Let's be clear and unvarnished...44 of our Senators hate the Constitution and basic civil rights. They do not believe in the fundamental right of due process. RestoreHabeas.org has the breakdown.
Absolutely unacceptable. With all the horrors that we hear about Hamdan, about suicides, about innocent people rounded up for bounties and left to rot in Guantanamo and Abu Ghraib, it is absolutely immoral that 44 senators feel that entrusting basic civil rights of any person to the Bush administration is the way to go.
Senator Dodd has not given up the fight:
"America's moral standing, and with it the security of the United States, suffered another setback today, atop a pile of setbacks that has accumulated over the past six years. The outcome of this vote is both symbolic and tragic. Each of us in the Senate faced a decision either to cast a vote in favor of helping to restore America's reputation in the world, or to help dig deeper the hole of utter disrespect for the rule of law that the Bush Administration has created. Unfortunately, too many of my colleagues chose the latter, and my disappointment runs deep. But I will not rest my case with this vote. Instead, this defeat will only deepen my resolve to restore the rule of law and with it American security, for far too much is at stake - for every American - to simply give up the fight."

Does anyone remember what the breakdown vote was to rescind Habeas? So much crap flies every single day, I can't keep track. So the Dems can't get it back, which one of them voted to give it up in the first place? I'm with Dave in PA, add to that most of my family as well. Torches and Pitchforks to the gates. I see no other way at this point.
The GOP platform for the next election must now include a statement invalidating the Bill of Rights. Because that's exactly what this breakdown says.

Are these Republicans so short-sighted that they don't see how this will play out in the long term, will hurt America and diminish the high moral standing we have enjoyed in the eyes of the world for at least the past 100 years? Once their ultra-conservative "base" is SATISFIED with their nominee for president... THEN the politicians in the party will start running for doors... and start voting with the Democrats... SO THEY CAN PROTECT THEIR CHANCES OF SUCCESS IN THE GENERAL ELECTION.
Me and my horse... we BOTH think this passes the SMELL TEST... and it stinks to high heaven. They will let as many troops AS NECESSARY die in Iraq just so they can get past their convention unscathed in the eyes of the religious right... and get another chance for re-election by FLIP-FLOPPING as much as they have to to win tight races at home.

Chris Dodd talks about the Constitution regularly. Russ Feingold talks about the Constitution regularly. Dennis Kucinich talks about the Constitution regularly. Howard Dean talks about the Constitution regularly. And even Arlen Specter talks about the Constitution regularly.
Others do to. Paul is not the only one. Moreover, Paul does get coverage on C&L when he defends the Constitution. He's praised for it. And there are also people here who point out the myriad disagreements they have with Paul.
I point this out as a regular advocate for libertarians and progressives to work together, not a knee-jerk anti-Paul poster. Though I do have plenty of problems with Paul's interpretation of the Constitution, and think he is wrong more than I think he is correct.
Time to strip them of legislative immunity. They've abused it.
The public faces the threat of detention and searches without warrants. No reason to recognize Members of Congress' "right" to be above the law.
Throw them in jail. Then deny them Habeas. Then they might change their mind. Gear up for some grand jury indictments, and detentions without chance to appear before any court.

Congress never had any constitutional authority to suspend the writ of habeas corpus to begin with. Article I, Section 9 of the Constitution permits such action only in the event of foreign invasion or armed insurrection. Every single one of these sons of bitches who voted for the Military Commissions Act or who has just voted not to restore the writ has broken the oath of allegiance to serve, protect and defend the constitution. Any such a person is no patriot and is unfit to serve in any office of public trust.

The Senate just rejected the restoration of habeas corpus. 43 Senators voted against the Constitution. 43 rejected a doctrine that predates our late, lamented republic by at least a century.
To be fair, no Democrat voted the wrong way. (Joe Lieberman voted the wrong way, but he isn't even a DINO anymore.) But they have gone along with a complete re-writing of the rules of the road. If the majority needs 60 votes to get its way in the Senate, then how on earth did the Republicans get their way these last few years? They never had 60 seats. No, the Dems are now culpable, too. They allowed FISA to be gutted. They allow Iraq to fester. They surrendered the big game without firing a shot.
Here's my metaphor for the day:
The Constitution stood, bound and blindfolded, before Bush's firing squad. The call to the Democratic cavalry went out. And, lo, the cavalry rode in, at the very last minute... and shot the prisoner themselves.
I used to take the Constitution for granted, and I argued that the Bill of Rights was what really mattered, and what was most endangered. I was wrong, and it is all gone now.
I have always had some sympathy for for the libertarian viewpoint, but felt it was a viewpoint without a meaningful constituency. Now our very founding principles fall into that same category -- hardly anybody who matters gives a damn about the real intent of the framers anymore.

