On the FISA violations, the Congress appears to look at the law and their oath as discretionary. The public appears to be taking the bait: Congress does something illegal, and the public responds.
To get Congress to change, we have to change how we're interacting with Congress. It can be done. Let's stop playing their game; and make them play a new game, where the rules are stacked against them. There's a way to do it.

A second point before I go to bed. I am not a Hillary Clinton supporter and I have been hearing and reading all day that in an interview she was ask if she thought Obama was a Muslim and she said: "Not as far as I know" as if she had her doubts. Well I finally saw the clip and I was astonished that what I have been hearing was just bull shit. Her exact words were:
You don't believe that Senator Obama is a Muslim?
"Of course not. I mean, that's -- you know, there is no basis for that. You know, I take him on the basis of what he says. And, you know, there isn't any reason to doubt that".
Then she was asked: So you don't believe that he's a Muslim?
She answered: No. No. Why would I? There's no --No, there is nothing to base that on, as far as I know.
Look, I have been the target of so many ridiculous rumors. I have a great deal of sympathy for anybody who gets, you know, smeared with the kind of rumors that go on all the time.
To me that doesn't sound like there is any doubt and all I have heard all day is how she went along with the "Obama might be a Muslim crap" The people I have heard that from should be ashamed.

I met a Muslim man at my caucus in Washington State who was very proud to be a Muslim and voting for a man with Muslim roots. What is wrong with that? Nothing in my mind caused me fear over this mans convictions. I just thought good for him! I'm glad he has passion, belief and he votes. GREAT on him and his religion. I just happen to not really put all that much faith in religion. I put my faith in myself, my friends and my remaining family that are not fundi's. There is a very loud and powerful element in American politics that believes that America is a Christian Nation. They are in the administration. They are in our military. They believe in a revisionist history in which all the famous founding fathers were devout evangelicals. There are Supreme Court justices who believe that the First Amendment does not apply to state governments, and who would remove the federal government's jurisdiction to redress an Alabama-imposed or Utah-imposed theocracy.
Do not underestimate this faction in our politics!
Oh, and the laws of which you were complaining, such as the ones that take away your right to smoke pot . . . . . . those are all religious-based at their core. The First Amendment alone does not protect our freedom of religion!
Read it carefully. The First Amendment is both antiestablishmentarian and antidisestablishmentarian. "Congress shall make no law respecting the establishment of religion, or prohibiting the free exercise thereof . . . "
No law. None. Meaning that if a state establishes a religion, or passes a law against practicing Islam, Congress is powerless to do anything about it.
What really protects our freedom of religion is the Ninth Amendment (though the courts have never recognized this) and the Fourteenth Amendment (which the courts do recognize -- but maybe not for long with the current crop of justices).
We must absolutely understand this if we are really to protect our rights in our system of government.

My argument is, Hillary has had many years to digest all the mistakes made and battles lost. She knows all of their moves and probably has a team already in place to counteract them. She strikes me as a person who will not make the same mistake twice. With Obama, nice guy that he is, will not be able to maintain support when the repubs try and take back the House and Senate (those elections aren't as sexy for the MTV crowd, just ask Bill) and he'll be hamstringed just like Bill. And you and I will be left defending Obama when the shine rubs off. Worst case scenario, he'll be a one term president followed by Romney....oh dear God, I'm never gonna' fall asleep now.

The 1st amendment’s intent was to prohibit a “national religion” as was being practiced at the time by the “Church of England” et al. They were simply saying, no national religion, and no laws establishing one.
This is true, though I'll hasten to add that, personally, I do not subscribe to the doctrine of original intent. I'm a textualist. And I wants judges to construct the Constitution's words, not whatever might have been going on in the minds of the people who wrote those words.
But we all must learn that if the religious right goes to the Supreme Court arguing that the First Amendment actually prevents the federal government from prohibiting each state from violating its own population's religious freedom, the argument will fall on at least four sympathetic ears. This is terrifying! But we can't be gobsmacked by it. We must see it coming. And we must understand the legitimacy of the argument before we can successfully counter it.
The amendments that really protect our freedoms are the Ninth and Fourteenth. We must learn to revere them like we do the First.

Although from an historical perspective, what was taking place at the time, the debates, and the eventual compromises, are all fascinating. But history too is malleable. I once wrote a paper on how different generations/eras perceived historical events dramatically differently, and why history as taught in those various eras was more revealing about those doing the “teaching” than what was being taught. Same applies here.
I also understand that as a lawyer, it is the “text” and the precedent that are paramount. (A little too important for my own taste.)

this is a great ad. how wonderful it would be if our society gained some sense of dignity, of modesty, of privacy, or discretion. if we expected that the personal religious beliefs of each of us were a closely held secret, held in humility and respect, in mystery, apart from the commerce of everyday banter.

