Last week after the last Presidential debate the MSM and the progressive blogosphere were consumed with "Joe the Plumber". Amy Goodman at Democracy Now was one of the only media outlets who focused on the protest and arrest outside of the debate. This protest was made up of civilians and a group of Iraq Vets Against the War. Some of these protesters were trampled by officers on horseback. One of these Vets Nick Morgan was seriously injured. I hope the so called progressive blogosphere gives this protest, arrest and injuries some main stage attention.

An update on Nick's condition

Message from Nick Morgan

I would like to say that I am overwhelmed by the amount of support that I have received since October 15th. In particular, I would like to thank my brothers and sisters in IVAW who have been aiding me in my recovery here in Philadelphia as well as Chantelle, Larry, Geoff, and Robby who came up from DC to visit. Although it physically hurts to laugh, I have been doing a lot of it thanks to my IVAW family. My girlfriend, Liz, has been here every step of the way to make sure I am taking care of myself and I would not be well on my way to recovery if it were not for her compassion and strength. I also owe a great deal of gratitude to all those who have emailed and called with messages offering support in any way possible. To everyone, stand strong and let’s make sure that justice is served. To all veterans and GIs; let’s make sure that our voices are heard, let’s ensure that our brothers and sisters are getting the adequate care and RESPECT that we deserve for putting our lives on the line for this country and our Constitution.

Here is an update on my physical condition for everyone I have not had a chance to speak to personally…

I have spent several hours at the VA in Philadelphia and will be having surgery on Thursday, Oct. 23rd [today] to stop my eye from sinking into my sinus cavity. The lower orbital (cheekbone) on the right side of my face is broken in three places. My nose may be fractured but will heal by itself since it is not out of place. I also have scrapes, bruises, and significant pain in my ribs (the x-rays were negative).

Every day someone tells me how much better my face looks. The stitches are still in and look like they are ready to come out. The swelling has almost subsided but there is still a fair amount of blood around my eye. My vision is a little blurry sometimes but it should get better. I don’t have feeling in a portion of my upper lip, nose, and upper right set of teeth. The surgeons said the feeling might come back depending on what type of nerve damage occurred. It’s getting much easier to eat. I just have to make sure to stay away from crunchy things and to take small bites, as my mouth still won’t open completely. Sleeping isn’t exactly easy because I can only sleep on my back due to my injuries…but other than all that, life is good!

The surgery will be fairly straightforward (from what I can gather). They will go under my eyelid and possibly above my gums to insert a degradable reinforcement for my cheekbone. They will obviously be monitoring my eye closely for quite some time. I will do my best to keep everyone posted upon recovering from surgery. Again, thanks to everyone for your concern and support!

The MSM has, predictably, not touched this story, which to me is the most shameful of McCain's long life of shameful acts. Sydney Schanberg, the journalist of "The Killing Fields," has been on this story for years and has a great piece in this month's "The Nation."
If this story was publicized, it would sink McCain -- not just his campaign, but the man himself -- for good. What he did was horrifying. Unfortunately, Dems, including John Kerry, helped abandon these men, so the MSM and the government will never touch the story. Please read it and tell others.

What was the payoff?

the progressive blogsphere was as caught up in the Joe The Plumber hogwash as the MSM. I have been trying for over a week to get several blogs to make this a front stage issue. Finally got one of the bloggers over at Firedoglake (Laura flanders thread that is not well attended) to make this a front stage issue. Still trying to get bloggers to make it a front stage issue instead of Joe the Plumber etc.

I want to see the look on the face of dopey Joe when the landslide election is called for Obama at 8:30 p.m.; and see his reaction to the next U.S. Senate which will have 60+ REAL Democrats in it. Buh-bye Joe. Maybe CNN will hire you to take Beck's place as the resident GOP idiot-schill!

