Kay Hagan Sues Elizabeth Dole Over Despicable Ad

By now most of you have seen or heard about Republican Elizabeth Dole's disgusting and desperate "Godless" commercial attacking her front-running opponent, Democrat Kay Hagan.

Not only has Hagan fired back with an ad of her own (posted above), her campaign has now filed a defamation lawsuit against Dole and fiercely punching back against what has to be the lowest of campaign smears in the 2008 campaign cycle. From The Hill:

Democratic challenger Kay Hagan has filed a defamation lawsuit against Sen. Elizabeth Dole (R-N.C.) for questioning Hagan's faith in what is shaping up as the nastiest campaign of this cycle.

Hagan announced the lawsuit after Dole refused to remove the ad, which suggests Hagan is an atheist and has become the subject of tough criticism from several newspaper editorials in North Carolina. Several polls show Dole trailing Hagan, a state senator.

“Elizabeth Dole would love nothing more than to distract from the issues and her record for the last five days of the campaign,” Flanagan said. “In filing this suit, we’ve made clear that these kind of despicable tactics will not be tolerated, and our campaign is moving forward with the most important task at hand: defeating Elizabeth Dole, and giving North Carolina’s families a voice in the U.S. Senate that they’ve been sorely missing.” Read on...

I thought that this is reminiscent of when the Republicans accused Obama of being a Muslim. In both instances it seems that no one has wondered what would be wrong with being either a Muslim or [God forbid] an atheist being president. It would seem that the chances of of either a Muslim or an atheist being elected president in the [alleged] best democracy in the world is about as likely as an independent or third party or socialist candidate being allowed to participate in the presidential debates.

I think I would much prefer that Hagan sue for False Light, not Defamation. After all, I do not consider it defamatory to say that Hagan either works with atheists or is an atheist. There's nothing wrong with either, and I would not want a precedent set to the effect that calling someone an atheist is grounds for defamation.

False light is a similar tort, one in which a non-defamatory lie is told about someone, and I would rather that be the basis for the case.

I have to agree here. The ad is stupid, its intended to defame, but it shouldn't. I'm not the type to get worked up over nothing, but as an atheist I find this is extremely unhelpful. This lawsuit is essentially confirming that being an Atheist is a bad thing. The news on Pharyngula is that Hagan has even gone so far as to refer to hanging out with atheists because 'that's how you convert them'.

Simple rule of thumb, if you search and replace atheist with another group identifier, such as say, 'homosexual' or 'african american' or 'woman' or 'jewish person' and you're horrified by the context, then its probably a bad idea.

Hagan is going to be better than the alternative, but there's no need to turn teeth on people who were supporting you the moment the merry cross waving lunatics come marching up to scream at you. Word to the wise: You're a Democrat, the types that are going to be scared off because you pal around with the godless aren't going to vote for you no matter how much you kiss up to the Churchgoing. All this does is make you seem weak, reactionary and most of all, untrustworthy to 16% of the populace.

It would be incredibly dangerous to set the precedent that being labeled an atheist is somehow defamation of character. It makes me think twice about Hagan's attitudes, to tell you the truth. Is she making any effort to claim that, while she is not an atheist, there is nothing wrong with being one? That in fact, our country was founded by a few of them?

I can't appreciate hearing that being called an atheist is in any fashion defamatory. That got me worked up. People look to Hagan for guidance and admire her. Hagan and Dole should BOTH offer apologies to atheists.

Dole will likely lose not because of the despicable ad, not because of the economy, and not because of the lawsuit. She will lose because she has probably been the most ineffective and inattentive Senator that North Carolina has ever had in its history as a state.

Dole is known not only for her silence on the Senate floor during signifcant debates, but for her physical absence from her so-called home state. She much prefers her DC condo. She represents precisely much of what is wrong with that one branch of our government.

I'm not into the god thing but for this DOLE person to attack an obvious Christian like this will surely send her to hell in a hand basket.

It just makes me sad. What the hell is WRONG with being an atheist? It's no more heinous than being a Muslim or a Jew or a Buddhist or a Hindu or any other faith (or non-faith) of one's choice.

The ad shouldn't have just been about 'It's a lie, I am a Christian', it should have been about 'and why should it matter, anyway, if another candidate were an atheist? Bigotry is bigotry, and should have no place in this election.'