Someone told me I should watch this video, so I did, and the accusations just blew me away! It took over an hour to watch this video, but it certainly brought up a lot of questions in my mind about the Clintons. I noticed the video is kinda old too - have these accusations already been debunked? Thanks to anyone who might share some wisdom with this young Texan girl and newly registered voter.

Isn't that was Democrats have been railing for, for the longest time? "We need to become more like them so we don't fall by the wayside." Not policy wise, but attack and re-attack ad wise. Fill the air with enough disinformation and be sure to get your voters out. That's all the Republican's do anymore and even that seems not to be working as much, but I put that at the feet of this admin more than people wanting change.

Just as one listens to some of the phone in calls on hate radio talk shows or C-Span, Judgments are made in many ways. Just as one writes comments in a political blog the ideals are judged. But the reason for what is written can be seem very mysterious to brilliant because translations carry with it not only a misunderstanding of composition, and life, but when done well, can carry an excellent reach to a vision that is compelling to follow, yet might be wrong because of that person, the time, or the motivation. Or maybe the right thing to do. Sound familiar? Our Constitution is in a sense a map of life. We have the ability to Change it, not just Obama.
So, here we are warning each other, with a superior method in the Internet introduced from a time during the Clinton Administration that encourages all of us because of its expediency to solve problems that have been ignored or abused with, sadly far too many intentions for the mischief mind, making advances and advantage in a selective process. Ironically we all indulge in bias without warrant. Isn’t that a FISA funny.
For more times then I can count usually comments that are made that have only cursive words, and a few, show only a diminished minds likely locked in temper that is hard to release. But, wants to. Listening to phone calls on C-Span reveal a frightening reality that our country in loaded with a lot of people that have a surface reasoning with out depth and breath or anything that any of us would want to share. Then there are those with superior skills in language modified with auditory quality that play in the political mix very well. However we all gather here converse to draw out what is best for what we might need. And that’s simple to address issues, for a better way of life.
Obama in his book called “Audacity of Hope” is something to read. Here you find a man who was a teacher at the University of Chicago Law School. A much respected Institution that gave the opportunity to this young man to teach the Constitution and Law for about eight years. Very Impressive measure of experience. Actually, tremendously more so then any other candidate we have to vote for.
Truly a time and an expertise gained that should reveal a superior understanding and argument for change in our most basic Constitutional method. Yet, and alarmingly, and for me with some fear, wonder why Obama would declare in his book that he “offers no unifying theory of American Government”, a very worry some statement which opens a curious feeling of no need for Americas present methods. Shocking, and one reason there some that challenge Obama in his patriotism. Moreover why don’t we have those serious questions about what Obama believes in, or how could Obama have any ideal of change if he offers no theory of American Government? This is a very empty statement for the front runner of the Democratic Party and already very disappointing. It’s amazing no one can see this extraordinary shallow mind to guide the world.

However here in Sweden, it's been about 0.5 degrees celcius warmer than the hottest winter of 1980-something. So there's def. warming over Scandinavia.

Nobody on Clinton's side had it banned, so ..... They could have stopped it through the courts, but didn't, so ...
I am in NYC. When Bill had the serious/ life threatening complications with/post his emergency bypass surgery at Columbia/NYC, there was a lot of 'talk' in medical NYC circles it was due to his drug use (incl. snorting cocaine, which has damaged his respiratory system, making him a high risk on this also w/anesthesia). Apparently that was behind some docs refusal to operate on him (they did not know the patient's name, just his med record) - too much at risk w/undisciplined patient w/ dangerous (to his own life/health) behavioral patterns. Nobody would say it loud, but, it was all over the place, for longer than one wants to keep hearing it. His latest behaviour in the campaign raised a lot of questions as well. You can remove them from Arkansas, but cannot remove Arkansas from them.

criticized the blog clog over at Firedoglake yesterday having to do with the I/P conflict. (although there has been a break through Siun posted this on Sunday) This is new for FDL even though Jane Hamsher and Christy Hardin Smith think that putting the word Israel in the title of a blog is really covering this critical issue. Am wondering if this criticism of Jane and Christy was taken off because Howie Klein (who often post here at C and L) is good friends with Jane and Christy. HMMMM (this is how the MSM works)

