Obama: Close Gitmo and No Torture
By John Amato Tuesday Dec 09, 2008 12:30pmIt's really very simple. Obama needs to keep his word and close down Guantanamo Bay and make sure we DO NOT TORTURE. I was on a conference call with Digby, mcjoan, Christy of FDL and Glenn Greenwald along with Anthony Romero from the ACLU last night who was at the trial yesterday, and he said the awful military commission, led by the judge, Colonel Stephen Henley, put on a good performance to make believe these guys were tried in a real court. It was all kangaroo.
In a letter the judge read aloud in court, the five defendants said they "request an immediate hearing session to announce our confessions".
The defendants said in the note that they made their decision on 4 November, the day Mr Obama was elected to become the next US president. It appeared that they wanted to rush towards convictions before Mr Obama – who has vowed to end the war-crimes trials and close Guantanamo – took office.
Mohammed and another defendant, facing possible death sentences if convicted, said at their arraignment in June they would welcome execution as a path to martyrdom.
But word that they were giving up their defence came as a shock to some of the victims' families – a select group of whom were in court.
Alice Hoagland, of Redwood Estates, California, was there for her son Mark Bingham, who is believed to be one of the passengers who fought hijackers on the United Airlines flight that crashed in rural Pennsylvania.
She said the defendants' announcement was "a real bombshell to me".
She told reporters she hoped Mr Obama, "an even-minded and just man", would ensure the five alleged mass murderers were punished.
The judge, Colonel Stephen Henley, asked Mohammed and his co-defendants if they were prepared to enter a plea. All five said yes, but Col Henley ordered mental competency tests on two of them. Mohammed said they would wait and all plead together.
There's an obvious power play going on to make it harder for Obama to proceed with his foreign policy plans and force him to bend to their will. Glenn Greenwald made the great point that he feels Obama will close Guantanamo, but what about the trials? These military commissions are a travesty of justice and we have to wonder what Obama will do about them.
If Klaus Barbie could be tried and convicted in an open court, then why can't Khalid Sheikh Mohammed be given the same treatment? What is wrong with the American legal system? I'm not glad to be defending these very bad people, but we have to keep the rule of law intact. We are a nation of laws. Use them. If Obama does the right thing and doesn't bend to the tremendous pressure from the military that is in overdrive at this point, he will show true leadership that will have a great impact around the world and actually remove a powerful recruiting tool for the growing number of terrorists.

"This afternoon's hearing was just another chapter in the Guantánamo military commissions debacle. Neither the military judge nor the accused are clear about how these proceedings will move forward. What is abundantly clear is that no matter how hard the government tries to advance the military commissions, this process doesn't work.
Questions of the death penalty and the competence of several of the defendants are still unresolved – and not likely to be resolved. The only solution is to shut the military commissions down and start from scratch."

In last night's conference call, Romero emphasized the fact that the military commissions process has been so haphazardly slapped together that even the judge didn't know how to proceed with a guilty plea, whether a death sentence could be imposed if the case wasn't heard by a "jury."
But even more disturbing to Romero, and what should be a red flag for the incoming Obama administration intent on shutting Guantanamo down, was the attempt to show that this proceeding was the actual equivalent of a real trial, a show put on for the visiting press and particularly a handful of 9/11 victims' family members to garner good PR for the military commissions process and for keeping Guantanmo open.

but, it is crucial to note: closing gitmo is just the very first step to be taken. close the torture facilities in eastern europe, at bagram, at abu ghraib, etc. any and all black sites, torture centers, rendition agreements need to be stopped IMMEDIATELY. then, the CIA must be forced to adhere to the military's rule of conduct in interrogations and habeas corpus needs to be reinstituted. finally, any one complicit in torture needs to stand trial for their crimes against humanity.
if the criminal justice system can handle timmy mcveigh, then it can handle alleged al qaeda thuggies.
torture and renditions CREATE terrorism. obama knows this, and i am glad to see that he is still speaking out about gitmo. keep it up obama, but don't stop there.
It's a shame that the vast majority of US citizens don't agree with you and believe that ignorance and hate are the way forward, as demonstrated by their attitudes, beliefs and for most their votes over the last 8 years.
The days of the screaming for blood and giving up of any civil liberty to Bush haven't been forgotten by the world. They are just going to be swept under the carpet so the US can feel better about itself, living with the lies once again.
Anything less is obstruction of justice. There is substantial prima fascie evidence to indict and convict these treasonous bastards.
I will not hold my breath as I know NOTHING will change with this administration.

Indeed, it would be astounding if anyone in the US actually understood the word "repercussion" .......
The backlash to the current US foreign policy is going to be devastating, ending, I would say.
The hate and pain exported in the name of "bringing them democracy" ( while stealing their oil) is going to be magnified and reflected a hundredfold.
At this point the World Court (Hague) would be best, even if survivors of 9/11 victims dislike it.
Unfortunately BushCo made that almost impossible with all their torture and illegal imprisonment.
The US dosen't recognize the international criminal court, they would have far too many people in it if they did.
Typical US world view, if they can't destroy or control it, they ignore it and just shout about how great they are, much like the US people when around the world.

Obama says he wants to establish a new tier of courts in the US system especially for these accused.
How is that NOT going to be functionally the same as the military drum-head/kangaroo courts now?
The other point is that the Military Tribunals don't have a precedent for a death penalty case where they plead guilty like this. The idiots never planned for this. NOw the courts are trying to figure out if they CAN PLEAD GUILTY or not.

These courts are such a joke, that you can't even plead guilty and confess in a legal sense
the judge may have to tell them they have to go to trial to be proven guilty even though they are saying they are guilty.

With the urgent tone and prescriptive language in this post one could be excused for being confused. Mr. Obama is not yet in command of anything but his staff and his time. So save this post on your hard drive and come July or August 2009 when he hasn't closed Guantanamo Bay, and whatever else he was supposed to do for you, then you can wail and holler.
Has anyone else out there noticed the right wing media urging this same frame - that Mr. Obama is somehow not doing enough and is therefore remiss, even though no oath of office, no inauguration party, and etc.?

Seems to me the Nazis used captured persons to carry out physical and mental experimentation in their secret prisons. I believe the mental testing of human limitations is much worse than the physical torture. It has been reported there was child sexual experimentation in OUR secret prisons ie. getting the parents to spill the beans. There is no reason for secret prisons if the intent is to hold persons until the end of combat. That these bastards will live in our communities in the future scares the shit out of me because once you operate on the dark side there is no going back. In the future the United States will suffer innumerable, despicable crimes,in our towns, carried out by those we allowed and encouraged to carry on like animals.
It's time to reconsider our ability to project hard power by our military to further our greed.
What ever happened to the court proceedings about the destroyed interrogation tapes?

Close down Gitmo, reinstate habeas corpus and punish those who torture.

Q U E S T I O N S:
If the detainees are seemingly guilty of being involved in the commission of hideous acts, or the plotting of said acts, why fear trying these detainees?
Now, if some detainees are not found guilty through the use of fair trials, then why fear releasing them?
It still fails logic, NO?
