Another version of this ad has a disclaimer that this bedside gun rack is not intended for use in homes with children "or mentally impaired individuals." But who else is gonna pay $39.00 to ensure their CONSTITUTIONAL RIGHT to shoot themselves in the leg when they get up to pee? And yeah, the phone number on the ad is no longer in service.

and wacky.

I wonder if whoever cooked up that idea realizes that children in grape towns (mainly this one, but Delano is the table grape capital of the world, after all) toss the pre-wrinklified grapes at each other during Harvest season? There's not much for children to do here, and not every child has a video game console of their own. I didn't, although instead of throwing grapes, I chose to read, and read some more.

...but I grew up in Delano, and can't remember the last time I saw it mentioned on C&L!!

for years. :) They did it when I was small, and they're still doing it now that I'm old enough to be this batch of kids' mother. ;)

I was talking about Delano, California. :) If that's your Delano, awesome! If you're talking about another Delano, still pretty cool! :)

Joey and Mimis are middle-aged sisters, and Callie is the young mom of Gomez and Lily (her kittens). :)

Mine's full name is "Lil' ET." She's named after a race horse. And aliens, as that's what she looked like when we found her in a plastic bag with her head sticking out of it on a 90 degree day in September. A wino was holding the bag. He was trying to save her, but she was feral and didn't take kindly to his efforts. I was holding her on my chest as I drove her to the vet's before I took her home, and I was wearing sunglasses. She kept staring at me very intently. At a red light, I took the glasses off and she looked relieved. She probably thought I was an alien with big black eyes. She's 17 now. The fastest cat I ever met. She's calico and mostly white. Greased lightning Miss Lily is.

mostly black and brown calico, but she herself is more of a light grey tabby.

Oh, and my Lily is named after Lily Munster. She and Gomez were born a bit before Halloween.

rough, they'll sort you right out. Here's rule #2: When you pet them, look at them. I keep telling one of my friends this, and he gets talking and kind of mechanically continues to pet them while he's involved in a conversation with me. The cats don't like that and they nip him. They don't break the skin, but it never fails to make him jump. It's pretty funny.

The Bedside Gun Rack – what a perfect Christmas gift. No wonder customers are buying one for each side of the bed! I’ll take THREE!

Of course I’ll then need the optional Pillow-Case Pistol Holster, the Shower-Howitzer Holder, the Kitchen Sink Zip-Gun Zipper, the Sofa-Shotgun Canister, the Patio Rifle Protector, and the ever important Washer/Dryer Ammo Cache.

Ohhhh I’ll feel so safe…

Here's a link to a story in my old town's local newspaper. It's a story about Rep. JoAnn Emerson from my old district back in the State of Misery. It's a big fluff piece about Emerson bragging about all the money the district is getting, money that she requested, but voted against. As I read this garbage I recalled other Republicans that were doing that, I looked up who voted for and against that particular bill and sure enough, Ms. Emerson voted against it. I posted a comment, but it hasn't shown up yet and I doubt it gets thru the censors there. They protect their own in that neck of the woods. I've been trying for years to get people to see what this woman really is to no avail. Her last name isn't even Emerson anymore really, she's remarried. She used to be married to a guy who represented the area for years, he is long since dead. She rode in on his coattails and is still milking it for all it's worth. She's a Tom Delay junkie and if looked into, she probably belongs in prison. Anyway, for anyone with time on their hands, I'd love it if you would register and make a short comment on this story and email the writer if you would.

The suit accuses the company of failing to disclose rebate terms, misrepresenting free items and failing to adequately disclose early cancellation fees."

• Media that mistakes neutrality for objectivity so completely, so thoroughly, that it would present "both sides" of debates like, Sexual Reproduction or Delivery by Stork?

• Lunatic "conservatives" who pay lip service to syllables like free-dumb and tear-a-knee, but who wear the uniform of liberty inside out and backwards.

• Libertarians who believe that "individual liberty" is best protected by ensuring the sovereignty of local jurisdictions, even when those jurisdictions will likely vote to violate their own citizens' individual liberties.

• "Senator" Joe Lieberman.

• Anyone who believes that the politically and functionally illiterate Sara Palin "wrote" a book about politics.

Article VI, Sec. III

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

Article VI, Sec. II:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

Diabolus est Deus Inversus

Karen's picture

True, the Supremacy Clause forbids individual states from violating the U.S. Constitution, but much of the Constitution limits the federal government without likewise limiting the states. Note the explicit distinction in Article VI, Sec. 3 between "the United States" and "the several states." Note then that the Oath or Affirmation clause applies to both, but the religious test clause applies only to the former.

Thus, Justice Thomas would argue, the religious test clause does not actually apply to or limit the state governments in any way. The several states may still impose religious tests upon their respective officeholders.

Moreover, the Supreme Court has never held that the religious test clause applies to the states, and many scholars believe that it does not. The textual distinction between the several states and the United States is clear.

The Supreme Court has held, however, that provisions like those covered on the linked Rachel Maddow clip do violate the First Amednment's proscription of the establishment of religion, which limits the several states through the 14th Amendment.

Thomas rejects that argument too, noting that the First Amendment only explicitly limits the U.S. Congress, not the state legislatures.

Thomas is not alone.

Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?

ysbaddaden's picture
)O(

Looking at the history, with New England's Puritanism, and Maryland's Catholocism, and Jefferson's Virginia freedom of religion, I think the Founding Fathers did include the states in their reference, particularly since they didn't end one sentence and start another.

And the phrase under the United States is tricky, but I think it's comparable to Article III's creation of the Supreme Court "and in such inferior courts as the Congress may from time to time ordain and establish," they didn't say that all those inferior courts answer to the Supreme.

And since the first capital was located in New York, Thomas's interpretation could have led to a Constitutional crisis between the laws of the Federal Government and that of the New York State government.