Crooks and Liars and Firedoglake have blog clogs when it comes to this issue. ( have been observing for years now). They will make all sorts of excuses, but believe me someone like FAIR could conduct some research on BLOGS THAT HAVE CLOGS having to do with this critical issue.
Siun is one of the folks who has personally attacked me for my tone (while the bloggers at FDL can rip up anyone they please with what some would consider gutter language) and some others who would link articles and bring the I/P issue up at FDL. Jane, Christy Siun and their screener will rip into many issues with language that is sometimes surprising. But will blast people that they claim have a "tone" about the I/P conflict. Some serious double standards and selective "tone" and information policing going on.
This change is better late than never.
Now we know that MSNBC will not touch this issue. When I challenged Chris Matthews about the lack of coverage on the I/P conflict at the Libby trial he said "I am not in control of programming" (who is in charge of programming). Olberman, Scarborough, Matthews,...no one will touch this issue.
Let's see if the Diane Rehm show is going to cover what is taking place in the Gaza this week.
How about Neil Conans Talk of the Nation. His schedule is not listed. But let's watch and listen.
When the MSM (which we know has been going on for years), the debates and the so called "progressive" blogosphere are closed down to really providing fair coverage of this issue, how can we expect this conflict to ever be resolved?

A number of people are talking about David Rose's article on US clusterfuckery with its Palestinian policy. If you need any convincing that the entire Administration--and Condi Rice above all--is dangerously incompetent, read this article.
The story explains how the Administration pushed an election for the Palestinians, not seeing what every sane observer saw--that Hamas would win. Immediately after the election, Condi started pressuring Mahmoud Abbas to dissolve Parliament. When he refused, the Administration started backing the Fatah strongman, Mohammad Dahlan, in hopes that he could strengthen Fatah and the Palestinian Authority's security organizations--which had been devastated by Israel during the intifada--sufficiently to overcome Hamas. This set off a civil war between Fatah and Hamas. To end the bloodshed, Saudi's King Abdullah brokered a national unity government, without warning the US he would do so. In response to Abdullah's unity government plan, the State Department developed its own $1.27 billion plan, what Hamas considered "a blueprint for a U.S.-backed Fatah coup." The US handed that plan to Abbas and had him adopt it as if it were his own. Hamas responded by taking over Gaza and capturing the Egyptian weapons intended to strengthen Fatah.
In other words, the story is a description of the US' profoundly incompetent Palestinian policy, one which has exacerbated problems with each new development. As one Fatah commander described it, the whole plan seemed destined to leave Hamas in control.
You know,” he says, “since the takeover, we’ve been trying to enter the brains of Bush and Rice, to figure out their mentality. We can only conclude that having Hamas in control serves their overall strategy, because their policy was so crazy otherwise.”
I wanted to focus on what Rose calls "Iran Contra 2.0." When the US decided to strengthen Fatah so it could combat Hamas, Congress refused to fund the effort. Given our political climate, Congressmen are not about to green light giving Palestinians--of any faction--improved arms and military training. Instead, the Administration turned to a tactic used in Iran-Contra: to have other governments fund the US' desired foreign policy.

I am not a Hillary Clinton supporter and I have been hearing and reading all day that in an interview she was ask if she thought Obama was a Muslim and she said: "Not as far as I know" as if she had her doubts. Well I finally saw the clip and I was astonished that what I have been hearing was just bull shit. Her exact words were:

I said once months ago that when Ann Richards died it was because God needed her up there to end the corruption in the Bush administration down here, He has taken some amazing Democrats to do some other side fighting for the people. I met a Muslim man at my caucus in Washington State who was very proud to be a Muslim and voting for a man with Muslim roots. What is wrong with that? There is a very loud and powerful element in American politics that believes that America is a Christian Nation. They are in the administration. They are in our military. They believe in a revisionist history in which all the famous founding fathers were devout evangelicals. There are Supreme Court justices who believe that the First Amendment does not apply to state governments, and who would remove the federal government's jurisdiction to redress an Alabama-imposed or Utah-imposed theocracy.
Do not underestimate this faction in our politics!

The First Amendment alone does not protect our freedom of religion!
Read it carefully. The First Amendment is both antiestablishmentarian and antidisestablishmentarian. "Congress shall make no law respecting the establishment of religion, or prohibiting the free exercise thereof . . . "
No law. None. Meaning that if a state establishes a religion, or passes a law against practicing Islam, Congress is powerless to do anything about it.
What really protects our freedom of religion is the Ninth Amendment (though the courts have never recognized this) and the Fourteenth Amendment (which the courts do recognize -- but maybe not for long with the current crop of justices).
We must absolutely understand this if we are really to protect our rights in our system of government.

