Picture this: You've recently been through exhausting rounds of chemotherapy and radiation, you've been puking your guts up and your doctor warns you this is a particularly malignant cancer.

Then you find out through some miracle (or bizarre irony) that you're pregnant.

Your doctor warns you the chemo and radiation has put the fetus at risk. She also says the pregnancy could make it harder to effectively treat the cancer. You have a hard decision ahead of you.

Hah hah, only kidding! That decision's already been made for you:

Women's health and rights advocacy groups responded immediately to yesterday's announcement that President Obama would exclude abortion coverage from the Pre-Existing Condition Insurance Plan (the temporary high-risk insurance pools created by the Patient Protection and Affordable Care Act to transition us into the new health care plan). Obama has decided that women in these pools simply don't need insurance coverage of abortion care even though there is nothing in the new law that dictates this.From the ACLU press release on this:

Even using their own private funds, individuals would not be able to buy policies that cover abortion in these pools. The only exemptions would reportedly be for women who have been raped, who are the victims of incest or who will likely die if they carry the pregnancy to term.

What is perhaps most perplexing about this is that this plan was created to offer temporary insurance coverage to those who cannot afford coverage due to particulary serious health conditions. Women with serious health conditions may be some of the most affected by a pregnancy - the pregnancy may not cause her death but is a woman's life of so little consequence that it matters not to President Obama if a pregnancy bears an immense burden on her already ill body? As NARAL Pro-Choice America's Nancy Keenan puts it, "This policy means that women who are part of these pools because they have significant health problems, such as diabetes or cancer, will not be able to access abortion care, even if their health is at further risk."

Planned Parenthood's press release calls the rule "harmful to women":

“The very women who need to purchase private health insurance in the new high-risk pools are likely to be more vulnerable to medically complicated pregnancies. It is truly harmful to these women that the administration may impose limits on how they use their own private dollars, limiting their health care options at a time when they need them most. This decision has no basis in the law and flies in the face of the intent of the high-risk pools that were meant to meet the medical needs of some of the most vulnerable women in this country."

The Center for Reproductive Rights notes:

"Contrary to assertions by the White House, there's no current legal basis for the policy. The executive order issued by the President on abortion only addressed rules for segregating funds for abortion coverage in the healthcare exchanges and limits on community health centers. The Federal Employee Health Benefit Plan policy similarly furnishes no legal basis for exclusions in the new high risk pools."The proposal would not even permit policyholders to use their own private dollars to purchase coverage, as the Nelson compromise allows, and instead applies a Stupak-type ban like the one rejected by Congress. Healthcare reform was a tightly bargained piece of legislation - and with this, the White House is threatening to renege on a fundamental part of its bargain with American women and families who truly need coverage. Excluding abortion coverage from the high-risk insurance pools was not part of the negotiations during healthcare reform, and nothing in the bill compels this result."

He can be very determined when it comes to the few things he cares about, e.g. - having a healthcare "reform" bill under his belt that doesn't reform anything but ensures his campaign coffers are filled by those for whom he sabotaged real reform for; ramping up offshore drilling to unprecedented levels, even in spite of the Gulf spill, so he can be sure his campaign coffers are filled by Big Oil cash; cutting secret deals with Big Pharma to kill drug re-importation - ensuring Americans keep paying through the nose for medicine - so that he can be sure that Big Pharma will help fill his campaign coffers; working behind the scenes to kill meaningful financial reform to ensure his campaign coffers are filled by Wall Street, and so on.

Two possible motivations (that are both probably wrong):

A. Obama is stupid enough to believe that this will be a net political benefit in 2010/2012 elections. There is no way that this move (if it is as advertised here) will gain him votes from anti-choice advocates. This move will cost him votes from pro-choice/pro-women/pro-health care people staying home.

B. Obama is concerned that the policies would otherwise be challenged in court and be blocked from implementation. Considering the Hyde amendment only covers annual appropriations to HHS, I don't see any merit to a potential case. And I don't think this move will discourage anyone from filing a lawsuit against the plans anyway.

Before the mid-terms. I'm just getting a little tired of how easily he gives up the base for his own protection.

decision Susie but I don't necessarily buy your argument either. Nothing Obama does is going to buy silence from the GOP on this or any other issue. Perhaps buying internal peace within the Democratic caucus is the reason but even that doesn't seem worth it given the number of Democrats involved.

No, actually it is hyperbole. However disappointing Obama is -- and he's plenty disappointing -- he's not the worst president ever. That honor still belongs, I believe, to GWB.

What Obama is truly is the most disappointing president ever. While I'm not quite as certain as you are of Obama's ability to "change the way we love " [ -- I assume you meant "live"], I'm certain he could have tried a lot harder. But fundamentally he's a fairly conservative politician. As for never voting for him again, I can definitely accept your decision about that. The "lesser evil" option has grown mighty old. The question that is worth answering is not "Is Obama better than (fill in any lunatic from the GOP)," but "does he deserve our votes?" The answer to the first is easy -- of course he's better than the lunatic the Republicans will nominate. The answer to the second is more difficult. I can understand it if people decide the answer is "No." The other question that might be worth considering is "Can we survive another Obama term?" I'm not sure we can survive another Republican without more permanent damage. However one answers any of these questions, I think it's fair to say "Barack, you suck."

Who gets to assess the threat to the life of this hypothetical woman. Is it the insurance pool operators or the woman's doctor? In these pools do woman have a choice of physician? It's a bad decision anyway but how bad hinges on questions like this. Who exactly is being placated by this ruling and why, from a political perspective would anyone bother? I frankly don't get the logic behind this decision.

This was rumored to be part of the compromise in the House of Representatives which got it passed. All right then, one tin foil hat compromise rumor confirmed! So placated would be the blue dogs (they get abortion restriction) and political cover for the progressive caucus which had been threatening to not vote for it if it had the restrictions. Progressives get to vote for it with no restriction, but Stupak can vote for it since presumably Rahm Emmanuel promised Obama would add it back in by executive order later. You can trust Rahm it seems.

On who decides, hopefully it is the doctor, but if pools are administered by the states, some may make it a judge's ruling. That might be pretty sad in some places.

WDDIM? Most women who are so poor they have to resort to "the pools" will not be able to afford that lousy, overpriced crap insurance anyway. As with so many other issues, they will just avoid the whole mess and pay cash at planned parenthood. This is more of last week's garbage sitting around.
