Tea Party Leader Is Also a Tax Dodger

leahy_c1077.JPG

The timely blog Teablogging has revealed its sources:

According to documents obtained by Teablogging by running a goddamned simple Nexis search on the internets, national Tea Party organizer, Top Conservatives on Twitter cofounder and TCOTReport.com publisher Michael P. Leahy has, over the past 16 years, amassed nearly $150,000 in state and federal tax liens, small claims court judgments and civil suits.

Teablogging has .pdfs of all the documentation. My own impression looking them over is that Mike thinks the rules are for everyone else. Why protest taxes if you think you're not required to pay 'em in the first place?

This reminds me of Mark Foley working to protect kids from sexual abuse.

The ones who complain the loudest are often the most guilty.

Maybe Mr. Leahy is protesting taxes because he's tired of fighting against paying them. What a jerk!

Say what you mean. Mean what you say. But don't say it mean.

Timothy Geithner..anyone...anyone? The list on the Democratic side is longer I believe, not to mention most of them are holding high seats in the current administration.

"Why protest taxes if you think you're not required to pay 'em in the first place?" Oh I don't know...maybe because people believe their taxes are to high? Maybe because the KGB (I mean the IRS) has no due process and can invoke actions they deem sufficient.

"For years, the IRS has proclaimed that the great virtue of America's tax system is that it's voluntary. How does the IRS define "voluntary"? It says that the tax is voluntary because everyone computes his own income tax liability and sends the amount owed to the government. In other words, if the government calculated the tax liability for the citizenry, the tax would be involuntary. But since the people themselves are permitted to compute the liability, the tax is voluntary.

One can only wonder, of course, how many public-school-trained Americans believe this nonsense. The truth is that the income tax is no more voluntary than the military draft. If you fail or refuse to pay, they will seize you, fine you, jail you."

Whatever, you have to tell yourself to get through this.

Stating the facts. If you notice, I did not state my personal feelings on the matter. I used maybe this, or maybe that. My own feelings on the matter would be another issue :)

Except the item about the Democratic side being longer, this is absolute truth.

has gone downhill significantly. Maybe the under funding, due to lack of tax revenue, is having a very negative effect in troll schools?

Really? The IRS says paying taxes is voluntary? I would love to see a link to somewhere that they say that - otherwise I think you pulled that out of your talking points.

Interesting, not an IRS page among 'em. Still, you did provide the answer from one of your links:

Finally, the income tax system is voluntary. That's because people are free to arrange their financial affairs in such a way to take advantage of any tax benefits. Voluntary does not mean that the tax laws don't apply to you. Voluntary means you can choose to pay less taxes by managing your finances in a way to minimize your taxes.

Ah, so it's not that paying taxes are voluntary, it's just choosing which method you're going to calculate what you have to pay is voluntary.

That's not going to help Mr. Leahy much.

wheyghey's picture

No part of the tax payment/filing process is voluntary. But the system is called "voluntary compliance."

http://www.irs.gov/irs/article/0,,id=172790,0...

http://www.irs.gov/pub/irs-news/tax_gap_repor...

Long-Term Goal for Voluntary Compliance

The Voluntary Compliance Rate (VCR) is the amount of tax for a given tax year that is paid voluntarily and timely, expressed as a percentage of the corresponding amount of tax that the IRS estimates should have been paid. It reflects taxpayers’ compliance with their filing, reporting, and payment obligations. The latest estimate of VCR is 83.7 percent for all taxes and all taxpayers for TY 2001.

So the taxpayer has filing, reporting, and payment obligations, but it's a voluntary system. Uh huh.

to pay our taxes to keep our society functioning. If you don't agree, then get off my roads, stop putting your sewage in my treatment plant, and deliver your own damn mail. Until you stop doing all these things, as well as all the others that are funded by tax dollars, STFU and pay your share. To do otherwise is to be unpatriotic.

paid for by user fees and not to my knowledge funded by the federal income tax

JustMyWords's picture

So none of the roads or public works in your area have ever been funded, in whole or in part, by federal tax dollars?

I hate to break it to you, but if you believe that, you are seriously wrong. City, county, state governments - all of them compete, quite ferociously, for dollars coming back from the federal government.

And while the post office may not get direct tax dollars, your mail DOES still need those tax dollars to be delivered. Local carriers drive on those tax-supported roads. The airmail is delivered on planes taking advantage of tax-dollar-paid air traffic controllers.

Do we really need to have this conversation?

Timjoebillybob's picture

Mail I pay for on a per use basis, same as fed ex. If they aren't making enough on it to cover their expenses raise the rates.

Sewage I also pay for on a per use basis, to my cities water department. Again if they aren't charging enough raise the rates.

Roads, should be paid for through state and local taxes and fees which I pay, with the federal portion coming from the postal system which is the constitutional basis for it. And perhaps some from the general fund for the regulation of interstate commerce clause.

I have used exactly the same word as you. Amazing the number of people out there who are like the esteemed Governor of Texas, Perry, who was all about leaving the Union until the Swine Flu outbreak, then wanted a lot of government help on the matter. All for them and none for the country they all claim to love so well.

they are not organizing big protests over taxes. So can't see as how the fabulous patriots of the GOP who don't want to give money to the government in the form of taxes so that the government can do its business....can't see why you wouldn't note that as being highly hypocritical. One of the ladies in my old business used to say to her customers, "You want.....you want....but you don't wish to pay." She should meet some of these guys.

