Madoff: Entitled to Penthouse - And $62 Million

NEW YORK (CBS) ― Bernie Madoff is accused of fleecing his clients out of billions, but he said Monday he shouldn't be forced into the poorhouse.
His lawyers are arguing that Madoff should be entitled to keep the $7 million apartment he's currently being held in while under house arrest and $62 million, including $45 million in municipal bonds.
Court papers filed on Monday state that Madoff and his lawyer say the Manhattan penthouse and the millions held in accounts of Madoff's wife, Ruth, are not subject to seizure.
The court papers say Madoff claims the apartment and the money are unrelated to a $50 billion fraud Madoff has been accused of carrying out.


Won't the civil suits leave him with nothing? Assuming of course he doesn't end up in jail?

That 22 year old black kid could have had his house or his parents house seized by the feds and any other asset tangentially connected to the offense, even without an conviction. We need to demand that it's not only Bernie who feels pain on this but his entire family. His wife, his kids, his brothers, everyone who is in any way related to him needs to have all their assets seized and frozen until this mess is sorted out and if any of them had any involvement in this massive fraud then everything they own should be forfeited. We cannot make it profitable to rip people off and we should not stand for it as citizens. A massive, far reaching draconian penalty may deter the next Madoff but anything less simply reinforces this criminal behavior.
Like he said . . and he could blow the whole lid of this whole farce on the stand. (That the reason for all the delicate handling of this case?)

I've known for a long time that there is no justice but this is truly sick! He belongs in prison along with all of the thieves from the Bush regime including Bush.
I know, what Martha Stewart did was illegal and unethical as heck, but at least she served her sentence. For that I have to have a small amount of respect for her in that. Not so much for Madoff obviously.

Because she contributed heavily to Democratic campaigns, she was scrutinized much more heavily than Republican contributors. The money she got from that insider trading was minuscule compared to what Madoff's Ponzi scheme netted him and the damage she did to at most extremely small compared to the many who have lost their life savings and may even be homeless as a result of Madoff. Yes, there is no justice in the world the Bushies created.

It is horrible what Madoff has done to so many people. I wish I could say that I knew that there was some equally horrible punishment waiting for him in the wings, but I can't... :(

Martha Stewart spent more on her defense than she was accused of making through insider trading. The only people she "hurt" were already wealthy.
Ken Lay (of Enron fame) ruined thousands of livelihoods and retirements, but did he spend one day in the slam? No, died of a heart attack, if you can believe that. Any pissed off God worth his divine vengeance would have kept him alive another thirty years.

Will be that since he never bought any securities at all, all evidence of fraud is not under the jurisdiction of the SEC, and is therefore inadmissible.
I say treat him like Citibank would treat one of their defaulted credit card customers. He can keep $2,000 of personal property like the clothes on his back, a car if he needs it to get to work, and a house if it's built like a cardboard box. All the rest is subject to seizure to pay his debts at 35% interest.

In view of Madoff's ongoing arrangement to stay on in his New York City penthouse from which he sent out expensive jewelry and gems before that loot was determined to be still there.
In view of Madoff's now being quite brazen about invoking any premise he is "entitled" to seven million dollar NYC penthouse or sixty million because these are in his wife's name.
Why is this guy getting such soft handling thus far?
Where did the ill gotten/stolen money go? No investments having been made. Fifty billion $$ went somewhere. Got parked or moved around somewhere. There must be some very interesting trails to somewhere.

I believe the SEC was questioned before a congressional committee about why despite numerous warnings about Madoff's too good to be true returns, they did nothing. I believe the SEC sited national security as a reason not to respond to the question or provide any additional information.
And we all know that if you or I stole $20, we could very well wind up in jail, but this guy gets house arrest? If that doesn't show that there are double standards in this country, I don't know what will.
This case is nothing like what has been portrayed on television, and there are reports that much of the money may have wound up in Israel.
This may have been as much a money laundering operation with US government participation -- and likely other governments besides. The thing that really blew me away about this case was a number of large US and European banks were also "customers" of this guy, yet people investigating this say there is no evidence Madoff made any trades at all. Banks seriously assess risk: you telling me none of then caught onto this? They must have known as well that this guy was dirty.
Mark my words, this guy will walk free or die a death like Ken Lay. He's not suffering now, nor will he. (Interesting that a few people who were intimates have died recently, though.)
And if Obama wanted to send a clear message, he could insist that this guy be in jail where he belongs awaiting trial. But there are two sets of laws today; one for the insiders and one for the rest of us. And Obama ain't going to change that either.

Most laws and mechanisms federal and state agencies use to prosecute drug crimes are actually fully unconstitutional.
In Drug offenses the state is allowed to put the burden of the proof on the accuser. Which goes against the basic principle of US justice, in which the state has the burden of the proof.
Furthermore, the state can seize all your assets until you prove your innocence. Which makes it difficult for the accuser to hire a decent lawyer. If you are a two bit drug dealer or user, you will be stuck with a public defense lawyer. Which pretty much means they are SOL.
But hey, shredding the constitution is a small price to pay for making sure that soccer mums everywhere get to pretend little Johny is not going to have any weed to smoke...
I won't advocate that Madoff should be killed. I am not saying that a group of armed men should break into his multi-million dollar home and drag him by the hair out of his comfy bed and then gut him like a rabbit. I would never advocate that kind of violence. I would be saddened to hear about the death of a man who has stolen from so many and is being treated by the justice system like a sacred cow.

it shouldn't matter if the manhattan penthouse or the money in his wife's accounts are "not related" to his theft of 50 billion dollars. how can that claim be made anyway? is he claiming that that money had nothing to do with his business activities and can he prove that claim? he has creditors, and they should all be paid with whatever money and assets are available. these should all be confiscated and liquidated and whatever debts he owes should be paid as far as can happen, which won't be 50 billions of dollars worth. it should be determined where that money went by a thorough investigation. if madoff is left penniless, he'll just have to start over, like millions of other people who lost everything, have nothing, lost their jobs, and have to start over from scratch. it's hard for me to feel sorry for bernie madoff. he can experience life like many others these days are experiencing it, the hard way.
also, what makes him exempt from real prosecution. personally, i would rather see him penniless and out on the street rather than in jail at taxpayer expense. let him fend for himself on the street, penniless, without a job, without money. that seems more like poetic justice to me. but he should be fully prosecuted and not be exempt from it.
