Admiral Thad Allen approved part of Louisiana's Barrier Island project proposal today as a component of the Federal oil spill response, opening the door for Louisiana to recover its costs from BP or the Oil Spill Liability Trust Fund.

As important as the costs are, approval is far more significant for Louisiana's coastal wetlands. The proposed plan allows for 45 miles of barrier berms to be constructed immediately to protect the coastline and wetlands from oil, particularly in the event of a hurricane.

The photo at the top is from the plan filed (PDF) with the Army Corps of Engineers. The highlighted areas are where the berms will go.

Hopefully they can get this project underway immediately and complete it fast, before the hurricanes start rolling in.

WASHINGTON - FBI agents recently spent a day interviewing the Army contracting officer who raised concerns that the Pentagon improperly awarded contracts without competition to Halliburton Co., Vice President Dick Cheney 's former company.The Army Corps of Engineers contract officer, Bunnatine Greenhouse, was interviewed last week and now is gathering documents requested by the FBI and Army criminal investigators, her lawyer said Wednesday.

Shepard Smith had a fascinating segment on the catastrophic Gulf oil spill today, featuring an interview with a former nuclear-sub captain who argued persuasively that it was time -- past time, really -- to blow up that leaking oil well in the Gulf and put an end to the massive pollution that's resulted from its being open.

Smith originally brought on Christopher Brownfield to discuss the potential for using a nuclear bomb to stop the leak, and Brownfield said that yes, it was decided a viable way to stop it -- it has been done four times previously. But he gave many compelling reasons NOT to use a nuclear warhead for the job -- the biggest one being that the same job could be accomplished with conventional explosives.

So why aren't we talking about doing this? Well, Brownfield explained that too:

Brownfield: If we demolish the well using explosives, the investment's gone. They lose hundreds of millions of dollars, from the drilling of the well, plus no lawmaker in his right mind would allow BP to drill again in that same spot. So basically, it's an all-or-nothing thing with BP: They either keep the well alive, or they lose their whole investment and all the oil that they could potentially get from that well.

As Brownfield explains, "We need to seal this thing off." Desperately. But why hasn't anyone been bringing a complete shutdown of the well to the table?

Brownfield: Yes, I think -- stopping the spill immediately. And the reason why we haven't seen that option is because, frankly, BP is still at the helm. I think President Obama needs to take charge of this, bring all the assets of our military to bear, bring the U.S. Army Corps of engineers, bring the U.S. Navy, and bring in all the private-sector organizations that have the equipment for deep-sea operations to make this happen. Let's explode this, collapse the well, and put an end to it.

I don't know about the rest of you but this story seems like it should be the final straw:

Scientists are finding enormous oil plumes in the deep waters of the Gulf of Mexico, including one as large as 10 miles long, 3 miles wide and 300 feet thick. The discovery is fresh evidence that the leak from the broken undersea well could be substantially worse than estimates that the government and BP have given.

“There’s a shocking amount of oil in the deep water, relative to what you see in the surface water,” said Samantha Joye, a researcher at the University of Georgia who is involved in one of the first scientific missions to gather details about what is happening in the gulf. “There’s a tremendous amount of oil in multiple layers, three or four or five layers deep in the water column.”

The plumes are depleting the oxygen dissolved in the gulf, worrying scientists, who fear that the oxygen level could eventually fall so low as to kill off much of the sea life near the plumes.

If Brownfield is right, BP has had its chance to save its well. The time has run out.

If Brownfield is right, it's time for the president to seize control of the situation and blow this well up.



As we live through another anniversary of the man-made disaster on the Gulf Coast and the shocking lack of a federal response that caused thousands to die needlessly, thoughts turn again to whether anybody remembers New Orleans and its environs, and whether the proper resources are being deployed to rehabilitate the region. If you listen to the President, of course, his Administration is doing a heckuva job down there. Lots of cabinet members have visited the region, to be followed by the President later this year. The White House has untangled some bureaucracy to allow for more federal assistance to reach the Gulf Coast, and the stimulus has enhanced recovery efforts. And even some local Republicans have praised his approach, particularly the renewed sense of confidence in FEMA.

But that's the White House's spin. And not everyone agrees with it. The Institute for Southern Studies has reported on coalition groups blasting the Army Corps of Engineers for their slow response to restoring the natural barriers - wetlands, marshes, and barrier islands - that could help prevent future hurricanes. New Orleans resident Harry Shearer has more on that. To their credit, the White House has created a federal task force to speed up coastal restoration projects. But on other issues, the ISS has given the Administration low marks.

