Six Names Leaked As Obama's SCOTUS Nominees

Guess we'll have to sit tight and wait a while longer to find out for sure. Who do you like from this list, and why?

WASHINGTON – President Barack Obama is considering a list of more than six contenders for the Supreme Court that is dominated by women and Hispanics, one that includes judges and leaders from own his administration who have never donned a judicial robe.

Among those under consideration are Solicitor General Elena Kagan, Michigan Gov. Jennifer Granholm, Homeland Security Secretary Janet Napolitano and U.S. Appeals Court judges Sonia Sotomayor and Diane Pamela Wood. California Supreme Court Justice Carlos Moreno is also under review by Obama.

Sources familiar with Obama's deliberations confirmed the names to The Associated Press on condition of anonymity because no candidates have been revealed by the White House. The confirmation amounts to the first time any name has been directly tied to Obama.

One official cautioned that Obama is considering other people who have not been publicly mentioned. And more names may be added as the administration considers a replacement for retiring Justice David Souter.

But there’s no dispute that on Feb. 4, 2003 — five months after Pelosi’s September meeting — CIA officials briefed Pelosi aide Michael Sheehy and Rep. Jane Harman (D-Calif.), then the ranking member of the House Intelligence Committee, on the specific techniques that had been used on Zubaydah — including waterboarding.

Harman was so alarmed by what she had heard, she drafted a short letter to the CIA’s general counsel to express “profound” concerns with the tactic — going so far as to ask if waterboarding had been personally “approved by the president.”

Porter Goss, the House Intelligence Committee chairman in 2002 who went on to become director of the CIA has a different recollection. As he wrote in the Washington Post, he, Pelosi and the ranking Senate Intelligence Committee members were briefed extensively, "understood what the CIA was doing," and "gave the CIA our bipartisan support." Goss was "slack-jawed to read that members claim to have not understood that the techniques on which they were briefed were actually to be employed."

If facts come out that support the notion that Pelosi was involved in formulating, advising, authorizing or carrying out illegal interrogations she should face the same consequences as others.

It is unlawful for the executive branch to limit notification, as it did here, to the Gang of Four. There is no such entity recognized in the National Security Act. Federal law does provide, however, for notification of fewer lawmakers than the full intelligence committees, but only when “extraordinary circumstances affecting vital interests of the United States” are at stake. Under those very limited situations, the notification may be to the “Gang of Eight,” which includes the majority and minority leadership of the House and Senate, in addition to the intelligence committee leaders.

Oddly enough, I live in Arizona and was born Michigan, so I can say with complete authority- they are the worstest candidates ever!

Harriet Meirs was just plain dumb and didn't hide it. But nothing can be worse -as we've already seen, than someone playing dumb just to get the job.

Either of those two Governors would be about as trustworthy and principled as Joe Lieberman.

If Roe or other fait-based issues ever appear again in a Roberts court, she may surface as another Kennedy instead of the civil rights minded Souter. And that would be a disaster.

acronyms involving federal offices have to include letters for "of the"? Why not PUS for President and SCUS for Supreme Court. Aren't acronyms supposed to shorten things? Does is have to do with CUS?

I believe in separation of church and state as it is listed in the constitution. I don't agree with trying to force local government to remove crosses or the 10 commandment from courthouses.

1st Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;

The constitution was written to be interpreted by the common man in simple terms. Which is why when people state that this or that person is a constitutional law scholar/professor amuses me a bit. We should all be constitutional scholars. No training needed beyond simple language skills. And perhaps a old copy of Blacks Law to understand the words as they were used back then.

All it states is that is that the Gov can't mandate religion. It doesn't say they can't favor one or the other, or use their beliefs in their duties. Just that they cannot infringe on your personal beliefs. ie Making everyone in the US join "x" church or making "y" church illegal.

Quick and dirty version.

The establishment clause has generally been interpreted to prohibit 1) the establishment of a national religion by Congress, or 2) the preference of one religion over another or the support of a religious idea with no identifiable secular purpose.

I would love to have had a dynamic, fighting governor as leader in this state.

But I don't see that in Napolitano and we dearly need an "activist" judge to balance the scale.

Yeah, although no one seems to know if Coleman is the focus of this particular investigation, or if it's just part of the wider case against his benefactor, Kazeminy.

It also came out recently that Coleman has asked to use campaign funds to pay for his defense in the criminal case. I'm waiting for his donors to raise a stink about that, but I'm not holding my breath...

appealed the lower court ruling back to the Minnesota State Supreme Court. Oral arguments are set for June 1. Assuming they uphold the lower court, Team Coleman will then file an appeal to USSC.

Basically Frank Ricci a white man from Italy, quit his second job, spent around $1000 on text books and studied his ass off to pass the test for promotion. He came in 6th out of 70ish for 8 spots open. When no blacks passed the city through out the test and promoted no one.

Funny how Obama feels that the next justice of the Supreme Court he will soon appoint "should be dedicated to the rule of law" and “who shares my respect for the constitutional values on which this nation was founded and who brings a thoughtful understanding of how to apply them in our time.”

Now, this is interesting to me because Obama refuses to prosecute Bush/Cheney War Criminals,CIA torturers...etc, even though this behaviour clearly violates US and International law. Obama is not a King, (or at least he isn't supposed to be) and is violating the laws of this country by helping these people avoid prosecution.

So, here we are..."The Obama King", who refuses to uphold the rule of law himself, as well as protect and defend the Constitution about to appoint the next Supreme Court Justice who by the way is also expected to uphold the rule of law, as well as defend the Constitution...

Wow, there's a lot of paranoia here, and not many people with favorites. Notwithstanding predictions of doom and fascism, this is a pretty big decision. And well worth the effort to do a little reading and make your feelings on your favorite known. ABAnet and Judgepedia are both places to find summaries of careers and rulings.

My letters went out for Diane Wood. Antitrust and Int'l Trade lawyer (so she's not afraid of fields in which the US has given up some sovereignty), and Obama's in the process of putting teeth back in antitrust. She's spent 20 years at U. of Chicago and the 7th Circuit sitting across from Richard Posner and Frank Easterbrook -- not only two of the smartest conservatives in the country, but conservatives with a very fully formed philosophy behind them. I can't think of any better training for sitting across from Scalia and Roberts.

She doesn't have the Everyman background, I think she plays oboe in the Chicago Symphony now, but I'm for getting the intellectual big guns on the court now and using the next pick to find the person who can explain to her colleagues how things work in the real world. Judge Sotomayor would also be good, but I like Wood's chances a little better for becoming the intellectual energy behind the next generation of the liberal side of the court.

The question is, are you Democrats prepared? Given this wonderful list of lefty women, he'll actually choose some white male right of center. I'm going to have a big laugh at that.
