Lou Dobbs and the Birthers: Stefan Cook's orders were rescinded by the military

Lou Dobbs ran the story of US reservist Stefan Cook, who refused to go to Afghanistan because he says President Obama isn't a US citizen. Notice how Dobbs framed the beginning of the story: He says new questions are being raised about Obama's citizenship. Really, Lou? They aren't new questions, they are the same Birther garbage being peddled by the same Birther Queen Bees since well before the election.
We have a Birther in our midst.
U.S. Army Maj. Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go. Barack Obama was never eligible to be president because he wasn’t born in the United States.
Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client.
In the 20-page document filed July 8 with the U.S. District Court for the Middle District of Georgia the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.
Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”
Cook, a reservist, received the orders mobilizing him to active duty on June 9.

He didn't just sign up for the military 5 months after the inauguration - he's been a reservist for quite some time. The timeline - based on what I've been reading - is:
* In February, Cook posted on Free Republic that he was now a plaintiff in a class action suit Taitz was pursuing on behalf of military officers because of Obama's "illegitimacy."
* In May, Cook volunteered to deploy to Afghanistan. Reservists who volunteer for deployment have the right to rescind their request at any time for any reason, right up until the day they they are to get on the plane. This is something Cook would certainly have been well aware of - meaning he knew at the time he volunteered, he knew he could get out of it just by asking.
* In July, he files his suit requesting that his deployment orders be rescinded and that he be granted status as a conscientious objector due to his belief that Obama is not legitimately the President.
* Within a day of the suit being filed, the Army rescinded his orders. Taitz claims that this is proof that Obama is not the legitimate President and that the military knows he's not and thus won't even try to fight the suit. This, of course, is complete bull since Cook only had to ask to have his deployment canceled, and the Army apparently considered his suit to be his "asking" and when the leadership of the unit he was supposed to deploy to heard about the suit, they said they didn't want him anymore.
* The DOD notified the defense contractor that he was working for and said they don't want him working on their stuff anymore, and the company he was working at was unable to locate a non-DOD position for him, so he lost his job. (Awwwwww.....)
* The military files a motion asking that the suit be dismissed since the guy wanted to get out of his deployment - and now he's not being deployed - so no trial is needed for him to get the "relief" he was suing for. Taitz gets two retired soldiers (A 2-star General and a Lt. Col. in the Air Force) to join her suit and says she wants to go forward with it because of Cook's loss of employment and because people are saying that he manipulated the situation for political purposes.
* This morning, the Judge dismisses the suit.

I love how she's trying to object to people saying the guy manipulated the situation for political purposes. It's pretty obvious that's exactly what happened. He was already protesting Obama's presidency when he "volunteered" for deployment, and he "volunteered" knowing he wasn't going to have to go.
I dunno who's bright idea this was, but they sure didn't think it through very well. Even if the judge had agreed to hear the case, I would think that the fact that it could be demonstrated he already was protesting Obama's legitimacy *prior* to "volunteering" would cause some serious damage to any case he might present.

I have trouble believing a court will allow individual soldiers the right to determine whose commands they'll follow and whose they won't.
I would think that the issue of Obama's suitability for office would be moot in this case by the simple fact that the FEC accepted his nomination and the congress certified him as the president. Come 1/20/09 it should be irrelevant what the soldier believes, he is now legally bound to follow Obama's military orders.

They do have the right to question what they believe are illegal orders, but not in civil court. They have to go through the military courts and they have to prove that orders they received were in violation of the UCMJ.
There are a couple of ironies here:
1. Cook was in violation of the UCMJ when he filed suit in a civilian court. Several violations, in fact, including conduct unbecoming, that could get him jail time, a dishonorable discharge and loss of all benefits.
2. What they are essentially attempting to do is invalidate Obama's presidency - in a lower court. But Obama was sworn in and affirmed as president by the Chief Justice of the Supreme Court. An act which has the effect of law, since it made Obama the legal president, with all that goes with that.
How can a lower court invalidate or overturn the Supreme Court?It can't.
So, Cook and the Queen Bee have brought a case to a court which has no jurisdiction to hear it in the first place, and in the second place, they brought a case over a matter which has already been settled by the highest, and final, court in the land.
And this is why Chief Justice Roberts and President Obama redid the oath after Roberts screwed up the first time - exactly because of idiots like this, who would have been running around screeching about the oath too.
It will be interesting to see what the court does.

The only room regarding choice, is wether soldiers can refuse to carry out immoral/illegal orders as defined by the military and the multiple international treaties of which we are members. As in the famous "I was following orders" Nuremberg outcome.
A soldier can question the legality of an order, but through military channels, not civilian. There is NO civilian recourse for military personnel.
The military is no summer camp, you give up your rights when you join. There is no free speech, right to assemble, right to bear arms, none of that. Lots of military exercise those rights regularly, but only because they have not received a direct order not to. But the military always has the option to issue such orders and the soldiers must obey or face charges.
It's amazing that they're reduced to rehashing conspiracy theories that were totally debunked months and months ago. How any rational person could possibly support the Republican party at this point is beyond me. Sean Hannity has also been all over this "birther" (lol what a name) nonsense.

