Dick Cheney Indicted in TX.
Not much info in the piece because the information is not public yet, but a DA has indicted Cheney and Alberto Gonzalez and a few others on charges that are related to corruption in the private prison system following an inmate's death. And not surprisingly, there's some profiteering involved.
I'm sure Cheney will try to have it thrown out of court.

the first and second of Bush's pardons?
Boo Hoo
The State of Texas is bringing these charges. The president is limited to pardoning federal crimes.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
if that's the case then I'm happy as a clam today! thanks Karen
Whoo, hooo!!!!!!!!!!!!!!!
Also, a series of tubes just told me that Ted Stevens has lost his reelection bid in Alaska!!!!
Another Whooooooooo HOooooooooooooooooooooo, booo, hoooo, hoo!!!!
I saw that too, then I come to C&L to find that Cheney and Gonzalez have been indicted! wow, what an orgasm!
Then hopefully soon Georgia, let the bodies hit the floor, sixty here we come.
I'm not letting it dampen my optimism. The best part about winning Georgia would be that the Senate Democrats could then take off their fake masks of reconciliation, and drop-kick Lieberman into the Potomic.
Isn't Texas where Cheney got drunk and shot that guy in the face.
I'm sure a whole lotta scary shit goes down in Texas. Kinda makes me shudder.
(Actually, I'm almost afraid of any place that isn't charming New England. It seems civilized there to this Canadian.)
"If the US government enforced its banking laws like it did its park regulations, we wouldn't be
in this damn park in the first place." OCCUPY.!!
funniest response of the night...
Bush can't pardon for state crime violations and I assume that is what these are.
That's right, I'd forgotten that presidential pardons don't apply to state laws. What about a GOOBER-pardon?
Yeah, the Gov could of course. I am assuming that is what you mean by Goober.
Goober, as in that clownish guy that used to put gas in Andy Taylor's truck, while he was hauling Otis the town Drunk off to jail.
Why bother to "try" to do ANYTHING in court. He knows he's two months away from a blanket 2000-2009 presidential pardon, anyway. In fact, I've bet money on Cheney taking a shot gun into the Senate and going on a shooting spree on January 19th, knowing that his ass is off the hook for anything and everything as of January 20th.
However, from their perspective, the ultimate Bush/Cheney "in your face" coup would be for Bush to give a Nixonesque pardon to Cheney (for anything and everything he MIGHT have done during his tenure as VP) on January 19, and then resign. Cheney is sworn in the same afternoon, then turns around and pardons Bush, gives the press corps the finger, turns around and hauls his butt on to Marine 1 and sputters off into the sunset.
Are they truly that fast? The video is no longer available?
here anyway

