A NEW BILL OF RIGHTS
Proposed Amendments to the United States Constitution

Article I: The Pursuit of Happiness

Neither the government of any state nor of the United States shall infringe upon the equal right of each and every person to pursue his or her own happiness.

In any case or controversy in which a person challenges an infringement upon his or her pursuit of happiness, the state shall bear the burden of proof that the law either does not so infringe or that the law is necessary to secure the equal pursuit of happiness for each and every person.

Article II: Consensual Legislative Representation

Each and every person of the age of consent shall command an equal portion of legislative power over the laws by which he or she is governed, that power to be delegated to a representative in the U.S. Congress and to state legislatures.

The right to vote shall be construed as the right to transfer consensually that portion of legislative power to a representative, and each representative shall command only the legislative power directly proportionate to the number of persons who contractually delegated their portions to that representative.

Article III: Health Care

Consistent with its power to tax and spend for the general welfare and to secure the equal pursuit of happiness, the government of the United States shall make available a form of public insurance that guarantees access to health care for each of its persons who are citizens of the United States.

Article IV: Person Defined

The word "person" in this Constitution and in the laws of the United States and the several states shall be construed only to include living human beings, not entities created by law.

The word "person" in this Constitution and in the laws of the United States and the several states shall not be construed to exclude any living human beings on the basis of race, ethnicity, national origin, status as prisoner of war or enemy combatant, religion, sex, sexual orientation, gender identity or any other arbitrary ascription.


Everyone is equally entitled to the pursuit of happiness. Wasn't that once self evident?

until you do run the country? How about changing who we vote for to represent us? Some think term limits but do we want to get rid of Kucinich, Sestak, Wiener and Grayson types. Work hard during the primaries.

Personally, I believe we should all be working on reforming the electoral system -- first at the local levels, and then on up to the state and federal levels.

(We can work hard in the primaries, but it won't necessarily make any difference in this system. Consider, for instance, the Lieberman disaster and the fact that our current electoral system puts pressure on any representative to bow to the whims of the continually shifting 51% of his or her arbitrary districts and the people who fund campaigns. Oh, and term limits are a pretty shoddy attempt to fix things in my opinion.)

What we really need is to guarantee that our representatives actually represent the people who voted for them, which is what I was going for in one of my amendments. We're not going to get better representation until we abandon the idea that representatives represent districts, and win the right to cast votes on their district's behalf by winning a plurality of the votes therein. We have to abandon the idea that the right to vote is merely the right to suggest one candidate, only to lose all representation altogether if our one candidate does not win an election.

Maybe I'm being too meta-analytical . . . in any case, if we really want to make an impact on our government, we can work locally to reform the way we elect people in the first place.

that you gave a very thoughtful answer. I have been very supportive of public financing of elections. Take the power away from the corporations and their lobbyists.

Public financing would be another wonderful reform.

Of course, because of the current doctrine, doing it right would require a Constitutional amendment specifically authorizing it. So, I wasn't totally without practicality in my original approach, offering amendments for discussion. ;)

Senator Sanders, I think it will be up for discussion. There is no reason other than those that work so hard to get corporate financing wouldn't be in favor of it. When they realize how hard they have to work to get corporate lobbyists to finance their elections and how public financing would take that burden off their shouders, it could be an easy sell in the House and Senate.

I do hope Bernie gets it passed, in a form acceptable to the Supreme Court, but I don't think it's that easy.

There is no reason other than those that work so hard to get corporate financing wouldn't be in favor of it. When they realize how hard they have to work to get corporate lobbyists to finance their elections and how public financing would take that burden off their shouders, it could be an easy sell in the House and Senate.

Oh, there's a reason: Public financing would also finance their opponents. Equally. And limit their spending to the funds doled out. Incumbent politicians don't want competition. They like the idea that they have the experience to play the system well, earning a financial advantage over the naifs who challenge them.

Moreover, not every representative is there because she actually believes in something. They don't necessarily want to change the country for the better. They're happy to take money and kickbacks from whatever special interests get an advantage from the status quo.

they don't want the competition, but they do have to take into account the time and effort they have to put out to get the money rolling in from those corporations and lobbyists. They don't even have time to read the bills, especially the republicans

Obama finally stands up to Myanmar, but still needs to do something about his love of out-sourcing via sweatshops. Britain and Australia are forced to apologize for exporting poor children for (slave) labor. Global warming is wiping out Hawaii's beaches. Barry thinks pulling a Clinton on domestic spending will "appease" the moderates. Did Christianty contribute to our economic crisis? At least those poor rich people can finally breathe easy. The law-talking guy who sent a bunch of innocent people to prison on trumped-up child molestation charges in the 80s is finally retiring. And like McCarthy, he's still loved by his supporters. Hillary plays nice with Palindrone. Male and female Brit soldiers engaged in rape of detainees. Yeah, trust the guy who backed Dances with Smurfs, Dumbya, and McCain, to know what he's talking about on charging for online information. Considering the Pope is more out of touch with modern Catholics than the Dems, I don't imagine this scenario happening, unless Republicans and Bishops somehow manage to come up with jobs in the private sector any time soon....

global warming is said to be something that could cause the problem to get worse; however, the writer sure does a crap job of authoring what could be an informative article and instead opts to make a sensationalized scare fest for the beach hungry locals. of course,in doing so, global warming is one of the first problems mentioned (even though it has nothing to do with the current beach loss).

No wonder Inhofe is all over everyones ass when articles are written like this, it sure doesn't help the cause, does it?

Global Warming is another case where the Pukes are correct in that the poor and middle class get stuck footing the bill. It hurts them the most, the rich, not so much.
Until we start taxing/fining according to earnings, the regular folk are going to get the shaft again.

The Young Turks have an amazing interview with one of Sara Palin's defenders. In defense of Palin's "death panel" comments, he says that the government will inevitably withhold care from some people, and that people die when health care is withheld. When asked by Cenk Uygur whether the current health insurance companies could be said to have/be "death panels," since they routinely withhold health care from people who then die, he actually said that it only counts as a "death panel" if the government does it.