Has “Dr.” Taitz violated this rule? Does her appearance before the Supreme Court, in filing documents for the frivolous, since-dismissed case Lightfoot v. Bowen, therefore subject her to discipline?

It seems there's some questions about her validity as an attorney with the American Bar assc.
California does not require a degree from a law school to sit for the bar. Law school used to be optional nationwide.
From my professional responsibility class notes:
In California, Vermont, Virginia, and Washington, applicant may take the bar exam after study under a judge or practicing attorney for an extended period of time. This method is known as "reading the law".
New York requires that applicants who are reading the law must have at least one year of law school study.
Maine allows students with two years of law school to apprentice instead of completing their third year.
All other states and the Feds require law school prior to sitting for the bar.

That's hilarious! A few years ago I was considering a career change, and wanted to puff my CV with a Juris Doctorate law degree. Obviously I didn't have the time or money to go to law school, so I did some research and found that there are actually two "law schools" in the U.S. that offer LAW DEGREES BY CORRESPONDENCE! William Howard Taft University is one of them.
When I looked at their requirments, I saw that it was pretty much a diploma mill, giving grades mostly on the PASS/FAIL system based on essays you'd write in response to assignments.
They also had two J.D. degree streams. One of which took only three years instead of four, and was intended to focus on business, rather than law, per se.

Apparently Cook orchestrated this, and never had any intention of serving in Afghanistan. Supposedly he REQUESTED active duty in Afghanistan in May, they processed his request, and then when his orders came through in June he refused to go citing this Birther nonsense.

this would have disqualified John McCain as well, since he was born in Panama. Besides, this is not what the US code (nor the constitution) requires (see below).

Why won't Obama release his long form birth certificate that shows the hospital and attending physician at his birth?
Because (1) The form he's released is the only form that Hawaii provides a copy of and (2) that particular form is the one accepted by every state, every agency of any state government and every agency of the US government accepts to determine an individual's citizenship status.
Think about this for a minute, ok? This issue was raised well before the election was held. At that time, President Bush was still in office. Do you HONESTLY think that if the FBI, the State Department or any other part of the government that's involved in determining if someone is qualified to be the president had ANY questions about Obama's legitimacy that they would NOT have done everything they possibly could to get him disqualified if they could?
They were certainly aware of the issue, and it was clear for a while before the election that the vote would be a close one. Do you REALLY think that if they could have thrown the Democrats into disarray by getting their nominee disqualified over his birth records that they would have passed up that chance? 1. Obama has released what the State of Hawaii has issued: his LEGAL certificate of birth.
2. The STATE, not Obama, does not release the original birth certificates, bcause that is what Hawaiian statutes require.
3. Obama has nothing to do with those statutes, he was a child when they were made law.
Now, tell me why you think Obama is under any obligation to do what no other candidate has been asked to do?
It isn't as if Obama refused to do something that all the other candidates did, they ALL were checked out to make sure they met all the qualifications to run.
So, please explain: why are you implying that Obama either didn't do what the other candidates did, or somehow managed to hide his refusal to provide what all the other candidates provided from everyone except the few ever-vigilant Freeper nuts who are trying to make something out of this?
And, I'm curious, do you think Obama got into the Senate and onto Senate committees requiring security clearences without any one noticing that he either couldn't prove his citizenship or was refusing to provide a legal birth certificate?

If poor Orly would have called the Hawaiian hospitals herself and asked anyone there about relevant law, even the janitors, she would have learned that HIPAA bans the release of patient information. Notice at the beginning of the Orly Taitz video an older guy with white hair, white beard, who appears to have introduced Taitz. That appears to be one Philip Berg, another infamous birther. Berg is actually a Democrat who was a Hillary supporter. He's had a number of cases against Obama that actually made it to but were rejected by the Supreme Court.
Now, there is a spat between Berg and Taitz. Don't really know the whole story, yet, but somehow, Taitz published the name, address, and social security number of one of Berg's staffers, Lisa Liberi, in an effort to discredit her and I guess Berg. So Berg and Lisa Liberi are suing Taitz.
Let's hope these wackoes destroy each other in the process.
Liberi is a domestic abuse survivor whose personal information was released, potentially allowing her abuser to locate her.

What I'm wondering is whether the Democrats IN CONGRESS asking about John McCain's birth certificate (released), his school records (released), his Naval service records (released), his Naval Academy records (released), his Senatorial records (released), and his medical records (released) are also classified as "insane" for having requested those............
McCain released VOLUMES of information regarding the above-REQUIRED items to the Congressional Democrats demanding them to establish HIS "eligibility" to run for President........