I keep suggesting that whenever a wingnut makes a physical threat in public against a person or specific group (which must happen at least once a week), that we should take steps to register their name on the No Fly List. According to the Patriot Act, such threats will land you on that list, and once one of them finds out that they got there, believe me, they'll be screaming to repeal the Patriot Act.

Habeus Corpus is a right guaranteed to US citizens by the US Constitution. It is not applicable to Syrians, Saudis, Iraqis or Iranians shooting at US troops and blowing up Iraqi civilians in Iraq. Congress made the right choice in rejecting that nonsense.

The issue isn't citizenship, but whether justice is or isn't done. Justice demands that those detained by the US government have a chance to challenge their detention, especially when that detention is based on false evidence.
In some cases, the prisoners were not engaged in any combat, and were incorrectly identified as combatants by disgruntled people. Example: A Pakistani farmer with a grudge against a young man over a farming issue used a false charge to have this young man taken away. The US cannot wage a "war of civiilation" when that civilization proves to be barbaric, and blind-deaf to justice and evidence. The Holocaust started because there was no perceived consequence for injustice. We must remember, or we are not better than those we supposedly are "fighting".
This has a false premise: That Habeas is "guaranteed". No, it is the opposite: It cannot be denied, unless there has been an invasion or rebellion. Their have occurred.

Time for the DNC -- if it is serious -- to shut down funding to enforce the illegal changes. DNC Chairs can zero-out funding, but they refuse. Bills cannot leave committee unless the DNC agrees.
If the DNC Chairs in both the Senate and House agree -- before debate and a vote -- to same langauge, no conference committee is needed: Thus, there is no threat that the GOP can "block" a conference committee with a filibuster threat.
The DNC has the power to end this illegal activity, but refuses. Please contact your friends, let's get the evidence organized, and get the state-level grand juries empaneled to prosecute Members of Congress at the State level for denying the states of an enforcement mechanism: Something the US Government is required to enforce and gurantee to the states.

It's already started. The issue is when the citizens of the states realize that they can lead an effort to prosecute Members of Congress, and have them jailed for violating their oath of office, 5 USC 3331. Legal counsel can also be prosecuted for implementing unlawful war crimes policies.
All agreements to "agree not to enforce the laws of war" are illegal. Geneva requires that the laws afforded to local citizens and the military be afforded to prisoners of war. When the US denies prisoners -- who allege they are being detained for illegal reasons -- the same rights that Geneva says must be provided to POWs, then that is a subsequent war crime.
Refusing to afford POWs the right to challenge the detention -- something that US troops are able to do under the UCMJ -- means Congress is passing unlawful legislation that endorses war crimes.
Before a war crimes tribunal the question on policy makers will be: Did they reasonably act; or were they abusing their legislative immunity. A war crimes tribunal may conclude that Members of Congress recklessly ignored their oath, did not pass reasonable legislation, and permitted war crimes despite their duty to investigate and end the illegal practices.
At this juncture, the question is whether the US citizenry, infused with this barbaric abuse of power by this US Government, will peacefully work with state-level legal counsel in the Attorney General's office to prosecute Members of Congress and investigate-disbar legal counsel hoping to implement illegal agreements to immunize offending US government officials and legal counsel. all agreements to immunize anyone for war crimes are not enforceable. No reasonable Member of Congress would support denying any POW rights which Geneva says must be granted to POWs.
The issue going forward: If the US will not lawfully comply with Geneva through internal measures, legislation, and the courts, what alternative does the world have to ensure the US fully complies with Geneva? The US and world community in WWII after it was attacked at Pearl Harbor was left with no other option but to use combat forces.
The laws of war permit reciprocity: The right of other nations to commit the same violations in response to another nations refusal to respect a law of war. If the Congress will not enforce Geneva, then other nations are permitted to commit like abuses against similarly situated prisoners: Denying all people -- on accusation alone, regardless their combatant status -- of having any rights to appeal their detention before a court.
No reasonable Member of Congress would vote to continue depriving enemy POWs rights which Geneva says must be granted: The same rights afforded to US troops under the UCMJ -- the right to challenge the evidence and charges.

