Liz Cheney went on Morning Joe today and tried to defend her father's recent media appearances, in which he attacked the Obama administration's policies in the war on terror, and moreover his role in enacting the torture regime that he's now so vigorously defending as having saved "thousands of lives."

To which Eugene Robinson responded in the Washington Post:

The fallacy lies in the fact that it is impossible for Cheney to prove that anti-terrorism methods within the bounds of U.S. law and tradition would have failed to prevent new attacks. Nor, for that matter, can Cheney demonstrate that torture and other abuses were particularly effective.

Liz Cheney, of course, thinks that's all wrong: These "interrogation methods" kept us safe -- and that's all the justification they need. She thinks having the OLC write up an excuse as paper cover is justification enough, and said so to Robinson, after he compared their lawbreaking to a bank robbery:

Robinson: But look, efficacy isn't the only thing we should be talking about here. We should also be talking about legality. We should be talking about whether what was done was legal. If I rob a bank and get away with it, there's a lot of efficacy there, but it's not legal.

Cheney: Yeah, but that's not a fair comparison. That's not fair. Because this program was very responsibly and carefully done. And if you look at the history of it, with the CIA coming to the NSC and saying, 'We need to know what we can do legally.' And the very legal opinions that the administration has released are in fact the documents that set out in great detail, this is what you can do, and this is what you can't do. If you cross this line, it becomes illegal. If you cross this line, it becomes torture. It was very, very clear. So I think it does a real disservice to the people who ran the program to equate it with robbing a bank or with criminal activity. You have to look at the very specific and important legal restrictions that were put in place.

Robinson: I do not think that's the case. Torture is a war crime. It is a war crime.

Cheney: That's right. And this wasn't torture. Those legal memos demonstrated where the line was, and where it would become torture.

Robinson: Waterboarding was torture during the Spanish Inquisition, it was torture when Pol Pot did it, and I believe it was torture when we did it. But that --

It quickly devolves into crosstalk, and Cheney spends a lot of time filibustering with her talking points, but she never is able to effectively respond to Robinson's chief point: Legal paperwork is not adequate cover for committing torture, one of the most heinous of all crimes. As he points out at the end:

No, you don't have to make that choice. You don't have to choose to act in an illegal manner. You don't have to.

And there was a revealing exchange at the end of this discussion between Cheney and Mike Barnicle:

Barnicle: Forget the legal niceties of legal or illegal. If he's the only one you have in your hand, then there's something seriously wrong with your intelligence capabilities. If you only have one guy who can give you that information?

Cheney: Exactly. That's exactly right. You know, Mike, that's a really important point, because that's where we were on Sept. 12, we didn't know anything about Al Qaeda -- well, I shouldn't say "anything." We didn't know very much about Al Qaeda.

That's right -- especially if the "we" is the Bush administration particularly, and not our intelligence agencies generally. Because the Bush/Cheney (starting to look even more like it really was Cheney/Bush, in retrospect) administration was completely asleep at the wheel on Sept. 11, having dismissed concern about Al Qaeda as "a Clinton thing".

Dick Cheney and George W. Bush and Condi Rice didn't know much about Al Qaeda on Sept. 12 because they had ignored Richard Clarke's in-depth memo on the subject back in January!

Then there was the Aug. 6, 2001, presidential daily briefing titled "Bin Laden determined to strike in US," which concluded:

We have not been able to corroborate some of the more sensational threat reporting, such as that from a ---- service in 1998 saying that Bin Laden wanted to hijack a U.S. aircraft to gain the release of "Blind Sheikh" Omar Abdel Rahman and other U.S.-held extremists.

Nevertheless, FBI information since that time indicates patterns of suspicious activity in this country consistent with preparations for hijackings or other types of attacks, including recent surveillance of federal buildings in New York.

The FBI is conducting approximately 70 full-field investigations throughout the U.S. that it considers bin Laden-related. CIA and the FBI are investigating a call to our embassy in the UAE in May saying that a group or bin Laden supporters was in the U.S. planning attacks with explosives.

Of course, that memo was ignored too. Neither Bush nor Cheney nor anyone else in the adminstration insisted we gather more intelligence on Al Qaeda at that point. It was a "Clinton thing."

Moreover, there was that 2006 National Intelligence Estimate whicch found that Bush's "war on terror" has certifiably made us less safe, and more likely to suffer future terrorist attacks:

A stark assessment of terrorism trends by American intelligence agencies has found that the American invasion and occupation of Iraq has helped spawn a new generation of Islamic radicalism and that the overall terrorist threat has grown since the Sept. 11 attacks.