To see your expression when you realize that the next U.S. Congress (with 260+ democrats - how's that permanent repuke majority thing workin' out for ya'?)and a new Atty. Gen. (that is not going to put up with your "executive whatever bullshit anymore)," well, all I can say is you better get yourself a boatload of damn good lawyers, because even though it took years, we eventually got the previous group of republican criminals - and we ARE going to get you too!

is an excellent satirist and the only reason I don't regularly read his blog is because of its' irregular updates. Thanks for bringing his most recent post to my attention. People, this is worth a read and do not fail to follow his link back to Althouse's site which features a right wing law professor with only a passing knowledge of law. She apparently feels that actually quoting her statements is somehow libelous.

The Bush administration’s wiretapping program has come under new scrutiny this week. Two influential congressional committees have opened probes into allegations US intelligence spied on the phone calls of American military personnel, journalists and aid workers in Iraq. We speak to James Bamford about the NSA’s spying on Americans, the agency’s failings pre-9/11 and the ties between NSA and the nation’s telecommunications companies. [includes rush transcript]

JAMES BAMFORD: Yeah. There’s two major—or not major, they’re small companies, but they service the two major telecom companies. This company, Narus, which was founded in Israel and has large Israel connections, does the—basically the tapping of the communications on AT&T. And Verizon chose another company, ironically also founded in Israel and largely controlled by and developed by people in Israel called Verint.

So these two companies specialize in what’s known as mass surveillance. Their literature—I read this literature from Verint, for example—is supposed to only go to intelligence agencies and so forth, and it says, “We specialize in mass surveillance,” and that’s what they do. They put these mass surveillance equipment in these facilities. So you have AT&T, for example, that, you know, considers it’s their job to get messages from one person to another, not tapping into messages, and you get the NSA that says, we want, you know, copies of all this. So that’s where these companies come in. These companies act as the intermediary basically between the telecom companies and the NSA.

AMY GOODMAN: Now, Jim Bamford, take this a step further, because you say the founder and former CEO of one of these companies is now a fugitive from the United States somewhere in Africa?

JAMES BAMFORD: Well, you know, this is a company that the US government is getting all its tapped information from. It’s a company that Verizon uses as its tapping company, its eavesdropping company. And very little is known about these companies. Congress has never looked into any of this. I don’t know—I don’t think they even know that there is—that these companies exist. But the company that Verizon uses, Verint, the founder of the company, the former head of the company, is now a fugitive in—hiding out in Africa in the country of Namibia, because he’s wanted on a number of felony warrants for fraud and other charges. And then, two other top executives of the company, the general counsel and another top official of the parent company, have also pled guilty to these charges.

So, you know, you’ve got companies—these companies have foreign connections with potential ties to foreign intelligence agencies, and you have problems of credibility, problems of honesty and all that. And these companies—through these two companies pass probably 80 percent or more of all US communications at one point or another. And it’s even—gets even worse in the fact that these companies also supply their equipment all around the world to other countries, to countries that don’t have a lot of respect for individual rights—Vietnam, China, Libya, other countries like that. And so, these countries use this equipment to filter out dissident communications and people trying to protest the government. It gives them the ability to eavesdrop on communications and monitor dissident email communications. And as a result of that, people are put in jail, and so forth."

MEMORANDUM OPINION
In this Espionage Act prosecution, defendants Steven Rosen and Keith Weissman have
been charged in Count I of a superseding indictment with conspiring to transmit information
relating to the national defense to those not entitled to receive it, in violation of 18 U.S.C.
1
§ 793(g). Defendants, by pretrial motion, attack the constitutionality of § 793 in three ways.
First, they argue that the statute, as-applied to them, is unconstitutionally vague in violation of
the Due Process Clause of the Fifth Amendment. Second, they argue that the statute, as-applied
to them, abridges their First Amendment right to free speech and their First Amendment right to
petition the government. Third, defendants assert the First Amendment rights of others by
attacking the statute as facially overbroad. In the alternative, defendants urge the Court to avoid
these constitutional issues by interpreting the statute as applying only to the transmission of
tangible items, i.e., documents, tapes, discs, maps and the like.
In addition, defendant Rosen has been charged in Count III of the superseding indictment
with aiding and abetting the transmission of information relating to the national defense to one
