Judge Blocks Implementation of Wisconsin Anti-Union Law -- Again
Not that it matters much to the militant dictators running Wisconsin right now.
Dane County Judge Maryann Sumi has just blocked -- again -- Gov. Scott Walker's (R-WI) new law curtailing public employee unions, after the state Republican leadership moved last Friday to circumvent her previous order that blocked the law on procedural grounds. But that's not the end of the discussion, as it appears the state will continue to defy the order.
The Milwaukee Journal Sentinel reports:
"Further implementation of the act is enjoined," said Dane County Judge Maryann Sumi.
She noted her original restraining order issued earlier this month was clear in saying that the state should not proceed with implementing the law. The Walker administration did so after the bill was published Friday by a state agency not included in Sumi's earlier temporary restraining order.
"Apparently that language was either misunderstood or ignored, but what I said was the further implementation of Act 10 was enjoined. That is what I now want to make crystal clear," she said.
But minutes later, outside the court room, Assistant Attorney General Steven Means said the legislation "absolutely" is still in effect

Unitary executive, anyone?
Is this idiot trying to short-circuit the recall process and go directly to impeachment?
By the way, DO NOT collect $200 when you pass "Go"...
not all martyrs see divinity
Grounds for impeachment if ever I saw them. Walker is a blatant criminal who is on the record conspiring against the people of his own state and now demonstrates flagrant disregard for the law. At least Nixon tried to hide it!
when the states freakin' head of their Justice Department says everything's peachy keen??:
I wonder if Obama/Holder have weighed in on this one??
Is this flunky Stephen Means speaking for his boss's interpretation of the ruling??

I think we're seeing a very good example of just how ephemeral and arbitrary is the concept of "law". Sure it works just fine - when the people implementing it are honest. Fill the halls of government with corrupt selfish assholes and guess what? When there's no one to uphold it, "Law" no longer means anything other than what the guys in charge SAYS it means.

Geezuzz, when are you going to scream for justice and quit accepting this shite?
Use federal agents if necessary. I'm told this is a nation of law.
I couldn't even type that last sentence without laughing.
Doesn't this make Walker a criminal? Seriously? Doesn't this practically set him up to be FORCIBLY removed from office BY LAW? If the people of Wisconsin wanted to storm the capital and literally DRAG him out of office, I would fully support them. This man needs to be removed from office and sent to PRISON.
Yes. I think he is getting very close to the Rubicon. It may become necessary to strip his power.

Walker's office is perfectly free to claim that up is down. When they start actually implementing an enjoined law, that's when contempt begins. Actually it's more like "anyone could sue, automatically win, and get their costs paid" instead of perpwalks.
Impeachment isn't up to a judiciary to initiate, and Scott Walker could knock over every liquor store in the state and the Rethug legislature wouldn't touch him.
It's time to become a mob and physically overthrow ALL TeaBag government.

Let them say every ignorant thing they can think of to the cameras to make a big compilation tape to run 24/7 the month before the next election. Then they can go on Fox and say "I never said that", while all other stations run the video of them looking like total jackasses.

Sumi is an Activist and biased judged; the apple doesn't fall far from her tree. With a little research you'll find her son too has been a lifelong political activist and political operative who also happens to be a former lead field manager with the AFL-CIO and data manager for the SEIU State Council; both having strong membership in public-sector employment. He also runs a company called Left Field Strategies, a political campaign firm. Fishy? Sumi is hardly unbiased and as such her inability to remain neutral constitute should constitute her recuse.
That was all bullshit, wasn't it?
A clear conflict on interest. By law, “A judge should avoid any case in which his impartiality might reasonably be questioned"...And should seek recuse should “his spouse … has a financial interest in the subject matter in controversy or in a party to the proceeding, or any other interest that could be substantially affected by the outcome of the proceeding.”
Her son is actively involved within political affairs as well as earns his living off of the Unions. The standard is met.

The idea that the courts are the final arbiter of the constitution has not always been accepted. Andrew Jackson ignored the supremes on occasion, for example. Nixon did not. He destroyed evidence instead.
But this raises the question, how does a state judge enforce her order against the chief executive.

