Marty Lederman has an important post about the torture scandal, The Heroes of the Pentagon's Interrogation Scandal -- Finally, the JAG Memos
. As Marty says, "These memos reveal the JAGs as the real heroes of this story."

The memos are extraordinary. They are written by JAGs from the Air Force, Navy, Army and Marines. As Senator Graham put it on Monday, these folks "are not from the ACLU. These are not from people who are soft on terrorism, who want to coddle foreign terrorists. These are all professional military lawyers who have dedicated their lives, with 20-plus year careers, to serving the men and women in uniform and protecting their Nation. They were giving a warning shot across the bow of the policymakers that there are certain corners you cannot afford to cut because you will wind up meeting yourself."
It is fair to say that these accounts reflected sustained, uniform and passionate opposition to the OLC legal theories that were being foisted upon the military. Indeed, the tone of the memos is one of barely concealed incredulity, and outrage--disbelief--that a young legal academic from DOJ could sweep right in and so quickly overturn decades of carefully wrought military policy, using legal analysis that almost certainly would not withstand scrutiny outside the Administration and around the world. ...

In particular, these memos eloquently warn of the grave harms that could result from such a radical shift in policies and legal understandings--harms not only to the prospects for nation's efforts to stop terrorism, but also to military interrogators and officers who could face domestic and international prosecution for engaging in such conduct, and, most importantly, to U.S. forces who are themselves detained in this and future conflicts.

It's about time somebody starts beating the drum to silence that arrogant, smug bastard. (Here's the video of Robert with Ed Henry trying to be the victim in the Plame game.) I was able to get Novak to apologize on the air twice by simply getting off my ass and raising some hell to CNN. What will it take for the journalistic community to do the same?

As Jay says, "how can they look at anybody with a straight face and say they are concerned for future whistle blowers if one of their own, Robert Novak, together with sources made possible an act of retribution against an actual whistle blower?" Wasn't it Novak who started the rumors flying about Rhenquist?

Sullivan: Here's a question I can't get out of my head. What if Terri Schiavo had had a living will saying she wouldn't want a feeding tube to keep her alive for decades with no reasonable hope for recovery? Legally, of course, there'd be no issue. She'd get her chance to die in peace. But morally? The arguments of the proponents for keeping the feeding tube in indefinitely suggest that removing the tube is simply murder. If that is the case, then how can removing the tube ever be justified - even if she consented in advance? Murder is murder, right? Isn't a "living will" essentially a mandate for future assisted suicide? It seems to me that the logic of the absolutist pro-life advocates means that this should be forbidden too. They should logically support a law which forbids the murder of anyone, regardless of living wills. In a society that legally mandates the "culture of life," the individual's choice for death is irrelevant, no? Or am I missing something here?

You aren't missing anything. If some have their way, living wills will be invalidated:

Theology doesn't matter. Laws don't matter. Your wishes don't matter. Moral obligations are what matters to some of these folks. And before I get flamed, note the terminology Land used- he 'accepts' peoples wishes. If given the opportunity to mandate what he wants, he will. And you are a fool for thinking otherwise.

McCain's Embarassing FCS Gaffe

McCainGaffes John McCain attacked Barack Obama recently saying Obama would "slow" FCS, the future combat system which has been a procurement nightmare with corruption and overruns all around. McCain had previously spoken out about how bad that nightmare has been.

Indeed, it's been so bad that, back in July, the McCain's campaign's senior economic adviser submitted a "plan to balance the federal budget by 2013 to The Washington Post editorial board" that specifically set out what McCain would do about it as president.

Noah Shachtman at Danger Room found the relevant passage:

Balance the budget requires slowing outlay growth to 2.4 percent. The roughly $470 billion dollars (by 2013) in slower spending growth come from reduced deployments abroad ($150 billion; consistent with success in Iraq/Afghanistan that permits deployments to be cut by half -- hopefully more), slower discretionary spending in non-defense and Pentagon procurements ($160 billion; there are lots of procurements -- airborne laser, Globemaster, Future Combat System -- that should be ended and the entire Pentagon budget should be scrubbed).

Does anybody care about the handicapped and elderly?

I know putting together a convention of this magnitude is no small task.

There have been many glitches and complaints, which is par for the course and I know the DNC have tried to do the best they could with parking and credentials and whatnot. But I have asked the DNC for weeks and weeks how they could help me get around during the convention because I have a handicap placard in California due to a real problem walking distances from my nerve damage. I got no response.

I didn't see this link on their website. I wish it was more prominently placed. Obviously, there is a tremendous amount of security and many checkpoints, but there is no assistance available for those that are elderly or not in the best of health, who would not be able to walk miles and stand in the blistering heat waiting to proceed to the Pepsi Center. It's hot and the high altitudes have many people flustered. How many of them knew that Denver would be so hard to maneuver in? I certainly didn't.

When I finally got to the first check point, I asked if there were any carts to take the elderly and handicapped to the next stop. I was told that they were only there to get water for the Secret Service. Hey, they did an amazing job and needed the help too, but what about all the elderly people that came here, dressed to the nines and high heels, because this is an important event to them and they had to travel miles and stand for hour long check points to even see the Pepsi Center? I saw some almost passing out.

I made many calls, not asking for special treatment, but for decent treatment of a handicapped person. When I called ten times on Tuesday, I got voice mails and then was told I would be called back. Nothing happened. I left an angry message yesterday telling them I'd write about it and now suddenly I find out that there is help available. Really? Well, it's too late now. I'm already devastated. I'm pretty good at putting on a happy face when I'm being interviewed and never want to make it much of an issue to my readers, but I just couldn't handle the pain of trying to go out any more.

I have to take some of the blame too. I had people helping me and they came up short too in finding out all that could have been done. I'm writing this to voice a complaint so that the next time an organization puts on a huge event, they seriously take into consideration what all handicapped and elderly folks have to go through to even show up to support or cover that event. I promise to do a better job in finding out how to help those in need of assistance for future events. And I don't think this is only a DNC problem. They are being very kind now and said they misunderstood my situation. I believe them, but I think it's a systemic problem that needs more attention. Telling someone that you are handicapped is not always understood and I get that that's why my calls were misinterpreted. I hope to help those in need in the future because this is a serious issue for many people.

The Convention still has been a blast and I think it's been a valuable experience.