The Institute of Southern Studies recently released a report that assesses how Washington has handled the storm's aftermath. The ISS asked 50 community leaders to grade the Obama administration's Katrina recovery efforts: Obama got a D+, and Bush was given a D-. If graded on an E for effort curve, Bush probably would have gotten the edge given his authorization of millions in Gulf Opportunity tax credits and bonds, and an extension of time under which developers could use them.

Meanwhile, Obama has done little in seven months beyond distributing $50 million in housing vouchers. Unfortunately, families either won't be able to use them because there aren't enough houses built yet, or the vouchers will be of little use because they only cover a fraction of rents, which have risen substantially since Katrina. He's also instituted a plan to sell FEMA mobile units to families for $1 or $5, but many of those trailers are toxic from formaldehyde leaks.

The American Recovery and Reinvestment Act (ARRA) did little for recovery and reinvestment in the Gulf Coast area that needed it the most. Since calculations were made based off current population numbers -- many displaced people throughout the country are still waiting to return -- fewer ARRA dollars reached these congressional districts. ARRA's tax credit exchange program, which cashes in states' low income housing tax credits, also excluded the Go Zone tax credits, leaving over 17,000 housing units hanging in the balance.

The Lower Ninth Ward, already struggling prior to the flood, has been particularly slow to return to stability. Only 20% of its residents have returned full-time, and the area has lagged far behind the tourist spots and the Garden District.

The neglect of the Gulf both during and after the storm will not get turned around quickly or easily. I'm tempted to cut the White House a little slack on this one. But on the current trajectory, New Orleans is looking more and more in the post-Katrina period like a restored home for the rich and connected, and a nightmare for the voiceless. And given the moral outrage that the response to the storm correctly engendered, that is unacceptable. We have an obligation to those who were left to rot in the fetid waters, not just to give them a return to the same inequality, but a chance at a better life. Should Obama visit the city before the year ends, he shouldn't go to Bourbon Street, but the Lower Ninth, and he should not just tell them what he will do, but back it up.



This USAToday piece leaves out an important piece of the puzzle here. The company who sold the pumps was closely tied to the Bush family, at one time even employing Jeb Bush:

WASHINGTON — Huge flood-control pumps installed in New Orleans after Hurricane Katrina don't protect the city adequately and the Army Corps of Engineers could have saved $430 million in replacement costs by buying proven equipment, a federal investigation finds.

The investigation by the federal Office of Special Counsel finds there was "little logical justification" for the corps' decision to spend hundreds of millions of dollars on the "untested" hydraulic pumps, which are meant to empty millions of gallons of water from the below-sea-level city during storm-related floods.

Nope, no "logical" justification. Just political! From March 2007:

Meanwhile, Sen. Mary Landrieu, D-La., asked the Government Accountability Office on Thursday to investigate the Corps and the contract it entered into with Moving Water Industries Corp.

MWI is owned by J. David Eller and his sons. Eller was once a business partner of former Florida Gov. Jeb Bush in a venture called Bush-El that marketed MWI pumps.

But wait, it gets even worse:

In 2002, the U.S. Justice Department amended its suit against Eller, alleging that he twice flew suitcases of cash to offshore tax havens to hide his assets, the St. Petersburg Times reported. The DOJ also claimed that MWI improperly used more than a third of a $74.3-million U.S. loan to pay a Nigerian agent for the company. In turn, that agent and other company officials paid Nigerian government officials involved in buying MWI's pumps, the lawsuit alleges. MWI denies the charges.

According to the paper:

Between 1985 and 1993, the government says, Eller flew on his company plane to the Bahamas and to Grand Cayman, once with a "large suitcase filled with currency" and once with a "large duffel bag or suitcase filled with currency." At both places, a chauffeured limousine whisked him and the money away. Eller told his pilot he was "moving his assets out of the United States," the lawsuit contends, calling it an effort to shield the money from creditors.

Eller's lawyer, William Scherer, said the flights never occurred and neither Eller nor MWI has accounts in either country.

The lawsuit by the George W. Bush Justice Department suggests no wrongdoing by Jeb Bush, who from 1988 to 1994 worked with Eller marketing MWI pumps to foreign countries, including Nigeria.

Indeed, the amended complaint omits allegations of influence-peddling by MWI -- including Eller's bringing Jeb Bush into the pump business -- leveled in the whistle-blower's recently unsealed lawsuit. That lawsuit prompted the federal investigation.

