Evidently, Bill O'Reilly's idea of defending his network's journalistic honor is to lie blatantly -- not just to his national TV audience, but to a U.S. Senator to boot.

Last night on his Fox News show, BillO -- incensed by Sen. Tom Coburn's suggestion that Fox News' coverage of the health-care debate was misleading and biased -- tried to claim that no one on Fox had ever suggested that you'll get thrown in jail if you don't buy health insurance.

O'Reilly claimed it three times in the course of the interview, each time with escalating falsity, culminating with the claim that his staff had carefully researched the question and found that no one at Fox had ever said it.

Oh really? Because as you can see, we have the video that demonstrates clearly otherwise.

Glenn Beck, as a matter of fact, said it on his own Fox News show -- and he said it on Bill O'Reilly's program too, directly to O'Reilly's face. And O'Reilly made a joke about it.

Nor was Beck alone among Fox anchors saying it.

Here's how O'Reilly put it to Coburn:

O'Reilly: OK, but can you tell me one person on Fox News, just one, who has told this audience that they'll go to jail if they don't buy health insurance.

...

O'Reilly: Well, why then was it legitimate to bring in Fox News in the discussion, when, No. 1, you don't know anybody on Fox News -- because there hasn't been anyone -- that said people will go to jail if they don't buy mandatory insurance.

...

O'Reilly: Well, tell me, what -- because it doesn't happen here. And we researched to find out if anybody on Fox News had ever said you're going to jail if you don't buy health insurance. Nobody's ever said it.

Of course, none other than O'Reilly's sometime stagemate, Glenn Beck told his audience on Nov. 12, 2009:

Beck: But if you don't play by their new rules on health care, oooh, here's a new little twist. Have you heard this? You're going to be looking at a fun little stint in jail.

... But if you don't play ball with them now, if you don't get into their government health care, there will be jail time. And that of course was fair.

The next day, Nov. 13, in his weekly appearance on The O'Reilly Factor, chatting over his then-recent appendectomy, Beck repeated the line, and O'Reilly responded by asking Beck if he intended to go to jail over health insurance (transcript courtesy Media Matters):

O'REILLY: Couldn't they do [liposuction] at the same time [as your appendectomy]?

BECK: No, they wouldn't. No. I don't have universal health care.

O'REILLY: Well you will soon.

BECK: Or I'll go to jail.

O'REILLY: Are you going to be a conscientious objector to health care?

BECK: You know, this is the first time in history in our country where, just to be a citizen, just to not go to jail, you have to buy something.

That's some crack research squad O'Reilly has there -- they can't even rustle up the times this lie was repeated on O'Reilly's own show.

No wonder the fact that not only did they miss the Beck claims, they missed that Sean Hannity made the same claim (citing Dick Morris), as did Judge Andrew Napolitano. All on the Fox News Channel.

O'Reilly clearly got away with lying to Coburn to his face.

But as for defending Fox's honor, well, let's just say that it worked about as well as it should.

I hope that Sr. Coburn gets this research that confirms that he is telling the truth, and FOX lies. I think that supporting Coburn on this is important. Honest Conservatives are few and far between, and in danger of extinction. Whenever we find one, we owe it to everyone to provide support.

can I ask a question?

If you do not buy health insurance, and you only pay the portion of your taxes to the IRS, and not the fine, what happens to you eventually?

If there is no enforcement, why have the fine? Is it a special fine which, unlike other fines does not result in a bench warrant for non payment?

recently and they discussed this very issue. My impression was that
it is a fine without an enforcement mechanism. But I will not claim to have researched it.

The other day I was watching a discussion which pointed out that on average, the fine is much less than the cost of purchasing a plan, so many will opt for the fine, unless it increased much much higher, like $2000+

Thanks ricky. Well, according to that there is no enforcement mechanism. None. No penalty for not paying the fine.

Thew only sense I can make out of this is that the IRS will not send you your return if the fine has been levied. And by their predictions, enough tax payers will be in a refund position that they will net a sufficient revenue for the health insurance program.

Sound good?

Now, does the IRS then send those collected fines to be divided up amongst the insurers?

..that's what I've heard also. Largely, its all in the tax credit you receive for having or one you lose if you don't. That's how I heard it explained.

this issue is being avoided, as the IRS is not near and dear to the hearts of most americans. there is a mandate, you will have to attest to having insurance, if you don't there will be a fine. if you lie, that is filing a false tax form; i get this from reading various articles and from a cpa.

of course, since all tax law compliance is "voluntary", i am sure there will be no problems...

According to a poll posted by Mr. Amato they are more popular that the Tea Party (and Democrats and Republicans, too.)

That's what I'm wondering. The enforcement body is the IRS. The only debts you can go to jail for are taxes and fines. This seems to qualify. Does the fine have a special classification?

It is a damn good question and was not answered by the interview clip or the post and its links.

