My oh my, I don't think the Republican Party is trying very hard to disprove the widely held notion that they are the party of privileged white men. Let's look at their perhaps unintentionally revealing tactics in questioning Supreme Court nominee Sonia Sotomayor:

First, we have Sen. Jeff "I couldn't become a federal judge because of my racist tendencies" Sessions basically telling Sotomayor that he expects her judgments to fall in line with other Puerto Ricans on the bench, because they're Puerto Rican. (h/t Think Progress)

And then Sen, Jon "We don't want no stinkin' Gazan refugees" Kyl goes off on a SEVEN minute rant to Sotomayor over his out-of-context interpretation of her "wise Latina" remark (thinking and talking points courtesy of Rush Limbaugh), despite the fact that Sotomayor had already addressed this issue a number of times.

And then Sen. Lindsey "I'm going to throw a tantrum and shut down the Senate if you get to see what we enabled" Graham treated Sotomayor with such attitude that even MSNBC's Tamron Hall and Mike Viquera termed it "patronizing".

And then to really hit home how the GOP's exposure to minorities come almost exclusively from TV sitcoms, Sen. Tom "Don't Ask, Don't Tell about my fellow GOP's sordid affairs" Coburn invokes none other than Ricky Ricardo to warn Sotomayor if she--metaphorically speaking, of course--attacked him.

Really, GOP...how do you think you're gonna attract that all-important Latino bloc of voters to your side in 2010-- with fried chicken and potato salad?

For a short time in my life I sold display ads for a local newspaper. One of my clients was a car dealership and the guy who owned it had a thick as hell southern accent. He told me once that when people bought cars from him, because of his accent the customers thought he was stupid and everytime he sold a car the buyer automatically thought they had gotten the best of the deal. Don't be fooled by accents.

Oh no, don't be "fooled" by the accent. The point is I have these "kinds" in my family closet(believe me, we keep them in the closet...incest, prison time, etc). They are "highly predudice"(and they are no gems themselves). Their deciet levels seem higher than the average bear and their self- rationale is always there. Their bigotry seems, almost, guaranteed. And when dealing with them they throw tantrums, falsely accuse and believe "their way" is proven American. But they back stab family members for gain.

The comments Lindsay Graham read originate from lawyers who regularly appear before Judge Sotomayor. Graham did not make them up. I regret to say that there is no disputing the fact that among this group, she has a reputation for lack of congeniality and hostility and arrogance. And these are lawyers who do not say the same thing about other judges, be they Latino, female, or African-American.

I have litigated in federal courts for 25 years. Judge Sotomayor is not the worst judge or the biggest bully I have experienced, but she is certainly in the bottom 25 percent. I support her nomination because she is not unqualified (I never got no summa from Princeton and her resume beats hell out of mine), because I support Obama, and because it is disgusting that no Latina has made it to the Supreme Court.

I just wish I had more reasons to support her. Like that she is a great or brilliant or exceptionally fair Judge. She is none of those things.

According to him, Sotomayor does not have a reputation of being particularly friendly. However, that isn't a prerequisite for being a Supreme Court Justice. She is demanding, doesn't suffer fools gladly (which makes her performance during these hearings all that much more impressive) and can be brusque with those around her.

However, I wonder how much (and honestly, I don't know the answer to this) of the "bitch on wheels" reputation she has in law circles comes from being a woman in a man's world. My personal experience is that women do the same things as ambitious men are often referred to as "ball-busters" and other epithets.

Friendliness is irrelevant, I agree. And there is a double standard, as you say. And,yes, she is doing a good job at the hearings, though not blowing your top in the U.S. Senate shouldn't impress us too much. None of the above proves that Judge Sotomayor is free from arrogance and willful ignorance, however.

I clerked for a woman Judge -- an infinitely better lawyer than me -- and respect and admire my woman colleagues. Thank God that they are transforming and improving the law and the legal workplace. (Much nicer place now, for me at least, than back when I started, in what was then a male club.) And the tougher the better, as far as I am concerned.

But there is a reason we call them "hearings." Those "fools" she will not suffer are the representatives of parties before the court.

Kyle made some perfectly valid points. The fact is that Sotomayer *has* quite clearly stated in the past that her Latino background and experience helps her in decision making, and even makes her a potentially better judge than old white men. And it bothers me that Sotomayer has not only failed to respond adequately to these points, but that she has been given a free pass in the media for doing so.

It seems to me that Sotomayer's present claims about making judgements based only on "the law" are very much at odds with her previous statements, and quite frankly make her look disingenuous. If she thinks her background makes her a better judge, she should be honest about that, not suddenly change her tune when she gets in front of Congress and try to pretend she's some sort of literalist.

if you bothered to listen to the whole of Sotomayor's speech that day to see that she didn't say anything of the sort. In point of fact, she said just the opposite, but that's one of those inconvenient facts that prevent any actual critical thinking being from believing that Kyl had a valid point.

Well it might have helped Nicole if you guys had actually posted her responses instead of just the questions. It does make it rather hard to make a judgement. Admittedly I haven't watched much of the proceedings, only clips because I haven't time to do anything else, but the responses I have seen to date have not impressed me much.

Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O'Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with the statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.

Let us not forget that wise men like Oliver Wendell Holmes and Justice Cardozo voted on cases which upheld both sex and race discrimination in our society. Until 1972, no Supreme Court case ever upheld the claim of a woman in a gender discrimination case. I, like Professor Carter, believe that we should not be so myopic as to believe that others of different experiences or backgrounds are incapable of understanding the values and needs of people from a different group. Many are so capable. As Judge Cedarbaum pointed out to me, nine white men on the Supreme Court in the past have done so on many occasions and on many issues including Brown.

However, to understand takes time and effort, something that not all people are willing to give. For others, their experiences limit their ability to understand the experiences of others. Other simply do not care. Hence, one must accept the proposition that a difference there will be by the presence of women and people of color on the bench. Personal experiences affect the facts that judges choose to see. My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.

I also hope that by raising the question today of what difference having more Latinos and Latinas on the bench will make will start your own evaluation. For people of color and women lawyers, what does and should being an ethnic minority mean in your lawyering? For men lawyers, what areas in your experiences and attitudes do you need to work on to make you capable of reaching those great moments of enlightenment which other men in different circumstances have been able to reach. For all of us, how do change the facts that in every task force study of gender and race bias in the courts, women and people of color, lawyers and judges alike, report in significantly higher percentages than white men that their gender and race has shaped their careers, from hiring, retention to promotion and that a statistically significant number of women and minority lawyers and judges, both alike, have experienced bias in the courtroom?

Each day on the bench I learn something new about the judicial process and about being a professional Latina woman in a world that sometimes looks at me with suspicion. I am reminded each day that I render decisions that affect people concretely and that I owe them constant and complete vigilance in checking my assumptions, presumptions and perspectives and ensuring that to the extent that my limited abilities and capabilities permit me, that I reevaluate them and change as circumstances and cases before me requires. I can and do aspire to be greater than the sum total of my experiences but I accept my limitations. I willingly accept that we who judge must not deny the differences resulting from experience and heritage but attempt, as the Supreme Court suggests, continuously to judge when those opinions, sympathies and prejudices are appropriate.
