Attorney: Rove Will Cooperate With DOJ Probes

Murray Waas reports that Rove is apparently being cooperative with investigators in both the U.S. attorneys case and the Gov. Don Siegalman case:

Karl Rove will cooperate with a federal criminal inquiry underway into the firings of nine U.S. attorneys and has already spoken to investigators in a separate, internal DOJ investigation into the prosecution of former Alabama Gov. Don Siegelman, his attorney said in an interview.

Rove previously refused to cooperate with an earlier Justice Department inquiry into the firings. The Justice Department's Inspector General and its Office of Professional Responsibility (OPR) said in a report released last September detailing their earlier probe of the firings of the U.S. attorneys that their investigation was severely "hindered" by the refusal by Rove and other senior Bush administration officials to cooperate with the probe.

Rove's attorney, Robert Luskin, said that Rove, however, will cooperate with a federal criminal probe of the firings being led by Nora Dannehy, the Acting U.S. Attorney for Connecticut who was selected by former Attorney General Michael Mukasey to lead the investigation. Dannehy has recently empaneled a federal grand jury to hear evidence in the matter.

Luskin told me that Rove had earlier not cooperated with the Inspector General and OPR probe into the firings because "it was not his call... it was not up to us decide." Luskin said that Rove was directed by the Bush White House counsel's office not to cooperate with the Inspector General and OPR.

Roves attorney should have said Mr. Rove will show up, however he will not cooperate with furthering the Congressional or Justice Dept. investigation.

Well, you know in court cases, the Court Reporter is there to take down the record. And then to prove perjury, that record is supposed to be transcribed. But for some reason in my divorce case in Austin, Texas the Court Reporter never got around to transcribing the record and the Judge never ordered her to do so. Yeah, something fishy was going on there. It's not nice to deny a natural born American citizen her rights. When are those Texans going to respect the rule of law?

It doesn't seem to say but as I read it, it doesn't mention if he'll be responding to the congressional subpoena does it?

Well, it was probably on his check list, but he forgot to do it. Sort of like forgeting to turn the gas off before going on vacation.

I bet Bush issued some sort of secret pardons that would only be revealed if someone were actually charged. Of course, the pardon would hopefully not be honored. While I would love to see Thomas, Scalia and Roberts claim that Bush has the power to issue double-secret pardons or argue that Bush retains executive immunity, even though there is no such thing, particularly when the matter pertains to official US business.

The US president has no privilege to keep secret his official business. While there is a secrets clause in the Constitution, it does not apply to criminal behavior or the Executive Branch. Rather, it is a tool of Congress, which can only be executed through legislation, and I am not aware of any statute that says the President may issue secret pardons.

If Rove suddenly cooperates, its because the Obama lawyers let him know that the new administration wasn't going to support his claims of executive privaledge going forward.

Rick Sanchez reported yesterday that Bush granted Rove 'Presidential Privilege in Perpetuity' before his time was up in office, without telling anyone. So armed with that, apparently, Rove doesn't have talk to anyone, anytime about the Bush Administration if he doesn't want to unless it's overturned by the Supreme Court. In essence it's lifetime immunity.

I saw that and I have a feeling that it would not hold up in court. Maybe Rove's lawyer told him he could try to go the Presidential Privilege route but the fee would be enough for Lufkin to build up his stash that he has lost in the stock market.

First of all, there is no presidential privilege, no matter what anyone tells you, when the matter at hand refers to official US business. The President has no privilege to conceal his public duties from the American public. End of sentence. Period. I will, of course, reconsider if anyone can cite specific constitutional language otherwise.

Second, any reporter who seriously parrots a Bush talking point like "granting Rove presidential privilege in perpetuity" is either a nincompoop or not a reporter.

Third, there is no presidential privilege for a communication with a US employee. Why? Because that is official US business, and the public has the right to know everything a US official does in the performance of his official duties. Granted, there was a period time that Rove was not a US employee - I think he had to go due to some skullduggery - but Bush still wouldn't be entitled to claim privilege because Rove's lay status would eviscerate any claim of privilege.

I know that some may contend that there is a body of law that recognizes Executive immunity; however, I happen to fundamentally reject the idea that a US president has any privilege to keep secret any aspect of his official duties, except for the narrowest of possible circumstances. For example, Bush seeking private counsel to discuss his criminal conduct, etc.

Of course every word that comes out of Rove's mouth is a lie. And if the Courts ask him to testify under oath, the little turd will always resort to Executive immunity.

In some ways this doesn't make sense. I agree with tyree. The crimes Bush committed are far more serious and there are rationalizations that are going on in the current administration that seem to be PROTECTING Bush.

Saying that Rove will cooperate with Conyers is like believing that Rove cooperated with Patrick Fitzgerald. I never did understand why Rove wasn't charged with disclosing the name of a covert agent, but that's because the handsome face of Patrick Fitzgerald hoodwinked the nation. He (Fitzgerald) was never anything but cover for Bushco.

If he "cooperates" its because the fix is already in.