The classified National Intelligence Estimate attributes a more direct role to the Iraq war in fueling radicalism than that presented either in recent White House documents or in a report released Wednesday by the House Intelligence Committee, according to several officials in Washington involved in preparing the assessment or who have read the final document.

The intelligence estimate, completed in April, is the first formal appraisal of global terrorism by United States intelligence agencies since the Iraq war began, and represents a consensus view of the 16 disparate spy services inside government. Titled “Trends in Global Terrorism: Implications for the United States,’’ it asserts that Islamic radicalism, rather than being in retreat, has metastasized and spread across the globe.

Among the reasons the report identified for its spread? "[T]he indefinite detention of prisoners at Guantánamo Bay and the Abu Ghraib prison abuse scandal".

And now we're expected to find Dick Cheney and Friends and Family credible when they warn us that Obama taking action to address these problems will make us more vulnerable?

Right.

As Robinson says in his column:

Other high-ranking officials from the previous administration, including George W. Bush himself, have had the manners and good sense to follow long-established custom and refrain from attacking the new president and his policies. Cheney, however, is not only accusing President Obama of knowingly putting American lives at risk -- an outrageous charge -- but is also diving headlong into partisan politics.

I'm wondering if the right wing really believes that waterboarding isn't torture- or if they beleive it's not torture....only if the US is doing it.

Didn't the Japanese waterboard US POWs in WW2? Were we wrong to accuse them of torturing US POWS -if waterboarding isn't really torture?

Ventura, honest as usual, said on the Larry King Show that waterboarding is torture. He would prosecute all that did it and all that authorized it. He called Cheney a coward during the Vietnam War & a chickenhawk now. Liz Cheney is the daughter of a coward & sadist. She's as sick as her father.

My question to morning joe: "who gives a f*&k what she says" - really pathetic to put on this classless shill - hint: it's not coincidence her last name is Cheney - she is actually related to the person who is at the apex of all this. But I guess people who believe you can get relevant information out of a waterboarded torture victim could believe that you can get a straight answer out of a Cheney about torture without them resorting to framing it in fictional universe where you presuppose that it works, that it doesn't have international effects, and that it's legal.

I do feel sorry for her though - her rearing by Dick and Lynn (which one puts a bigger chill up your spine?) has really warped her - she is now a graceless bully that probably should be kept separate from civilized society - really no hope for reforming bullys unfortunately.

On edit: It was interesting (and infuriating)) how the New York Times recently ran an obituary of a World War II serviceman who was "tortured" by the Chinese. Many of the techniques used on him were the same as what we employed during the last administration. The Times uses the word "torture" when an American is the victim, but can't bring itself to use the word when describing the crimes of the Bush/Cheney Crime Syndicate.

.. The Pew Research Center for the People & the Press has been polling Americans on this key question for almost five years. Since 2004, representative samples have been asked, "Do you think the use of torture against suspected terrorists in order to gain important information can often be justified, sometimes be justified, rarely be justified, or never be justified?" The results over this time period have shown only minor fluctuations. The most recent numbers, from last month, reveal that 15% of Americans believe torture is often justified, 34% think it is sometimes justified, 22% consider it rarely justified, and 25% believe torture is never justified. So not only do 49% consider torture justified at least some of the time, fully 71% refuse to rule it out entirely.

Since when are settled questions of law, codified in domestic legislation, international legal codes, commonly accepted rules of war and diplomatic treaties signed decades ago, subject to interpretation by public polls??

Never mind the moral dimension of torture. It's AGAINST THE LAW.

I see the point about public ambivalence toward the use of torture in time of war - but the point is irrelevant. If a poll said it's OK to ignore anti-trust regulations, or endangered species laws, or constitutional protection against domestic spying without warrants (!!), does that in any way weaken these laws? Of course not.

That's it. That's all you have to say when they bring it up. We dont just waterboard them for fun. It's torture and it's to prepare them for torture, so it's somewhat ironic to claim its not torture because we waterboard our own soldiers to prepare them for when they are tortured.

It started off with Joe on the telephone defending torture for 10 minutes and then we got her for 10 or 15 minutes. Then they brought on Eugene Robinson and he had to sit an listen to her. I am about done with this program. I guess I am going to have to do Morning Joe like FOX. Let someone watch and provide clips so I don't have to.

