Clarence Thomas is suddenly upset that people have the audacity to criticize the Supreme Court. As long as conservatives attack the bench it's quite alright, but Clarice can't handle it critiques when they come from the left.

Questioning the Supreme Court and other government branches needs to stay within the range of fair criticism or "run the risk in our society of undermining institutions that we need to preserve our liberties," Justice Clarence Thomas said Thursday.

Thomas also told an audience at the University of Florida law school that some comments he hears about the court "border on being irresponsible."

He didn't speak specifically about the court's recent decision on campaign financing or mention President Barack Obama. But Thomas' comments come a week after Obama took the rare step of openly criticizing the decision during his State of the Union speech.

Thomas supported the 5-4 ruling that allows companies and unions to spend freely on ads that promote or target candidates by name.

Thomas said the court should be questioned but is bothered by some rhetoric with "the idea of assigning ulterior motives to opinions that people don't agree with, rather than saying simply that the court doesn't agree with my argument."

When Tom Delay, John Cornyn, James Dobson, Jerry Falwell and Pat Robertson declare open warfare against the activist Supreme Court, Thomas stays mute. Kinda like his behavior on the court except when he acts like an activist.

Did Clarence Thomas really say those things, or was he perched atop Scalia's knee while Scalia appeared to drink a glass of water?

He can talk? I thought he was just a dummy taking up space on the court and having his voice given to him by Scalia. Well damn, I learn something just about every day. Oh, I guess he's heard of free speech, right?

Thomas makes no pretense about listening to arguments. His mind is made up before the case gets there in every instance. This isn't because he's well prepared, it's because he's driven by ideology rather than the law and precedent and he's not subtle enough to even go through the motions.

I just want to say, in no particular context to this discussion, that Conservatives tend to fall into two groups. Those who see politics as nothing more than rooting for their home team. A meaningless sport with no consequences. And those who figure they can make a buck off the first group somehow.

Only when the last tree has died
and the last river has been poisoned and the last fish has been caught
will we realize we cannot eat money.

If that's true, maybe he can point out exactly where in the Constitution or Bill of Rights the word "Corporation" is mentioned.

Then, after he admits that word does not appear in either document, he can explain his reasoning for giving them the rights of human beings.

He's no different from Scalia, Roberts, or Alito. They were confirmed after saying they were strict Constitutionalists, but inject conservative ideology into every decision, regardless of what it says.

This court is another legacy of the Bush administration. Big business runs all three branches of the federal government.

We liberals are supposed to be on the side of feminism. Liberal men are supposed to be sensitive to issues of demonization and discrimination. Liberals are not supposed to engage in sexist this crap. Would we use racist stereotypes (say, bug-eyed and rubber-lipped cartoons from the 1920s) to poke at Thomas? Of course not. Would we take shots at him by calling him gay? No. So why is gynophobic name calling acceptable? Acting like the worst, bigoted conservative thugs is not acceptable. If liberals are pro-feminism and anti-discrimination, we should act that way, dammit.

NOBODY is immune from public outrage, most especially the "most prestigious institution in Washington" as George Will calls them.

The public should and will hold people like Clarence Thomas to a higher standard. Do you get it, Justice?

It wasn't criticism that hurt the public's opinion of the court. It was your activism in giving us Bush vs. Gore, electing a president. It is you who is making a mockery of tenure by practically sleeping in court. You were a disgrace before your confirmation. Anita Hill's testimony was the biggest joke at my high school. Who doesn't remember the pubic hair and coke? Before I even understood politics I knew about you and what you were.

When people like Rush Limbaugh or Glenn Beck or O'Reilly make statements such as this, I generally am annoyed. But they are hacks. No credibility, just a big mouth with millions of GOP dollars behind it.

But Clarence Thomas is giving them the power of his supposed prestige. A man who has personally done much damage to America in a few key, activist decisions, derives more than annoyance from my heart today.

I am offended and outraged that this man has the power he does. You would do well to sit back against your chair and keep your mouth shut permanently, Justice Thomas.

This man is a disgrace to all the Blacks, encluding those in his family, who have died, been lynched, maligned, followed in stores, accused of driving while black, marched, cried, gone without, sacrificed, spat on, beaten, harrassed, intimidated, incarcerated...

The only way this man can redeem himself even slightly is for him to retire from the Court and give Obama the opportunity to select his replacement.

As Thurgood Marshall said, "A black snake will bite just as quick as a white snake."

What a legacy for thomas to leave behind.

Clarence, BTW, married racist Rush Limbaugh and his last wife. They are now of course divorced. But it was in the cards as they maintained separate residences throughout the marriage.

Faux Heterosexuality is so "Moral" you know.

..to awaken Justice Thomas?

