Saw these guys in the early seventies. Orange sunshine and pot were our drugs of choice before the gig, held in a warehouse in Lexington, Ky. One of the best shows I ever saw at such a small venue. Banks had a great guitar sound and powerful stage presence.

It seems that a lot more than one percent of the thugs in these gangs was armed were they expecting to stop some black from robbing the place?

Over at 'Raw Story,' they have an In Touch Weekly article that says the first report to the parents was in 2002 (Josh 14 years old), but that the family didn't contact the authorities until a police report was filed on December 7, 2006... over 3 years later!
I'm not sure what's right here. But, their story implies that a 3 year wait occurred!
That they might have ran down the clock on the Statue of Limitations.
