy, the officials said it gives them latitude to determine whether firms should be subject to the congressional restrictions, which would require recipients to turn over ownership stakes to the government, as well as curb executive pay.

The administration has decided that the conditions should not apply in at least three of the five initiatives funded by the rescue package.

This Bill Moyers interview is going viral so fast, I can't even keep up with it. And for a very good reason - former S&L regulator Bill Black explains exactly why the current banking bailout is a mistake. There's so much information, you simply have to read or watch the entire thing:

BILL MOYERS: Yeah. Are you saying that Timothy Geithner, the Secretary of the Treasury, and others in the administration, with the banks, are engaged in a cover-up to keep us from knowing what went wrong?

WILLIAM K. BLACK: Absolutely.

BILL MOYERS: You are.

WILLIAM K. BLACK: Absolutely, because they are scared to death. All right? They're scared to death of a collapse. They're afraid that if they admit the truth, that many of the large banks are insolvent. They think Americans are a bunch of cowards, and that we'll run screaming to the exits. And we won't rely on deposit insurance. And, by the way, you can rely on deposit insurance. And it's foolishness. All right? Now, it may be worse than that. You can impute more cynical motives. But I think they are sincerely just panicked about, "We just can't let the big banks fail." That's wrong.

BILL MOYERS: But what might happen, at this point, if in fact they keep from us the true health of the banks?

WILLIAM K. BLACK: Well, then the banks will, as they did in Japan, either stay enormously weak, or Treasury will be forced to increasingly absurd giveaways of taxpayer money. We've seen how horrific AIG -- and remember, they kept secrets from everyone.