The constitution is still there: It is the standard. The oath requires enforcing Geneva -- it is a treaty requirement. Congress has no power to unilaterally abrogate it. US Congress' action is evidence of subsequent war crimes.
The laws of war are a check on this Congress. No Longer a Domestic Issue
This vote has world-wide implications. The world leaders see Congress will not voluntarily comply with Geneva. There are two options for Americans: Lawful consequences with prosecutions, and voting them out of office; however, world leaders have another option besides sanctions and legal challenges -- they may lawfully engage in combat.
War Crimes Issue
Geneva requires all trial procedures afforded to the detaining power be afforded to POWs. Under the Uniformed Code of Military Justice, US military personnel do have the right to challenge charges against them. Geneva requires the same trial procedures be afforded to the POWs.
Despite the 2006 vote for 'change", the war crimes continue. Members of Congress need to be prosecuted for failing to ensure Geneva obligations are enforced.
Violation of Separation of Powers
Congress, in refusing to accept that Habeas was never lawfully denied, has engaged in unlawful Judicial Oversight -- it is trumping the courts, and saying that the Courts may not ensure that Geneva obligations shall be recognized. This is a violation of the Separation of Powers. The net result of this illegal assertion of non-delegated powers are subsequent war crimes. Congress, through this inaction, intends this outcome. This is illegal.

I hear you on the concern with the DNC. The problem is that the DNC does not need a "super majority" in the Senate to do anything. That is fiction. Let me explain.
1. DNC Chairs Control the budgets
The DNC, not the GOP, sets the agenda. The DNC Chairs can zero-out funding. They can strip the President of any funds used to violate Habeas; and expressly include languge that prohibits the President from abrogating Geneva. They refuse to do this.
2. DNC in House and Senate Can agree to Common Language
One argument is that the GOP can "block the DNC" because of the Senate Conference Committee. A conference committee is only required to reconcile a bill. Yet, if the Senate and House agree in advance to the same language, the GOP is not in any position to block what is not needed.
I appreciate the concern that "nothing" is being done. The issue isn't that the DNC is "stuck"; the issue is the DNC is making excuses to support war crimes. The DNC and GOP are the domestic enemy. As are their legal counsel. They need to be prosecuted. They refuse to use all lawful options -- zeroing out funds, engaging in creative problem solving -- and are arguably not meeting their 5 USC 3331 obligations: The requirement to enforce the Constitution and laws of war without any mental reservation. Refusing to use all options on the table is evidence of having a mental reservation, and argubly sufficient evidence for 5 USC 3331 conviction.
Remedies
It's actually quite simple to solve this problem. Reconsider the Declaration of Independence and Magna Carta for the Moment: Each was a list of grievances, and an outline for a solution. Today, the easy part are the many list of abuses. It doesn't take much to imagine a system that addresses these abuses:
- Denying Members of Congress immunity in specific cases, and compelling action
- Increasing the State citizen awareness of their power to prosecute Members of Congress and disbar legal counsel
- Creating an independent system to investigate -- outside Congress and the Executive Branch -- issues of war crimes, malfeasance, illegal warfare, and Geneva violations
I encourage you to not throw up your hands, but do the opposite: attempt to work with your friends to clearly identify the recurring problems; then discuss a lawful solution to the problem. Use the model of the Declaration of Independence and Magna Carta as a guide: A list of abuses can be solved with a list of solutions. It can be done. Best wishes.

Thing is, I ain't quiting dispite how depressing it all appears right now, and neither are a lot of the posters here who are in the know... But without the other 60 or 70 million citizens waking up... The ones who sat it all out completely, or thought voting republican was a good idea in 2000, and 'especially those' who voted that way in 2004 in spite of everything we all knew by then.. Not sure anything short of a second civil war is going to put a stop to this madness... Not even sure that would work... What's most disturbing isn't that the vote failed. Quite frankly, the numbers just weren't there, and Republicans are pretty goddamn stubborn.
The real disturbing part is that despite the Dems finally voting lockstep in the best interest of our country, the liberal base can't seem to be happy with it.
This is a really tough situation dems are in, and this just isn't helping. There's no 60-vote super majority.