And the "Freedom of Religion", as outlined in the 1st Amendment, is the exact opposite of what the revisionist “Christian Nation” group(s) is trying to propose. The 1st amendment’s intent was to prohibit a “national religion” as was being practiced at the time by the “Church of England” et al. They were simply saying, no national religion, and no laws establishing one.

My argument is, Hillary has had many years to digest all the mistakes made and battles lost. She knows all of their moves and probably has a team already in place to counteract them. She strikes me as a person who will not make the same mistake twice. With Obama, nice guy that he is, will not be able to maintain support when the repubs try and take back the House and Senate (those elections aren't as sexy for the MTV crowd, just ask Bill) and he'll be hamstringed just like Bill. This is true, though I'll hasten to add that, personally, I do not subscribe to the doctrine of original intent. I'm a textualist. And I wants judges to construct the Constitution's words, not whatever might have been going on in the minds of the people who wrote those words.
But we all must learn that if the religious right goes to the Supreme Court arguing that the First Amendment actually prevents the federal government from prohibiting each state from violating its own population's religious freedom, the argument will fall on at least four sympathetic ears. This is terrifying! But we can't be gobsmacked by it. We must see it coming. And we must understand the legitimacy of the argument before we can successfully counter it.
The amendments that really protect our freedoms are the Ninth and Fourteenth. We must learn to revere them like we do the First.

Although from an historical perspective, what was taking place at the time, the debates, and the eventual compromises, are all fascinating. But history too is malleable. I once wrote a paper on how different generations/eras perceived historical events dramatically differently, and why history as taught in those various eras was more revealing about those doing the “teaching” than what was being taught. Same applies here.
I also understand that as a lawyer, it is the “text” and the precedent that are paramount. (A little too important for my own taste.)

Someone told me I should watch this video, so I did, and the accusations just blew me away! It took over an hour to watch this video, but it certainly brought up a lot of questions in my mind about the Clintons. I noticed the video is kinda old too - have these accusations already been debunked? Thanks to anyone who might share some wisdom with this young Texan girl and newly registered voter.

Isn't that was Democrats have been railing for, for the longest time? "We need to become more like them so we don't fall by the wayside." Not policy wise, but attack and re-attack ad wise. Just as one listens to some of the phone in calls on hate radio talk shows or C-Span, Judgments are made in many ways. Just as one writes comments in a political blog the ideals are judged. But the reason for what is written can be seem very mysterious to brilliant because translations carry with it not only a misunderstanding of composition, and life, but when done well, can carry an excellent reach to a vision that is compelling to follow, yet might be wrong because of that person, the time, or the motivation. Or maybe the right thing to do. Sound familiar? Our Constitution is in a sense a map of life. We have the ability to Change it, not just Obama.
So, here we are warning each other, with a superior method in the Internet introduced from a time during the Clinton Administration that encourages all of us because of its expediency to solve problems that have been ignored or abused with, sadly far too many intentions for the mischief mind, making advances and advantage in a selective process. Ironically we all indulge in bias without warrant. Isn’t that a FISA funny.
For more times then I can count usually comments that are made that have only cursive words, and a few, show only a diminished minds likely locked in temper that is hard to release. But, wants to. Listening to phone calls on C-Span reveal a frightening reality that our country in loaded with a lot of people that have a surface reasoning with out depth and breath or anything that any of us would want to share. Then there are those with superior skills in language modified with auditory quality that play in the political mix very well. However we all gather here converse to draw out what is best for what we might need. And that’s simple to address issues, for a better way of life.
Obama in his book called “Audacity of Hope” is something to read. Here you find a man who was a teacher at the University of Chicago Law School. A much respected Institution that gave the opportunity to this young man to teach the Constitution and Law for about eight years. Very Impressive measure of experience. Actually, tremendously more so then any other candidate we have to vote for.
Truly a time and an expertise gained that should reveal a superior understanding and argument for change in our most basic Constitutional method. Yet, and alarmingly, and for me with some fear, wonder why Obama would declare in his book that he “offers no unifying theory of American Government”, a very worry some statement which opens a curious feeling of no need for Americas present methods. Shocking, and one reason there some that challenge Obama in his patriotism. Moreover why don’t we have those serious questions about what Obama believes in, or how could Obama have any ideal of change if he offers no theory of American Government? This is a very empty statement for the front runner of the Democratic Party and already very disappointing. It’s amazing no one can see this extraordinary shallow mind to guide the world.

I couldn't care less if they slaughter live animals and pray over their entrails so long as I don't have to pretend to give a damn or accept it as part of anything. Anyone got any link about global warming world wide (this winter)? I keep reading posts here and there about some countries experiencing their coldest winter in a while too. So perhaps climate change is a better choice of words.
However here in Sweden, it's been about 0.5 degrees celcius warmer than the hottest winter of 1980-something. So there's def. warming over Scandinavia.
On a more cool note, I would suggest not going skiing there any time soon. There's bound to be relapses. (yes I know it's an old link, and of the south pole.)