Sure, go ahead and blame all this neo-fascist bullsh!t on the poor, troubled kid with the drinking problem. But I don't think he works for the White House anymore.
You couldn't have waited until Bush left office, could you? Then you could have hung his wrinkled ass from the highest tree and they couldn't have touched you.
But what the hell, go fry his ass, or at least give it the old college try.
I know it seems insane but legally, Bush can (and will) grant blanket pardons for his entire admin (including himself) for anything they may have done during his presidency, (here's the insane part) EVEN IF THEY HAVEN'T BEEN CHARGED WITH ANYTHING!!!
Surely the new POTUS with his dictatorial powers could override a previous POTUS pardon.
After all their word is above the law, Chimpy proved this time and time again, he set the precedent
The President of the United States has no power to pardon people convicted of state crimes. Only federal.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
No... but they can always try and get the case moved to a federal court instead of a state one.
Zenrage:
Removal to federal courts is typical in civil litigation, not criminal. It's extremely rare and much more difficult in criminal cases. Besides, as far as I know, even if the federal courts were to hear the state charges, and adjudicate the case, it would still be a state conviction under the state law.
There might be some interesting legal conundrums in there, but criminal defendants don't say, "I shouldn't be prosecuted under this state law, but here's a federal law under which I can be prosecuted."
They'll do all sorts of pre-trial litigation, filing motion after motion, trying to get the case quashed before it even begins.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
Forgive my ignorance of legal matters, but perhaps this indictment was a way of ensuring that Cheney doesn't pack up and move to Bahrain as soon as he leaves office (or before, perhaps.)
They need to go after Bush too.
Sodomy. the victim: everyone.
Sadly, I think they saw that train coming a long time ago. Which is the only reaso I can think of for the current Supreme Court of Wingnuts to overturn all the state anti-sodomy laws in 2003.
I'd love to see these assholes in the Hague. No Pardons there.
me-oww!
Remember Chimpy's threat to invade, if any US citizen got taken to the Hague.
But that only applies up until 01/19/09 after then its open season on Bushco.
Also, don't the French or the British have a warrant out for the arrest of Donald Rumsfeld as a war criminal? I don't remember the details. But if it's Britain, I think it was just another 'stunt' that the politicians running the city of London pulled, with a municipal warrant.
His 'people' aka US gov types heard that the French police were coming to arrest him while he was having breakfast at the Hilton ! 30 minutes warning etc.
US embassy staff whisked him away off to an US airbase in Germany, where he got a mil flight back to the US.
Not bad having all those gov employees and US mil resources working for you, when you are merely a private citizen.
As much as I would like to see it happen.. This is a stunt.
Its not going anyplace.
basically Cheney is an investor in a prison company and they are aledging he protected the prison from investigation of abuse.
Children and adults suffered, some died !
As with Al Capone and the Feds, they got him via tax evasion.
So it can be with the Bushco perps, they can avoid the big stuff, but minor things like civil rights will hang them.
So, they'll get around to nailing Cheney just as soon as they're finished with Joe the Plumber?
Joe has been forgotten by most of the MSM. The people knew who he was, a partisan looking for fifteen minutes of fame. And MSM gave it to him. Idiots!
Here's a wiki link, if anyone is curious. http://en.wikipedia.org/wiki/Private_prisons
Lately, Karma has been kicking ass. Now Stevens lost his senate seat in Alaska. Poor Sarah Palin! She thought she would be a shoo-in. Now it has gotten much more complicated.
This story was broken early this morning on the East Coast and VERY early on the West Coast by Steve Langford on Howard Stern's "Howard 100 News." Langford has been like a bulldog on the GEO prison story since the death of Stern Show regular, Kenneth Keith Kallenbach who died of untreated complications of cystic fibrosis. He fell ill while in jail, (a GEO owned jail) and was not treated soon enough. Kallenbach was the character who could "blow smoke out of his eyes."
He had been picked up for supposedly trying to entice an underage girl into his car...a charge that is now in some doubt, but will never be fully investigated due to Kallenbach's untimely death. He had a medical condition that was not being treated in jail, and upon his death his family filed a wrongful death lawsuit against the jail and its owners.
Who would've thought that an admitted goofball like Howard Stern would have a news team that could've ever found out anything more important than what Wack-Packer could crap more than another? After I heard this info early this morning on the Stern Show, I searched for HOURS on news sites for more information, but apparently they were on top of this story before almost everyone else...go figure.
On Tuesday, November 18 at 10:00 AM, I was having a Capuccino and a Cornetto in Italy as two men within earshot were talking about Cheney being indicted. This would have been 4:00 AM East Coast time in the USA.
The get their news unfiltered.
How big will the Bush AmNest become? Can he pardon himself from crimes he expects to commit in the next two months?
ljmel
To all the folks worrying that Bush will simply pardon Cheney, HE CAN'T!
The president does not have the power to pardon non-federal crimes. The state of Texas is bringing these charges, and that's out of Bush's jurisdiction.
Now, I wouldn't hold your breath, or anything. Powerful people have powerful connections all over the place. But the president's pardon power is not an obstacle here.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
To think, TEXAS is bringing the charges. LOL. Limpballs and O'Liely can't say it's liberal north or La La Land, California.
P.D.:
Oh, they're already saying that. Just not quite that way. They'll go after the D.A. as an overzealous, crazy liberal.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
Finally coming out of woodwork and getting their late revenge on the neocons.
Repugs can't grasp that the majority of the people are more moderate, and they do so at their own peril. Claiming that they aren't conservative enough, is laughable. So let Palin be their leader. They will be the way of the Whigs.

Protest!
The President can blanket pardon everyone but himself for federal crimes. He will need Obama's help in covering his own ass.
Not that I put it past him giving it a try.
Scholars argue about whether a president has the power to pardon himself. It's been largely an academic exercise, since no president has had the audacity to do it. (Nixon pondered it.)
I wouldn't put it past Bush.
Hell, I wouldn't put it past Bush to announce that he has pardoned himself for any crimes he might feel like committing in the future, whereupon, I hope we would have the good sense to have Bush himself committed in the near future.
Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?
That's why they should wait to go after BushCo until after Chimp leaves office.
"In Texas, we have the death penalty and WE USE IT. Kill someone in Texas and we will kill you back."