This was supposed to be a country built on the premise of freedom of choice in one's religion, 'godless' or otherwise. How dare Dole assert that someone isn't a good person if they are an atheist. And how dare Hagan think that slur shouldn't matter.

Go for it, Kay Hagan. Just don't forget that people who aren't Christians vote too...

In North Carolina it's actually written in to the constitution that the denial of "Almighty God" disqualifies you from office. (Article 6 sec. 8) What a fucked up state, don't be surprised if Dole get re-elected by a large margin.

For real. Scary. Is this really contitutional. I live in Va and we have no such restrictions. Does anybody else know if their state's constitution has such language.

I didn't know that. I am an Atheist living in NC since 1993. I am not too suprised it's in NC's Constitution. North Carolina is full of CHRISTIAN BIGOTS! I was born and raised in Vermont. I have and accent. I have been harassed for being a Northerner. DAMN YANKEE go the hell home I have been told on more then one occasion. I know where the KKK meeting house is in a certain small town and some of the attendee's are BAPTISTS. Fucking every Sunday Bible beating BAPTIST'S. I have carried a pocket knife since I was 14 years old given to me by my Atheist father. I was told that I am in the Bible Belt now and that I (a female) shouldn't be carrying it. Fuck them. I still carry it and always will.

Let me tell you it is not easy. I proudly display my Darwin fish w/legs sticker on the back of my vehical. I run the Interstate most of the time. I usually run the hammerlane w/the hammer down about 10mph over the speed limit. When those Bible Beating Grannies see it "LMFAO" they speed up and try to pass. I won't let them though.

This state if full of Bigots in every shape and form. Most of the
Bigots I run into are Christians. Lady Dole fits right in.

How about a little perspective?

Calling someone a traitor or terrorist (or even implying it) is much worse than calling someone "Godless" or not a Christian. Either treason or terrorism could lead to prison or even execution. Accusing someone of favoring teaching sex education to kindergarteners is also worse. That's really about child abuse.

Wow, if being Godless is such a horrible thing, shouldn't I be feeling terrible about myself, since I'm an atheist?

What Dole did is the kind of scummy crap we've come to expect from Republicans. It's really bad because it is all that ignorant North Carolina voters need to justify not voting for Hagan, and it is designed to cost Hagan the election. I actually agree it is worse than the usual run of the mill attack ad (in part because it is a complete lie), but it is not even close to being as bad as calling someone a traitor, terrorist, or child abuser. It is much more akin to accusing Obama of being a Muslim. It's great fodder for the really stupid and ignorant, but just as there is nothing fundamentally wrong with being a Muslim, there's also nothing wrong with being an atheist, so (as Colin Powell pointed out) accusing someone of being something that is neither a crime nor unethical should not be an issue.

I think it's more the method than the message that makes this ad so awful. Putting Hagen face on screen with words that were just made up whole cloth. Nobody said what she is acused of saying yet they used a voice over to imply it. That's what makes this so awful. I would argue that putting words into someone's mouth is worse than twisting them.

But I do agree with you that the way this was done -- a voice impersonator -- really is exceptionally despicable. I'm glad Hagan is suing Dole and I hope she wins both the lawsuit and the Senate seat. Then Dole can rot in hell -- except I don't believe in hell (apart from it being eight years with George Bush as president).

There is nothing much uglier than a desperate Republican.

Apparently, there is a religious test for public office in North Carolina.

United States Constitution Article VI, section 3:
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the United States.

So I don't understand how the N. Carolina state constitution can be reconciled with the 'real' Constitution. I'm just a dumb o' carpenter. Are there any lawyers out there who could explain this apparent contradiction? And has anyone ever challenged it or taken it to the SCOTUS.

I didn't realize you had to believe in an apparently singular God to be eligible for public office in North Carolina. Pretty medieval stuff, really. Of course, North Carolina barely agreed to join the original 13 colonies in declaring independence from old King George. They were definitely on the fence.

However, Dole and Hagan are running for the UNITED STATES Senate, not the North Carolina Senate, which should render the North Carolina Constitution inoperative in this case.

Any Constitutional scholars or lawyers care to opine?