I am in NYC. When Bill had the serious/ life threatening complications with/post his emergency bypass surgery at Columbia/NYC, there was a lot of 'talk' in medical NYC circles it was due to his drug use (incl. snorting cocaine, which has damaged his respiratory system, making him a high risk on this also w/anesthesia). Apparently that was behind some docs refusal to operate on him (they did not know the patient's name, just his med record) - too much at risk w/undisciplined patient w/ dangerous (to his own life/health) behavioral patterns. Nobody would say it loud, but, it was all over the place, for longer than one wants to keep hearing it. His latest behaviour in the campaign raised a lot of questions as well. You can remove them from Arkansas, but cannot remove Arkansas from them.

I've been an Edwards supporter, undecided when he quit, thought of shillary, but her destructive actions against Obama and the Democratic party convinced me to vote for Obama in Feb - whom I've watched live - even yesterday in Texas he had a very easygoing, informative and intelligent town-hall mtg at some university. Young pple were asking sometimes stupid questions - he did answer earnestly and treated ALL w/ respect and seriousness.

criticized the blog clog over at Firedoglake yesterday having to do with the I/P conflict. (although there has been a break through Siun posted this on Sunday) This is new for FDL even though Jane Hamsher and Christy Hardin Smith think that putting the word Israel in the title of a blog is really covering this critical issue. Am wondering if this criticism of Jane and Christy was taken off because Howie Klein (who often post here at C and L) is good friends with Jane and Christy. HMMMM (this is how the MSM works)

This change is better late than never.
Now we know that MSNBC will not touch this issue. When I challenged Chris Matthews about the lack of coverage on the I/P conflict at the Libby trial he said "I am not in control of programming" (who is in charge of programming). Olberman, Scarborough, Matthews,...no one will touch this issue.
Let's see if the Diane Rehm show is going to cover what is taking place in the Gaza this week.

That's the problem - People don't keep their religion private - they want their religion in our schools and in our government. They believe this country was founded on religion when in fact it wasn't. Go ahead and have YOUR religion, but keep it out of my life.
Talk about yer "religious freedom" in the US...put a bumper sticker on your car that says something like "I'm a Presbyterian and Proud of it" or "Baptists go to Heaven" or "I love Jesus" and NOTHING will happen...on the other hand, put one on that says something like "Religion is a Hoax" or "Atheist and Proud of it" or "Jesus was Gay" and you better have good windshield and vandalism insurance and be able to handle yourself in a fistfight. A number of people are talking about David Rose's article on US clusterfuckery with its Palestinian policy. If you need any convincing that the entire Administration--and Condi Rice above all--is dangerously incompetent, read this article.
The story explains how the Administration pushed an election for the Palestinians, not seeing what every sane observer saw--that Hamas would win. Immediately after the election, Condi started pressuring Mahmoud Abbas to dissolve Parliament. When he refused, the Administration started backing the Fatah strongman, Mohammad Dahlan, in hopes that he could strengthen Fatah and the Palestinian Authority's security organizations--which had been devastated by Israel during the intifada--sufficiently to overcome Hamas. This set off a civil war between Fatah and Hamas. To end the bloodshed, Saudi's King Abdullah brokered a national unity government, without warning the US he would do so. In response to Abdullah's unity government plan, the State Department developed its own $1.27 billion plan, what Hamas considered "a blueprint for a U.S.-backed Fatah coup." The US handed that plan to Abbas and had him adopt it as if it were his own. Hamas responded by taking over Gaza and capturing the Egyptian weapons intended to strengthen Fatah.
In other words, the story is a description of the US' profoundly incompetent Palestinian policy, one which has exacerbated problems with each new development. As one Fatah commander described it, the whole plan seemed destined to leave Hamas in control.

There is a way to stop the immunity deal. Call your Member of Congress, and ask them to oppose the rule which brings the FISA bill to the House floor.

The point Catherine Dent is making is that our elected officials should NOT be making policy based on their personal religious beliefs -- which is exactly what Bush did when he vetoed expanding stem cell research.
First Freedom First is about YOU getting to decide whether or not you want religion to be part of your life. It's also about making sure you do not have to fund religion through your tax dollars -- which is the case with Bush's 'faith-based' initiatives.
The FFF campaign isn't "pro" or "anti" religion ... it's about YOU making this decision for yourself. And being respected for whatever that decision might be.
