(Attorney General Edward H. Levi - you wonder what he'd have to say today)

They involve such matters as surveillance at a political convention, investigations of a newsman unsympathetic to the administration cause, or the collection of information on political opponents. The proposed guidelines require that the request be made or confirmed in writing, specify those who may make requests, require the official initiating the investigation be identified, the purpose of the investigation stated among certain routine areas, and where a field investigation is initiated, an attestation that the subject has given consent".

Listening to this address, I wondered what Levi would have to say about Roberto Gonzalez and the shambles the judicial system had become - falling very far from the "high moral ground" we had been so tenuously placed. I was struck by Levi's mention of the "ambiguous nature" of our Constitution as part of the genius of it. But all it of seemed to be based on an assumption it would never be manipulated to fulfill an agenda of fear. The unscrupulous placed in charge to find loopholes in order to justify immoral behavior and the degree in which those behaviors are carried out.

(So infamous, they even wrote songs about him)

The name J.Edgar Hoover has been fading from Americas collective memory the past few decades. He died in 1972. But from 1924 up until his death he ran the FBI, taking it from a somewhat bumbling government agency into a monolith that was synonymous with eavesdropping, wiretaps, file keeping, political power plays, espionage and dirty tricks. He was the reason all subsequent FBI Directors had term limits. He made the FBI his life and his kingdom and was in charge right up to the last. He was the guy with all the secrets and he made a lot of innocent lives uncomfortable as the result.

Here he is from September 23, 1940 giving an address to the America Legion Convention in Boston, talking about one of his favorite subjects, The Communist Threat and "Foreignism".

With all that paranoia floating around, it's a wonder anybody slept at night.

  Because everyone knows the terrorists win if we don't forfeit our Fourth Amendment rights...

A Justice Department plan would loosen restrictions on the Federal Bureau of Investigation to allow agents to open a national security or criminal investigation against someone without any clear basis for suspicion, Democratic lawmakers briefed on the details said Wednesday.

The senators said the new guidelines would allow the F.B.I. to open an investigation of an American, conduct surveillance, pry into private records and take other investigative steps “without any basis for suspicion.” The plan “might permit an innocent American to be subjected to such intrusive surveillance based in part on race, ethnicity, national origin, religion, or on protected First Amendment activities,” the letter said. It was signed by Russ Feingold of Wisconsin, Richard J. Durbin of Illinois, Edward M. Kennedy of Massachusetts and Sheldon Whitehouse of Rhode Island.
