Where do they find these guys?

The Hill reported yesterday that South Dakota state Rep. Joel Dykstra (R) has officially entered the race for the Republican nomination to face Sen. Tim Johnson (D) in 2008. And who's Joel Dykstra? The DSCC offers this tidbit of news:

"I think 'rape and incest' is a buzzword. It's a bit of a throwaway line and not everybody who says that really understands what that means. How are you going to define that?”  --South Dakota state Rep. Joel Dykstra (

R-Lincoln County) on why the state legislature didn't include those exceptions in its abortion ban, April 20, 2006.

And here I thought "macaca" moments were supposed to come during the campaign, not before the campaign even starts.

Honestly, where does the GOP find these guys?

Where do they find these guys?

Is that a rhetorical question? They are found everywhere. Without getting philosophical, it is the inherent nature of man to be evil and to succumb to their lesser demons. What makes man "civilized" is his capacity to elevate his thoughts of empathy for others, love and "right or wrong".

When you live by the "rules of the jungle", as these asshats do, and you are one of the "favored few" who by luck of birth, opportunity and sheer chance you BELIEVE that you are inherently BETTER than others, and that you have all the answers. When you start down that path, when you lose your sense of committment to community and the idea of a "greater good for all", you wind up mentally where morons like this wind up, and you wind up with the half baked society that we now live in.

How are you going to define that? Well, let's see. First, there's the obvious starting point of using the dictionary. Second, with regard to "defining" these categories, Rep. Dykstra could take a look at his state's criminal code for the current legal defitnition of what constitutes "Rape" and "Incest". Perhaps a visit to the law library would be in order to look at established legal conditions when considering their relation to a new bill being drawn up?

I find this relevant to the worthless Mr. Dykstra:

"Let them call me rebel and welcome, I feel no concern from it; but I should suffer the misery of devils, were I to make a whore of my soul by swearing allegiance to one whose character is that of a sottish, stupid, stubborn, worthless, brutish man. I conceive likewise a horrid idea in receiving mercy from a being, who at the last day shall be shrieking to the rocks and mountains to cover him, and fleeing with terror from the orphan, the widow, and the slain of America." (Also the raped and sodomized....)

You know, there's nothing wrong with us. Our bullshit detectors work just fine. The problem is that there is so much bullshit out there. And when 27% - almost one out of every three - of us, is still eating that shit and saying how great it tastes, it can be hard sometimes to believe just how evil and corrupt the shit sellers are, and always have been.

Wasn't the anti-abortion Bill this guy was promoting defeated by a decent popular margin? And doesn't that suggest that the Republicans are putting him up because they want to have someone on the ticket, even a guaranteed loser? No woman, and no man worth a nickel could vote for someone who suggests, as Dykstra does, that rape is only some sort of vague concept which, by implication, women use to cause trouble for men (maybe "real men"?). In Dykstra's world, "No," means "Yes", and "a woman can run faster with her skirts up then a man can with his pants down." (Guffaw, elbow your buddy, and order another beer.) South Dakotans are not, in the main, crude and ignorant -- as this guy is going to find out come election day.

Rape: Does anyone really want to have sex anyway? If they do, then how do you know they didn't want it? Or didn't enjoy it? Anyway, you shouldn't enjoy it.

Incest: We're all from Adam and Eve, therefore there's no such thing, except as stated in the old testament, which doesn't use the term and is citable for anything you want to justify. Anyway, without a DNA test, who knows whether the person with whom you're fornicating is really your sister?

I think I agree with you anon. I think even before the 'politically correct movement' people just had a sense of decency and balance that told them that rape and incest were a hell of a lot more than buzzwords, and you probably might want to keep it quiet if you disagreed. Right wing radio has done a lot to break down those barriers and now these folks feel that discussing the pros and cons of the results of rape is just part of an honest discussion. He has probably committed rape and incest so frequently that he thinks that it is the norm, and maybe it is in South Dakota. A little rape and incest? All in the family.

I think the reason that people cannot understand that a law that discriminates against half the population based on the fact that they have wombs is just plain unconstitutional, is that there is no issue to compare it to that men have.

You can be sure that if men bore offspring, abortion pills would be available in vending machines on every street corner.

Since this idiot senator can't understand rape and incest, I suggest he be fitted with a womb, allowed to experience these traumas, and give birth, so he can get some perspective.

wiattny's picture

It's more ironic than the previous posters have indicated. The definitions of rape and incest were written by the S.D. legislature. There's no need for a dictionary. Here's the definition of rape from the South Dakota statutes:

22-22-1. Rape defined--Degrees--Felony. Rape is an act of sexual penetration accomplished with any person under any of the following circumstances:

(1) If the victim is less than thirteen years of age; or

(2) Through the use of force, coercion, or threats of immediate and great bodily harm against the victim or other persons within the victim's presence, accompanied by apparent power of execution; or

(3) If the victim is incapable, because of physical or mental incapacity, of giving consent to such act; or

(4) If the victim is incapable of giving consent because of any intoxicating, narcotic, or anesthetic agent or hypnosis; or

(5) If the victim is thirteen years of age, but less than sixteen years of age, and the perpetrator is at least three years older than the victim.

A violation of subdivision (1) of this section is rape in the first degree, which is a Class C felony. A violation of subdivision (2) of this section is rape in the second degree which is a Class 1 felony. A violation of subdivision (3) or (4) of this section is rape in the third degree, which is a Class 2 felony. A violation of subdivision (5) of this section is rape in the fourth degree, which is a Class 3 felony. Notwithstanding § 23A-42-2 a charge brought pursuant to this section may be commenced at any time prior to the time the victim becomes age twenty-five or within seven years of the commission of the crime, whichever is longer.

rape [rayp]
n (plural rapes)
1. criminolog: forcing of somebody into sex: the crime of forcing somebody to have sex

Cryptic, indeed.

“I think ‘rape and incest’ is a buzzword. It’s a bit of a throwaway line and not everybody who says that really understands what that means. How are you going to define that?” –South Dakota state Rep. Joel Dykstra

....Well I guess to define it, I would start by looking at the clearly defined statutes in criminal law. I know, I know, it's not like anyone at the government level reads them, because they clearly only apply to people who don't have an "R" after their name, but you asked, and I'm just saying.