Walker is about to do to the entire state of Wisconsin what he did before to Milwaukee County Courthouse security guards. And that cost Milwaukee County, court fees, 180 days of back pay for fired security guards and a $1.1 million dollar contract to the private security contractor. How the hell did that save anyone in that county a dime?
Walker is exposing the entire state to punitive damages from lawsuits filed by state employee unions.
Walker does not care how much money is lost or how badly services suffer. All he cares about is proping up some right-wing dogma no matter what the cost.
He sees himself as a victim of the Unions and of the Judical system. Walker is determined to blame others for his law breaking ways.

governor's law like he ignores the judge. The union members should send in their dues and keep their union. It should explain to the government that they will have to deal with the union or its members will go out on strike without regards to their stupid laws.
Ya, they should. They still have to impeach or otherwise replace Walker though because he's in control of the money to the public union members, and they can't just let a guy do the things he's doing to Wisconsin with his power as Governor. This has gone way past a union issue into a criminally reckless abuse of power. It has to be put to and end out of principle and Walker has to be severely punished.

they could just try to pass this bill again yet they rather break the law to pass this.
is fading, which means we are making a difference. keep it up.. and don't give up ...
They really don't want to do it all over again because there were so many little things that had to fall in place to get it through the last time. They couldn't recreate those conditions.
Also, the reason they rammed it through the way they did is because they no longer had the support of all the members of their own party. Repub Senators were starting to drop their support and it could no longer pass under the rules of a budget bill (requiring Dem participation or presence).
so keep doing what you have been doing. its making a difference.

As I see it, there is more than just a legislative victory or even a "Reagan moment" at stake. For some unexplained reason, and it isn't just obstinance or contempt, the Republicans are literally desperate to get this Bill turned into law. Desperate enough to jeopardize their personal careers as well as the long term goals of the Wisconsin GOP. Of course, there's the potential that the opposite is true. That Corporate influence has become so pervasive that the elected officials have nothing to lose by pushing the "system" to the extreme envelope. They may have already secured lucrative or comfortable careers in the private sector if their efforts come up short. I'm leaning toward the scenario that there are real consequences for Walker and the Fitzgeralds if this deal falls through. There are millions, if not billions, at stake for a variety of private sector players.
At the core, this Budget Repair Bill is all about privatizing a variety of services and assets. It's not just busting unions, it's about dismantling public education and selling off the infrastructure. It goes as deep as eliminating the minimum wage and eliminating education "standards". The next step is a focus on nullification and that means Federal Law is just something to ignore after a Bill makes a quick run through the GOP State Legislatures. For all the snark and competitive sarcasm I read in the comments, there seems to be a willful ignorance to the obvious strategy being employed by the Corporate-funded Walker "family" in Wisconsin and similar "leadership" in other States.
We take America for granted from both the right and the left. The Tea Party? Most ardent Tea Partiers have no clue what a Tea Party America would look like. They'd be a little more concerned if they really thought it through. At the same time, liberals tend to "disbelieve" there really are "Lex Luthers" on the right and assume that America's built-in safety mechanisms will stop a radical takeover. But Walker is stomping on every safety mechanism in Wisconsin and the liberals are still joking about it. It's not time to wake up. It's time to get real. We need to protect and defend our values and our frigging dignity. Stop the jokes and the false bravado, shiite is going down that is clearly NOT in our best interest as Americans.
With regard to the lie that Sumi is taking an activist position, the BS that was linked has been debunked time and again. The details are easily accessed and that's not the main point. The message from the right is our Courts are "fixed" or partisan. That may be somewhat true in the grand scheme of things, but let's remember that Republicans actually developed the strategy to stack the courts. Let's also be realistic and look at the FACTS in the Wisconsin case and recognize the validity of Sumi's ruling regardless of her son having a union job some years ago. And let's NOT "allow" the right wing radicals to distract and divert the dialogue from the basic issues and values that are at stake.
My last point is that I am well-versed in Conservative/Republican/Libertarian messaging. I'm also well aware of the true goals that the messaging is intended to facilitate. I finally landed on the Democratic Party after years of conservative activism. If you don't take this crap seriously, the Conservatives WILL win. I can see a clear path to victory and it will only lead to further concentration of wealth and a shrinking economy that will be ruthless on today's "Middle America". And don't even dream of blaming Obama, you can only blame yourself. He made it very clear, the people that want change HAVE TO get active and make that change happen. The first step toward change is recognizing the threat to your ideals and acting appropriately.
Reslugs don't care about them damn laws getting in the way of their government takeover. I thought Reslugs didn't want any government invading our lives and now what the hell are they doing? Using government to do their horrible, destructive things to this country. There isn't a scared Reslug party anymore, it's just the nutcase teabaggers and birthers now.
It wasn't misunderstood it was blatently ignored by the Reslug supreme arrogance and stupidity. I hope everyone of these llaw breaking bastards gets fined good and jail time. I would love to see that.