There are mornings when you can switch from Joe's show over to fox, and the conversation will be about the same subject and have the same tone.

There is seldom anything of value in his shows. Mostly Joe is an ass and mika is along for the ride I guess. She hardly stands up for the liberal side of things. Last week or the one before she was raising hell about Miss California losing the Miss USA contest because according to Mika, they girl would have won had she not been against gay marriage. Even though the judges said the girl who did win was way ahead of Miss California in the points even before the question and answer part of the contest, Mika was demanding Donald Trump reverse the decision and give the crown to Miss California. Mika's a ditz.

Bottom line, after watching how incredibly incompetent the panel is in shutting down these "arguments" to justify how we treated detainees--even after the sickening facts have come out--I have come to the following conclusions:

a) No one will be tried

b) No one will be convicted

c) We will permanently lose our moral authority on the world stage

The fact that Liz Cheney, as a person with NO role in government, with no credentials or expertise on the topic at all, is allowed on the show and then dominate the air time by just talking continuously about misrepresentations is the most revealing thing about this on going "debate" in the media. The recruitment of unprepared people to act as the "counter point" to the leading "point" also shows the agenda. Why not have Jesse Ventura as the opposing view to Liz Cheney? or Jonathan Turley? or John Dean?

The truth is - you cannot rationalize or justify a crime based on the results of the outcome. Whether or not torture produced any results is completely beside the point.

There is no question that waterboarding, blindfolded 'walling', sleep depravation, etc. are torture. The idea that we do some of these techniques to trainee volunteers who have safe words and stop the treatment at any time somehow makes it not torture is preposterous.

The law is very clear, under Geneva Conventions and Anti Torture Treaty. Torture is a crime AND not prosecuting torturers is a crime.

The reason we waterboard our military is to prepare them to withstand TORTURE. These people are stupid liars.

We tortured to keep us safe? No, we tortured to extract false confessions to justify invading Iraq. "The Mushroom Cloud"; "greeted as liberators"; Iraq's "involvement" in 9/11; "fixing intelligence" to justify the war; and other purposeful deceits were used to justify an unjustifiable war.

Just how were they going to "fix" the intelligence? Cherry picking was an obvious method. But so was reverse engineering a SERE program based on tactics used to extract false confessions from our pilots by the Chinese.

Yet the framing is always that we can't assume these criminals were doing anything "deliberately." "Surely they just didn't know that these were not intelligence gathering tactics. They were just mistaken. Of course, they were only trying to protect the country."

Nonsense, the trail is clear. Tactics used to extract false confessions were used by an administration that undeniably lied us into a war of their choosing. So why must we assume this was done for any other reason than to buttress their many other Iraq lies?

Oh, and, BTW, if this was so noble, why were so many tapes destroyed? Is it because they were filled with questions like: "Tell us about Saddam Hussein." or "How was Iraq involved?"

Waterboarding was torture during the Spanish Inquisition, it was torture when Pol Pot did it, and it was torture when WE executed the Japanese for doing it!!! That's all. Who gets to decide if and when these techniques are applied?

According to US Law, every one of those interrogated was innocent, because none were ever found guilty of any crime (innocent until proved and all that).

So they were just interrogated – legaly? Then anyone, anywhere, accused of any crime could therefore be “interrogated” in this manner – since the legal memos found it was not illegal. This would not only apply to FBI, CIA, and the military contractors in foreign
countries, but also for Sheriff Jim-Bob-Billy-Rae in MS.

Accused of drug-trafficking? Let’s find out fer sure – waterboard.
Accused of shop-lifting? Let’s get to the truth fast – waterboard.
Driving while black? “Not in mah countee!” – Waterboard.

Until one of these sadists actually gives specific examples backing up their claims of we torture (oh I'm sorry, we enhance our interrogation), terrorists didn't attack, therefore torture works; is no different than me saying I'm training in iaido, I've never been robbed, therefore if you train in iaido you'll never get robbed. You can't get more blatant an example of false cause than that.

Hell at least even Adolf Hitler's sister didn't try to defend him. A member of the Hitler family, Adolf's sibling no less, has more integrity and fortitude then to try to defend someone like Adolf.

Oh an ends justify the means? So if I were to nuke a city based on a rumor that Bin Laden was there buying fruit or something, that would be ok? This is yet another bitch who would be more than happy to burn what's left of the Constitution in the name of "national security" and I'm sure most of us know how Ben Franklin feels about people like that.
