Remember yesterday's post about how the Obama administration had refused to release the details of a secret copyright treaty because doing so would compromise "national security?" Well, it turns out that there are plenty of people who are cleared to be privy to this "sensitive" document -- strangely, they all seem to work for giant copyright companies!

Of course, they're allowed to know what's in the treaty -- but the public, activist groups, consumer rights groups, and the artists whom this treaty is supposed to protect are all forbidden from knowing what it says.

This has been a long time in coming. When you let Nixon off the hook you said "Corruption? criminality? I accept that."

He showed that there is no adverse impact to intruding on the rights laid down by our forefathers. Now, Obama has shown either one of three things. 1) He could not maintain his morales in the role that he was elected into, 2) that he lied his way into office (remember he was an attorney), or 3) he really does not hold power, and another individual/group who holds the reigns have made him aware of the consequences in going against their grain.

What solutions do we have as the people? The sole answer is civil disobedience. We cannot rely on our electorate to accomplish anything on our behalf. It is not profitable to them. Or, if you would like the easy way out, run to another country, and complain about their government when you arrive.

This is not an easy thing to digest. Obama did make it apparent that he has no interest in pushing forward an agenda that benefits the regular Joe Schmoe in American. While senator, he showed that he is not a leader, but someone that follows the pack for personal gain. This is the culture of our elected officials. Perform favors for one in exchange for favors in return. This is an ugly truth about politics. I've heard one congressman say that you have to be willing to sell your own grandma. Pretty ugly, but so is politics.

The claim of national security has been used since at least Pearl Harbor to keep politically explosive material hidden from the public.

There are still a lot of pearl Harbor-related documents that are classified on the grounds of national security.

Why? So the public won't see that Roosevelt had clear foreknowlege of the attacks. Read, e.g., "Day of Deceit".

Another example: There are LOTS of CIA and FBI documents on the JFK assassination that remain hidden away on the grounds of national security. We all know why.

The American people have gone along for the ride on these cover-ups.

If C&L is open to suggesting it publicly, we need a peaceful protest against copyright laws. Make Obama return the laws to what they used to be: works enter the public domain 50 years after publication, not 90 as the rewritten laws currently are.

I advocate that people start copying and distributing published works recorded in 1958 and earlier or which would have entered the public domain by now under older laws. I do not mean the public should do it for profit or to avoid paying royalties, but rather as a big middle finger to the corporations which have bribed politicians to extend copyright laws unnecessarily. Most notable and guilty of such bribery (under the false name of "lobbying") are record companies and Disney, among many others.

The public should obey copyright laws to the letter as they once were, but without reselling works that would have entered the public domain. For example, "Steamboat Willie" should have entered the public domain 30 years ago, and Duke Ellington's and others' music recorded before 1959. If an organized campaign were to start file sharing these pieces enough times, Disney and record companies would be unable to sue or name everyone. Eventually, they might be forced to relent just to get a reasonable 60 year expiration date.

The most egregious thing about the rewritten copyright laws is the hypocrisy of those who own the copyrights and want the copyrights to be extended. Disney has profitted tens of millions of dollars from works in the public domain (e.g. Cinderella, Snow White), yet bribes politicians repeatedly to prevent their own works from entering the public domain.

This has to stop. Having one's property be protected is one thing, but there's a point beyond which it is no longer reasonable and is done solely for greed and selfishness. These companies reached that point twenty years ago, if not longer.

Anyone with a blog (like this site here) is concerned about it. Technically, many of the videos and articles posted here are copyrighted by the original sources.

Myself, as someone who makes a living creating copyrighted material, is very interested in what is going on behind closed doors.

Much like anyone who pays an electricity bill or fills their car with some form of energy providing substance was (or should have been) interested in what Cheney was doing behind closed doors with energy execs in 2001; anyone who reads a blog, newspaper, book, watches a movie, listens to radio or music should have some interest in this subject. Though, I don't expect it to be the forefront of most people's attention given the other more pressing issues of the day.

Do you own the respective copyrights too said material? The Copyright concept, too me seems to be in need of an overhaul. I remember OJ was alleged to have attempted to copyright his initials "OJ" during his infamous trial, so as to make $$ every time someone would use his initials "OJ" to make money? It was a MSM thing so I'm not sure if it was true. :-/

I don't know much about copyrights, though I do believe the terms are far to long. Drug companies get like 20 years, I don't know, maybe that's a patent? We have to get Corporations out of government... like that hasn't been said! :-P

The book (of which I was one of six authors), was scanned (illegally) by the City of Los Angeles and posted online. I stumbled upon it by accident. None of the authors (nor the committee for whom the book was written) was ever contacted for permission.

Since the book was written for a non-profit organization, there is no financial loss for me, though the organization has probably lost sales of books (necessary to recoup the printing costs) still in boxes somewhere.

This issue is indeed an important one for those who depend upon a paycheck from royalties.

The negotiations are secret.

When it comes time for the Senate to ratify the treaty, what has been agreed upon in those negotiations won't be secret.

It's important to know what ACTA, in a general sense is about. Here's a pdf. from the EU which outlines it.

There have been leaks. Here's what, in November, the European Commission (charged by the EU to negotiate the treaty) had to say about the leaks:

"The negotiations are still ongoing. This means that there is no agreement yet, and that, at the time of writing this fact sheet, there is not even a draft text on which negotiating parties converge. A number of "texts", wrongly presented as draft ACTA agreements have been circulated on the web. At a preliminary stage of the discussions about the idea of a future ACTA, some of the negotiating parties have submitted concept papers, to present their initial views of the project to other partners. Some of these concept papers have been circulated on the net or commented in the press and presented as "draft ACTA texts or negotiating guidelines", which they are not."

I'm pretty sure what's got folks upset is that they think that the folks listed at Boing Boing are actually negotiating the treaty. They aren't. They're advisors, and the leaked material is most probably they're advisory papers (And, btw, that's only about 1/4 of the list od advisors. If you keep following the links from Boing Boing, you'll find the rest of the advisors here). But the people who are doing the negotiating for the US are from the USTR, who answer to the President, and ultimately to you and I. It's up to you and I to contact the President and let him know that we won't support him if he agrees to draconian measures in the agreement.

And if he does agrre to these draconian measures, it's up to us to let our Senators know that we won't support them if they vote to ratify such a treaty.

What they(RIAA/MPAA) are fighting for is to protect the profits associated with packaging and distribution. Something the consumer no longer needs or wants.