Peabody's picture

This is something I learned by 5th grade:
"To" = preposition i.e., "I went TO the store."
"Two" = cardinal number, i.e., "I bought TWO apples."
"Too" = excessive amount, i.e., "TOO many idiots protesting that their taxes are TOO high while mocking "public-school-trained Americans".

Seriously, if you're going to call other people stupid, at least proof-read your own post.

Anyone who actually attended a "Tea party" knows from the atmosphere that the majority of protests didn't have shit to do with taxes. I would be more shocked if this phony had a positive record on civil rights than diligence concerning his taxes.

And we all know it doesn't pertain to Republicans.... IOKIYAR

wheyghey's picture

A lot of these people say that the IRS is reading the law wrong and that they do not owe income taxes.

And they have a case (sort of) based on legalese semantics.

It hinges on the legal definitions, within the law, of the terms "taxpayer," "gross income," and simply "income."

HA!

Well isn't that...what's the word....fuckin ironic...
I am not the slightest bit surprised.

wheyghey's picture

How is it ironic?

It's like saying "That war protester didn't show up when they drafted him and he went AWOL." or "That civil rights protester sat in the front of the bus."

The guy protests the tax system, and he tries not to pay them. Seems like he's pretty much "on message" to me.

Matthew 22:15-21
15 Then the Pharisees went and plotted how they might entangle Him in His talk. 16 And they sent to Him their disciples with the Herodians, saying, “Teacher, we know that You are true, and teach the way of God in truth; nor do You care about anyone, for You do not regard the person of men. 17 Tell us, therefore, what do You think? Is it lawful to pay taxes to Caesar, or not?”
18 But Jesus perceived their wickedness, and said, “Why do you test Me, you hypocrites? 19 Show Me the tax money.”
So they brought Him a denarius.
20 And He said to them, “Whose image and inscription is this?”
21 They said to Him, “Caesar’s.”
And He said to them, “Render therefore to Caesar the things that are Caesar’s, and to God the things that are God’s.”

And if any passage of scripture has been interpreted a multitude of ways, this is one of them.

wheyghey's picture

Yeah the Bible also tells you to follow the government because the government is of the lord.

Romans 13

1Let every soul be subject unto the higher powers. For there is no power but of God: the powers that be are ordained of God.

You know, like Hitler, Stalin, Mao, Pol Pot, George W. Bush, etc...

2Whosoever therefore resisteth the power, resisteth the ordinance of God: and they that resist shall receive to themselves damnation.

So don't fight against an oppressive government because it is ordained by God.

3For rulers are not a terror to good works, but to the evil. Wilt thou then not be afraid of the power? do that which is good, and thou shalt have praise of the same

Yeah, no government ever engages in terrorism upon good people.

4For he is the minister of God to thee for good. But if thou do that which is evil, be afraid; for he beareth not the sword in vain: for he is the minister of God, a revenger to execute wrath upon him that doeth evil.

See? Hitler was a minister of God.

5Wherefore ye must needs be subject, not only for wrath, but also for conscience sake.

6For for this cause pay ye tribute also: for they are God's ministers, attending continually upon this very thing.

7Render therefore to all their dues: tribute to whom tribute is due; custom to whom custom; fear to whom fear; honour to whom honour.

Whenever the government tells you to do something, you had better do it.

8Owe no man any thing, but to love one another: for he that loveth another hath fulfilled the law.

Wait, Bible, you just said I owe the men in government their tribute. Well, thanks for yet another Bible contradiction.

mnich13's picture

What if, given that Paul is writing as an apostle of the Church, he's referring to the "higher powers" of the Church, and not the government?

It's entirely possible, I believe, that Paul's writings were altered at some point in time to promote obedience to government when he never intended to say any such thing. The book of Acts has "Peter and the other apostles" stating to the Jewish rulers that they'd "obey God rather than man".

At any rate, I give little heed to Romans 13 when somebody attempts to use it to convince me that God expects me to bow down to my government.

hairlip's picture

In the words of Tim Geithner and all the other Cabinet appointee cheats. "It was an honest mistake, but correctible." Have a bleeding heart like you have had in the past......

JustMyWords's picture

Well, why not just compare apples to oranges while you're at it.

Geithner, et al, have not been accused of being "tax cheats" by anyone other than right-wing gum-flappers. Please tell me which of the Cabinet appointees had been prosecuted? Sued? Which one of them did not make good on their obligations? If seem to remember that with the recent Cabinet appointees, they apologized and made good after being informed of their errors on their returns.

Leahy's situation is quite different. Since apparently you didn't actually read the article, it states "over the past 16 years, [Leahy] amassed nearly $150,000 in state and federal tax liens, small claims court judgments and civil suits."

Really not exactly the same situation. And Leahy isn't ignoring just federal taxes, he's ignoring state taxes. He's ignoring court judgements in civil suits. Hell, he's ignoring small claims court judgements.

What a prince among men.

Only when the last tree has died
and the last river has been poisoned and the last fish has been caught

wheyghey's picture

So if all food was grown and distributed by the government, and all other food was outlawed, would you criticize someone for eating but not paying their taxes? Then your argument is that the only food that exists is there because of taxes so everyone had better pay their taxes or they must starve.

Your argument above is that only the government is capable of building roads and only taxes could ever finance them, so anyone who is against the income tax (which doesn't pay for roads by the way) shouldn't use public roads.

Kathy in St. Louis's picture

but in such a circular fashion, you may want to go back and clarify. By the way, have you built and nice new roads lately? See, I haven't.