This begs a couple of questions: Why was a company under DOJ investigation for such serious charges given a major federal contract for New Orleans reconstruction in the first place? And why is the DOJ suit against MWI still unresolved after so many years?



While the corporate media is praising Obama's announcement yesterday to more stringently monitor mountaintop mining, those involved in fighting the massive pollution that results from the practice say it's nowhere near enough. One group's attorney called it "rearranging the bureaucratic deck chairs." (Remember how Obama kept talking about "clean coal"? This is what it looks like, folks: powerful poison dumped into people's lives.)

Friday morning, this terrible news:

Just how bad has the coal ash situation gotten in the United States? So bad that the Department of Homeland Security has told Sen. Barbara Boxer (D-Calif.) that her committee can't publicly disclose the location of coal ash dumps across the country.

The pollution is so toxic, so dangerous, that an enemy of the United States -- or a storm or some other disrupting event -- could easily cause them to spill out and lay waste to any area nearby.

And yet, for some reason, it's perfectly fine when mining companies do it! Hey, how about that "clean coal"?

There are 44 sites deemed by the Environmental Protection Agency to be high hazard, but Boxer said she isn't allowed to talk about them other than to senators in the states affected. "There is a huge muzzle on me and my staff," she said.

In other words, this is a very urgent problem. Activists say all Obama has to do is enforce the Clean Water Act that already exists.

If the Obama administration wants to protect the people and mountains of Appalachia, it needs to end the destructive practice of mountaintop mining, not settle for promises of stricter scrutiny of the mining permits, advocates say.

[...] The White House announced what it described as an “unprecedented” agreement among the Environmental Protection Agency, the Army Corps of Engineers and the Interior Department to better coordinate and tighten the agencies’ oversight of mountaintop mining and to review the mining existing laws.

In a memorandum of understanding, the agencies promised to:

    • Require more stringent environmental reviews for future mountaintop mining permits, including using the Clean Water Act to reduce contamination in streams and watersheds;

    • Propose a rule change to stop allowing a type of nationwide permit that doesn’t require site-specific reviews for mining operations to dump the mineral-laden debris of former mountaintops into streams;

    • Strengthen oversight of state agencies, both in their permitting and enforcement;

    • And, if the U.S. District Court vacates the Bush administration’s 2008 Stream Buffer Zone Rule as requested, return to the 1983 rules restoring the 100-foot buffer zone around streams for mining waste.

These are all steps in the right direction, but they aren’t enough, says Willa Mays, Executive Director of Appalachian Voices:

"Their priorities do not take into account that mountains are being blown up today, and until mountaintop removal coal mining is ended, residents will continue to suffer from high disease rates, floods, and poisoned water supplies directly attributable to this mining practice."

Advocates across Appalachia echoed her concern.

She has asked many questions: Why is Halliburton - a giant Texas firm that holds more than 50 percent of all rebuilding efforts in Iraq - getting billions in contracts without competitive bidding? Do the durations of those contracts make sense? Have there been violations of federal laws regulating how the government can spend its money

Another big story that was going on today was about my first meeting with Bush in June of 2004. For you all I would like to clarify a few things. First of all, I did meet with George, and that is not a secret. I have written about it and been interviewed about it. I will stand by my recounting of the meeting. His behavior was rude and inappropriate. My behavior in June of 2004 and is irrelevant to what is going on in 2005. I was in deep shock and deep grief. The grief is still there, but the shock has worn off and the deep anger has set in. And to remind everybody, a few things have happened since June of 2004: The 9/11 commission report; the Senate Intelligence report; the Duelfer WMD report; and most damaging and criminal: the Downing Street Memos. As we continue to explore the basis underlying our original essay, 'Ten Characteristics of A True US Patriot', it is imperative that we understand not only the principles supporting each individual Characteristic, but also how the Characteristics relate to each other. Without the participation and vigilance of the citizenry, liberty cannot long survive. Bush cut New Orleans Federal Funding

In fiscal year 2006, the New Orleans district of the U.S. Army Corps of Engineers is bracing for a record $71.2 million reduction in federal funding.It would be the largest single-year funding loss ever for the New Orleans district, Corps officials said.

I've been here over 30 years and I've never seen this level of reduction, said Al Naomi, project manager for the New Orleans district. I think part of the problem is it's not so much the reduction, it's the drastic reduction in one fiscal year. It's the immediacy of the reduction that I think is the hardest thing to adapt to....read on
