Antonin Scalia is today's Robert Taney, the Chief Justice in 1857 who clumsily ruled that Dred Scot was ineligible of being a US Citizen because he was someone's property. Sure, by the books, but ended up basically precipitating the Civil War which killed countless numbers of Americans...because of a Chief Justice's intransigence beyond what HE thinks is more important. That time, like now, the Congress was in flux and practically at a legislative partisan logjam. At such time you would think, knowing the mess in Congress, that the jUdicial Branch would step up and lead on an issue instead of hiding behind poor precedent. The Government is made up of THREE branches that the founding fathers all considered should LEAD the country in their respective branches. Scalia's routine cowardice in tossing it back to the Congress ignores a common vital responsibility all three branches must acknowledge and that is to DO NO HARM. Scalia and Roberts BOTH know their partisan decisions create harm to their fellow Americans, yet that is lost on a narrow minded ideological interpretation of law without a care to the consequences.