If it was you or me, we would have been sent straight to prison. But in Chaney's world( I call it Bizzaroworld) he got of clean. That still pisses me off.
It's worse than that. In Texas they have no reservations about executing people with mental retardation, or the mental age of a five years old. Which means that even Bush himself should be worried.
On Family Guy, they touched on that that when Peter Griffin said he was mildly retarded. Those Texans are loco.
May this be the first of many indictments for this crooked SOB.
see now why can the fucking congressional Dems have this kind of spine.
useless.
After Guerra's office was raided as part of the investigation early last year, he camped outside the courthouse in a borrowed camper with a horse, three goats and a rooster. He threatened to dismiss hundreds of cases because he believed local law enforcement had aided the investigation against him.
This is our point man on this? We are doomed.

Simply wow. I thought you were kidding.
Jeebus...are all Texans nuts?
.
And I am sure Bush put it there!
Koolaid? :-D
No, all Texans are not nuts. But in Texas, as in many parts of the world, the people don't expect good government from their leaders. They expect ENTERTAINMENT! If you can't tell colorful anecdotes about political corruption in the "old days," burp and f@rt simultaniously, or blow the balls off a racoon with a black powder musket at 100 yards don't bother running for office in Texas.
He camped out at the courthouse. After being the DA for twenty years, many grudges existed. His animals were not safe at home, to put it simply... plus then he had his alarm "clock" as well. I can just see this... but then, I'm a native Texan.

Must have to be from TX 'cause I agree...this does not instill confidence and to a good part of the country, I would think they (and I) would just think he was f'ing weird.
Something does seem a little fishy here

The more I read about this, the more I think this nothing but a petty little squabble between two small time political rivals.
As much as I would like to see Cheney and Gonzalez get their come-uppance, I doubt that this will go anywhere.
I believe that many Texans, being themselves quite insane, appreciate the insane behavior of their elected officials. Gives them a break from ignoring corruption and waiting for the End Times. Please note that I'm not saying that all Texans are insane; just the wingnutty ones.
"I'm sure Cheney will try to have it thrown out of court."
And, if that doesn't work, DICK and 'Berto will just invite the DA on a little duck hunting trip, yew betcha'!

Isn't 'berto clerking these days? For some second rate firm, no less?
The AG position just ain't what it used to be. ;-D
It would be wonderful if these crooks would finally get thier comeuppance. But something tells me they have "God" on thier side.
From what I read, the DA of the county was under indictment once upon a time himself, but a judge threw out the indictment. I'm sure the same is in store for Cheney and Gonzales as well.
A former Republican Vice President and former Republican Attorney General are facing indictment.
Isn't this just part of the process?
Corruption favors the wealthy.
A sitting Vice President. In any other country, this would be front-page news. However, it may also be the first crack in the dam; Bushco's co-conspirators can be indicted. And if they can be indicted, they can be investigated. See where I'm going with this?
YOu know it's just the tip of the iceberg! If they bothered to really investigate Cheney and Bush they'd find hell on earth. They both need to spend life in prison!
I hope Obama and the Dems now that they have power won't say "Oh, the American people just want to move forward and not look back"
No, we want to move forward AND look back to punish those who wrecked our nation and broke the law. This is the first step towards regaining our national reputation. To do other wise would be looked at as a wink and a nod to the powerful and corrupt by the free world and our reputation will never be fully repaired until we go after these criminal thugs.
And might I ad HAW!
Just seeing the name "Dick Cheney" and the word "Indicted" in the same sentence warms the cockles of my heart!
The sad fact is that whole families are being held in these private prisons. Many of the inmates are children. They even have teachers that hold classes for the children in these private prison facility. These people are immigrants that are awaiting deportation hearings. Some of these families have been incarcerated for years. It's a horrible situation and I am very glad that a DA has finally tried to do something about this.
http://aclu.org/immigrants/detention/28865prs...
I certainly hope a judge does not dismiss this case.
Private prisons should be outlawed. I had no idea Cheney had any ownership in them, but i am not surprised. If slavery was legal he would own thousands of people and torture those he was displeased with.
I wonder who he has locked up in his man sized safe?
Go get em!
Wouldn't it be sweet to see both these assholes doing time. Go get em!
Hey, Tubes Stevens thought he was entrenched and above the law. Along with Dick Nixon. Could happen.
Did Christmas come early, and no one told me?
As I mentioned elsewhere, there is a very real debate as to the ability of a president to pardon crimes which are not yet being prosecuted. As mentioned on a recent Olberman show, a president is not supposed to be able to pardon someone until they are actually facing justice.
This issue has NOT been resolved by the Supreme court, and the Bush crime family doesn't want to take a chance that it will be sent to the Supremes. They want their ducks in a row, so to speak, and strange as it might seem, this indictment actually HELPS secure a pardon from Bush -- one which would almost certainly past Supreme Court scrutiny, since the pardon would take place AFTER indictment.
And the person who claims that the President can only pardon federal crimes is simply wrong. Nowhere is that limitation stated in the US Constitution. Nowhere.