We are witnessing a sad phenomenom in politics this cycle....the politicians who can't leave on a positive note. Both John McCain and Elizabeth Dole have had good reputations in politics. Both are career politicians with accomplishments. Neither seems to know when the hell to retire. Why couldn't McCain take the Straight Talk Express and the high regard of the media and ride off into the sunset at 72? Likewise, why couldn't Dole a former cabinet secretary, head of the Red Cross and decent senator just give up the ghost and retire with her elderly husband to the front porch of their Carolina home?

Jeez, do these folks think they are entitled to go on forever?
To leave after such bitter campaigning and with bad feeling all around seems a sad end to a couple of otherwise good careers.

I am glad to know that there are others out there like me. It is lonely being an Atheist in North Carolina. It felt like I was the only one other then my father. It is good to know I am not the only one really pissed off by Dole's attack on Atheists. None of my Christian friends understand. I had to even put one in his place this morning. No holds barred.

It is also funny, all of my friends are Christian in one form or another. It kills me that my Methodist friend and his Baptist friend fight about who's worship is right. When they bring the fight to me I tell them if they want to prove it to me then they need to show me the Math & Science backing up their claims, otherwise keep their mouths shut. They usually leave me alone after that. They don't have a bible with that in it. If they are persistant then I tell them unless they want their feelings hurt they best leave me alone. Then I tell that that their blind faith is the equivelent to me taking Harry Potter literally. They get bent for a few and then drop the subject.

The sad thing about it though, I could show them the Math & Science and they wouldn't even understand it.

I wrote a letter to my local ACORN office about two or three weeks ago suggesting that they look into the possibility of bringing suit against John McCain, the RNC, or specific media pundits for defamation. Specifically on the grounds that the good name of ACORN has been forever tarnished by misleading, false, and unfounded accusations--that have resulted in death threats and violence.

Strangely, there's no mention of them both bearing false witness against atheists. Both talk as if there were something wrong with being one, in much the same way people used to talk about "fags", "ni****s", or "ki**s". Dole is saying the equivalent of "ni**** lover" and Hagan is saying the equivalent of "I don't associate with darkies".

(Edit: It seems C&L has a censorship filter. Unfortunately, sometimes the use of "obscene" words is necessary to make a point, and the bot prevents that.)

I didn't use those words to inflame. I used those words to show that the same mindset still exists, the hate has just shifted to a different target. Those who perpetrate the hate against atheists, however, are the same people who once perpetrated hate against gays, blacks and jews. They stopped hating those groups because it wasn't socially acceptable, not because they didn't want to.

It's why more rational, natural people like us need to regularly go blue in the face trying to patiently explain simple matters like these to the less fortunate, cerebrally challenged.

It's a long haul, but we don't have the baggage to carry around like they do either.

The US Constitution is clear about there not being a religious test. And (IIRC) thanks to the 14th Amendment the US Constitution supercedes the state constitutions. This means that if it ever came down to it the courts would have no choice to simply throw those bogus state constitution laws barring atheists from holding public offices out. I think this has already happened in some states. IIRC there used to be 19 or so states with such wordings in their constitutions.

Anyway I've written emails to Olbermann, Maddow, Hagan, and Blizter. I am wondering where some of the secular/atheist and separation of church and state organizations are regarding this. I have a feeling that The Freedom From Religion Foundation's radio show will talk about it. It's (or at least was on Air America) on Saturdays but an easy link to the podcast can be found here www.ffrf.org

We elect internet predators to office and men with WIDE stance who like to have sex in nasty public bathrooms (hey, I don't care if you are homosexual, but the only thing I think of in one of those bathrooms is how do I get out of this filthy germ infested room faster!). If Steven's wins - we elect felons! But merely being called an atheist threatens to damage your chances for office!

When she could have shown class and Colin Powelled her, she chose the easy route and abandoned the most descriminated class of people in the US. THANKS! I guess I will probably die before the US affords the same civil liberties to folks who temper their beliefs based on EVIDENCE.

I am an Atheist living in North Carolina and I vote.

I have on the back window of my vehical in big white letters, "DOLE IS A BIGOT!" right under my Darwin fish.

This has been getting LOTS of attention from the folks running I85 / I40 between Greensboro & Raleigh. I can run 200 miles a day and that's not including the extra-cirricular I WILL be running.

It will stay there until you either LOSE the election or remove your 2nd ad and apologize to the American people for being a Bigot, Hypocrit, & Ignoramous.