If it were possible (and Alito & Scalia weren't better fits for the action) I'd recommend a Misconduct Hearing in Congress regarding Thomas, with a view toward removal for non-participation....per Article III Section 1 of the Constitution...

is that Clarence Thomas says he has been protecting liberty!

"Questioning the Supreme Court runs 'the risk in our society of undermining institutions that we need to preserve our liberties,' Justice Clarence Thomas said Thursday."

I would be fascinated to read an opinion wherein Thomas preserved liberty, and please don't cite Bush v. Gore. I defy Thomas to name one opinion that he joined, or better yet penned, wherein liberty was preserved.

I just though I'd point out that Thomas has now said more in a "60 Minutes" interview than he has from the bench during questioning in the last SIX YEARS.

Donna Edwards' No Corporate Monopoly of Elections Amendment

Maryland Congresswoman Donna Edwards turned to Supreme Court Justice Louis Brandeis for guidance in framing the Constitutional amendment she proposed Tuesday as the right and necessary response to the decision by Chief Justice John Roberts and a high court majority to abandon law and precedent with the purpose of permitting corporations to dominate the political discourse.
..

JOINT RESOLUTION
Resolved by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each House concurring therein), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as part of the Constitution when ratified by the legislatures of three-fourths of the several States within seven years after the date of its submission for ratification:

ARTICLE--

SECTION 1. The sovereign right of the people to govern being essential to a free democracy, Congress and the States may regulate the expenditure of funds for political speech by any corporation, limited liability company, or other corporate entity.

SECTION 2. Nothing contained in this Article shall be construed to abridge the freedom of the press.

Man I hate these rightwing idiots no matter what color they are!
republicanism/conservatism is a mental illness!

Thomas has a difficult time maintaining a professional facade. He never had the stuff it takes to be in the position he is in so he compensates for it by acting and using a fake persona. To rational people he is already unmasked however he is unable to see this himself. He must maintain this lie at all costs. Should he finally be forced to face himself the result would be a demented rage. How does one own up to being a failure and a total fake.

"Clarence Thomas upset because of criticisms on the Citizens United case comes from the left". Come on, C & L are we now purposefully misleading?

The United States aspires to democracy, but no true democracy is attainable when the process is determined by economic power.

Everytime I see the crybaby asshole I think of his pubic hair on a coke can. He is a disgusting human being.

What a sad little man he is. He may be able to read law, but he really can't understand it. If Papa Bush hadn't needed an African-American conservative when Thurgood Marshall retired, Thomas would (maybe) be on an federal appeals or state supreme court; it was affirmative action on a grand scale. Everything is his past says he is a frightened, insecure man who follows the powerful and bullies those he considers beneath him.

As obnoxious as Scalia can be, he has the courage of his convictions and a sense of humor.

NOBODY 2012

FreeDUMB's picture

Does it say a corporation is a "person"? What are these idiots congenitally stupid? Ulterior motive or no ulterior motive, it looks stupid and that is the signature of the modern day right wing.

...in the Santa Clara County vs. Southern Pacific Railroad case there was an obiter dictum statement by the Chief Justice of the SCOTUS, Morrison Waite, added in the headnotes by the court reporter:

"The court does not wish to hear argument on the question whether the provision in the Fourteenth Amendment to the Constitution, which forbids a State to deny to any person within its jurisdiction the equal protection of the laws, applies to these corporations. We are all of the opinion that it does."

The goofy thing about judicial review is that jurists aren't necessarily strictly bound to either the particular wording of the Constitution itself or precedent when ruling. The SCOTUS, after all, is implied to be charged with interpreting the Constitution when determining if legislation is constitutional or not (See: Constitution of the United States of America, Articles III and VI; Marbury vs. Madison) .

Justice Thomas said: Questioning the Supreme Court and other government branches needs to stay within the range of fair criticism or "run the risk in our society of undermining institutions that we need to preserve our liberties,"

Justice john Paul Stevens's dissent to the Citizens United decision is much more damning of the majority than anything anyone else has said in the case's aftermath. Indeed, that dissent undoubtedly informed President Obama's decision to call the court out in the State of the Union address. Seek the dissent out and read it. Stare decisis is the judicial concept of respecting previous decisions--the very basis of legal precedent. Justice Stevens's dissent contains the following sentence which--I think--sums up the radical nature of the court's finding in Citizens United:

...[The] ruling...strikes at the vitals of stare decisis, “the means by which we ensure that the law will not merely change erratically, but will develop in a principled and intelligible fashion” that “permits society to presume that bedrock principles are founded in the law rather than in the proclivities of individuals.”

Justice Roberts and his cohorts have gone from interpreters of the law to legislators, and there's no remedy short of a constitutional amendment to stop the harm they've done. No law is safe from these people. None. Thomas should either find a more scalding criticism than the one from his fellow justice or shut the *bleep* up.
