Let me guess. Some are getting spooked by the Republican's made up "Soft on Terrorism" boogie man, right?
The "Rest" should be targeted for replacement.
I don't think a "soft on terrorism" approach would work anyways (although you may be right that this is the motivation), because Arlen Specter (Republican) introduced S. 185, a habeas restoration bill, which was approved by the Senate two weeks ago. With the latest revelations regarding Cheney and his Constitutional "theories" I would hope that everyone now realizes that the totality of evidence suggests a silent coup d'etat has taken place. All the Little Dems picking fly specks out of pepper is not going to do anything to change that.

The arrogance of these criminals never ceases to amaze me. I'm glad some people are calling for a restoration in D.C.
But, the main fact is this - there is absolutely nothing that allows the government to restrict habeas corpus like they have.
Foreigners or citizens, in America or on Foreign soil...they can't do it. period.

Many provisions of the USA PATRIOT Act, and pretty much the entire text of the Military Commissions Act do not hold water legally. They are de facto attempts to amend the constitution without even giving a nod to the process provide to make such amendments. The problem is, the partisan Republican US Supreme Court allows these travesties to stand by the simple expedient of never allowing a test case to be tried in their chambers. They are as bad as Abu Gonzales, traitors to their country and their high offices. Summary execution is too good for them.

BTW, it is my understanding that even if a law is later declared to be unconstitutional, until it is ruled so by the Supremes it is still in force as the law of the land. Any lawyers or law students out there who could clarify this issue for me?

Yes, I quite agree with you...the problem is they do it anyway, respect for the law does not stop them. That is why I believe our representative government is dead, murdered by coup. We live in a form of tyranny now, but most Americans do not have the courage to face that fact.

In response to a lack of comments on this topic...I'll make one.
There's no point in even arguing this. The Congress does NOT belong to the people. Habeus corpus is GONE. DONE. We gave it away after 9/11.
NO CONGRESS is giving it back. They're not. Period. Not until FUNDAMENTAL changes in our electoral system are made...such as limitations on campaign contributions, term limits, etc.
Until then...the elites call the shots. They pulled the wool over the eyes of the public, and the public allowed it. The majority of this country don't even know what the writ of habeus corpus is.
Done. Finished. We got that right at the end of a gun. We got that right by fighting a revolution. We GAVE it away without firing a shot.
You want it back. It's gonna cost...and the majority of Americans are NOT willing to lift a finger to even protest...ANYTHING...you think they're gonna FIGHT?!?!

Make a list of Hitler's Nazism. Restoring habeas corpus was one of his effective tools used in undermining the german populace whereby he gained total control over the region. Next, loss of freedom of speech (the press is doomed), imprisonment, etc.
I would like to address the last event where Hitler remained in the bunker and chewed the capsule. Feel better?
Cheney's end destruction will be similar as he frequently visits the bunker (reports).

According to the old testament prophecies, Babylon will be made desolate for their inequities. I saw a recent picture published by some marines, the streets are desolate as mentioned by the major prophets.

As for the "false flag" attack. This is where we have brought ourselves. Remember the terror color code system. We have been PROGRAMMED. This is CLASSIC black ops stuff. I find this post quite misleading when it says that only 22 democrats have been counted "supporting" this measure. 22 of them so far have signed up to co-sponsor it. Whether or not somebody is sponsoring legislation has nothing to do with their ability to support it or vote in favor of it. I'm sure a vast majority of democrats and a few republicans like specter (who voted for it in committee) are going to be on board. To prematurely criticize them and say they don't support the constitution simply for not wanting to cram 50-some names onto the bill's tagline seems rather silly.
There is no need to restore it. The constitution was not ammended, so it is still there. We just need to remove the pirate regime that is running the Justice Dept.

This is very misleading and while Bob Geiger might be trying to light a fire he should at least be honest. The truth, when you read his article, is 22 Dems have signed up to CO-SPONSOR this bill and he wants more. The article states way down at the bottom of the article that just because the rest of the Dems have not signed on to co-sponsor doesn't mean they don't support the bill. And actually the Senate Judiciary Vote to bring restore Habeus Corpus through Congress was something like 11-8 with total Democratic support.
There is a lot of Dem bashing going on right now, some deserved, some, as in this case totally unfair.
If this is not corrected, this is means for a new American civil war. I am loathe to invoke such dramatic prose but by this being the current law of the land, that many of you and myself as lifelong or newly American citizens and individual contributors in our "democracy" can be detained indefinitely with no legal recourse. That, as a citizen and a patriotic apostle of American ideals and constitutionality calls for nothing but all out unrest and rejection. This is no paltry civil unrest, no claiming that the income tax is illegal or unlawful. This is the gutting of our Democracy, even at the lavish and lobby money laundered 2 party level, it shrouds our country in shame and doom. I might have hoped that all representatives at any level would find this a basic affront to our nation and our constitution, and even less a blemish on the symbolic nature of our nation world wide, but it now looms over our heads again in our most progressive age? So, are we doomed to repeat the past so near to the same mistakes of our pasts? I really hope not.

You are right of course. But after all the government has been through with Bush, gosh darn-it, the opportunity to take a stand for habeas corpus should be about as controversial as taking a stand against raping babies. You'd think congressmen would be elbowing each other to be first in line.
I _am_ disappointed in my Senator, Amy Klobuchar, for not being pro-active on this foundational issue.
Yeah, but I look at it as kind of a first-come, first-serve thing. You reach a critical mass of sponsorship where adding your name to a bill makes you more like a groupie and a glory-seeker than a principled legislator taking a stand.
Just got back from the rally; if you're interested, try to find YouTube video of Kucinich and Dodd; they gave pretty good pep talks. Kucinich really blew me away, and he really impressed the crowd, but, there was a pretty sizeable Ohio contingent. Also, a guy from the Hip-Hop Caucus was the last speaker and he floored me.