Not true. Wesley snipes is in jail for tax evasion as are a lot of others. Anyone who has ever had a speeding ticket and did not pay it, or fail to appear in court, has a bench warrant issued for their arrest.

In Texas they can, (and will if you are say, black of Mexican American) take you to jail if they stop you while driving and you cannot prove current liability insuance.
Failure to pay a speeding ticket will get you deep in the hoosegow.

I still say there are several debt scenarios that will land you in jail. Also, I have read how fines collectible by municipalities have been sold to private collection agencies, who can and do threaten you with jail time for not paying their account because it was originally based om a fine.

Hospitals in several states have secured the arrest and even jailing of patients who miss court hearings on their debts. This legal tactic is chillingly known in some areas as “Body Attachment.”

the real trouble will come for people who file a false tax form, those fines can get pretty high; plus, the IRS can levy your income.

Debt collectors will often try and use deceptive practices such as threatening jail time on unknowledgeable victims to force them into repaying a debt. The FTC has established Fair Debt Collection policies that have strict restraints on what bill collectors can and cannot say.

Threatening jail over a debt is illegal. Debt collection is a civil matter.

Wesley Snipes is not in jail.

Back in 2006, Snipes was brought up on enough tax-related charges to keep a fleet of IRS agents busy for years: conspiracy to defraud the U.S. government, aiding and abetting the making of a fraudulent claim for payment and willfully failing to file a number of tax returns. He was acquitted on all felony counts but found guilty on several misdemeanor charges and sentenced to three years in jail; he is currently appealing, and is out on bail and free to travel for work.

You do not go to jail for debt in this country. You can go to jail for failure to pay a court-ordered fine.

you usually don't do an actual sentence for those bench warrants. If they pull you over, you might need to spend a night in jail, unless you can afford to post bond, and then they give you a court date. If you keep skipping the court appearances, they can eventually charge you with contempt of court, which carries a sentence. Or you can do what I did when I had a bench warrant issued against me, which was simply not getting pulled over for a year or two. They only serve the bench warrant if they pick you up for something else. Also, as far as tax evasion goes, I think in the case of the mandatory health insurance fine, they would simply deduct it from your refund or add it to the amount you owe.

Wesley Snipes is in prison for refusing to file any tax returns, based on Patriot conspiracy theories which teach people that they can make themselves exempt from taxes by declaring themselves sovereign citizens. In other words, he was a classic tax evader, and his bill is now estimated at about $20 million.

You won't go to prison for failing to pay your fine. But you will wind up owing more. Now, if on top of that you should also fail to file any returns at all, then you can probably plan on jail time. But it won't be because of the fine.

Also David, do you think there should be an enforcement mechanism behind the fines levied for not purchasing insurance? We are talking about a lot of people getting fines here. The only other enforcement mechanism I can think of is denying them health care.

Understand I'm not trying to support Fox's argument or whatever, I'm trying to figure out how this plan is workable.

Zackly. This part of the bill is weak.

They're going to have to figure something out, but eventually what they'll have to come up with is a system analogous to traffic fines, with enforcement through civil courts. Now, at the end of the day, you could end up in jail, though not for the fine -- rather (as happens now in civil courts) for contempt for refusing to follow a judge's order.

No, what they will have to come up with is single payer. Then all this crap is done with.

When Steven Colbert first started his show, he had segment called “Threat Down”. Usually bears where the #1 threat; but he always called O’Reilly “Papa Bear”. Not too subtle, but I don’t think many people got it.

The main thing here is that Colburn will check and find out that O'Mousedick is a liar and full of shit. What do you think that will do for the relationship between Fox/O'Mousedick and Colburn and other republicans who might want to tell the truth once every blue moon?

In my hometown newspaper, the Reno Gazette Journal, they run Bill's column once
a week and it drives me crazy. His last one dealt with the unfair coverage of the tea
parties by the main stream media. So, the rest of the media will not promote them like
Fox does and he calls them unfair. Why do newspapers carry this lying lier???

...Rather, I think it may simply be proof that a) he doesn't watch Glenn Beck, and b) when Beck appears on his show, O'Reilly doesn't pay any attention at all to what the CLOWN says.

Anyone with an ounce of gray matter knows that Beck is a complete idiot and in a better world no one would pay any attention to him -- ever. He wouldn't have a TV show, no radio program, and if any woman (or man) was unfortunate enough to be partnered with Beck, she (or he) wouldn't listen to a word the CLOWN says.

I'm not defending O'Reilly so much as I am acknowledging that he probably thinks Beck is idiot and ignores him. That's no excuse for the poor job of checking that led O'Reilly to claim that no one at Fox had ever said anyone could face jail for refusing to buy health insurance. The fact that he joked with Beck directly and apparently had forgotten about it altogether may be more of an indication of the low regard he has for the CLOWN than it is a sign of dishonesty.

Or O'Reilly may just be a lying sack of shit. Or both.
