Sy Hersh: Cheney Ran Assassin Ring

Like many reporters, Seymour Hersh has a lot of trouble keeping a hot scoop to himself, and dropped a major bomb at the University of Minnesota the other night. This is the second time he's spilled the beans on an upcoming story at a public forum:

After 9/11, I haven’t written about this yet, but the Central Intelligence Agency was very deeply involved in domestic activities against people they thought to be enemies of the state. Without any legal authority for it. They haven’t been called on it yet. That does happen.

"Right now, today, there was a story in the New York Times that if you read it carefully mentioned something known as the Joint Special Operations Command -- JSOC it’s called. It is a special wing of our special operations community that is set up independently. They do not report to anybody, except in the Bush-Cheney days, they reported directly to the Cheney office. They did not report to the chairman of the joint chiefs of staff or to Mr. [Robert] Gates, the secretary of defense. They reported directly to him. ...

"Congress has no oversight of it. It’s an executive assassination ring essentially, and it’s been going on and on and on. Just today in the Times there was a story that its leaders, a three star admiral named [William H.] McRaven, ordered a stop to it because there were so many collateral deaths.

"Under President Bush’s authority, they’ve been going into countries, not talking to the ambassador or the CIA station chief, and finding people on a list and executing them and leaving. That’s been going on, in the name of all of us.

"It’s complicated because the guys doing it are not murderers, and yet they are committing what we would normally call murder. It’s a very complicated issue. Because they are young men that went into the Special Forces. The Delta Forces you’ve heard about. Navy Seal teams. Highly specialized.

"In many cases, they were the best and the brightest. Really, no exaggerations. Really fine guys that went in to do the kind of necessary jobs that they think you need to do to protect America. And then they find themselves torturing people.

"I’ve had people say to me -- five years ago, I had one say: ‘What do you call it when you interrogate somebody and you leave them bleeding and they don’t get any medical committee and two days later he dies. Is that murder? What happens if I get before a committee?’

"But they’re not gonna get before a committee.”

The US Vice President, Dick Cheney calls on Congress to 'permanently' allow warrantless wiretaps on foreign electronic communications.

During a speech to the Heritage Foundation in Washington on Wednesday, Cheney said it is 'urgent' to renew and update the Foreign Intelligence Surveillance Act (FISA) 'immediately and permanently'.

The 30-year-old FISA is a federal law allowing physical and electronic surveillance and the collection of 'foreign intelligence information' coming from and going to territories under US control.

In a modification made last year that will expire on February 1, the Congress empowered intelligence agencies to tap into telephone conversations and emails, without first obtaining the permission of a special FISA court.

Cheney warned of 'serious consequences' if the Congress fails to provide protection for telephone and Internet carriers from lawsuits for alleged complicity in privacy rights violations in the US 'war on terror'.

"The challenge to the country has not expired over the last six months," he said, referring to the so-called war on terror launched in the aftermath of the 9/11.

"It won't expire anytime soon, and we should not write laws that pretend otherwise," said the US Vice President.

When "all" they were doing was trying to kill Castro, that was ok. How many South American presidents did they kill? If you were against American policy and were high profile, you were a candidate for murder. It's been going on for decades. The United States has the blood of millions on it's hands.

I think that, after the Church Committee CIA hearings in or around 1978, U.S. law was clarified to make assassinations illegal. Not that they were morally ok before then (they weren't), but, if my memory about the law is correct, that would make the crimes under Cheney even more onerous.

The moratorium on assassination was issued by executive(ironically) order.

Indirectly, the hearings led to the FISA/FISC laws.

I was listening to Thom Hartmann this morning and he was wondering if it was related to the US military-grade Anthrax that was sent all over the place, and then there's the DC Madam, who had Cheney's phone number on her call list, she said she would never commit suicide and sure enough in a short amount of time she turns up dead.

And, does Cheney still control this same group or any group like it?

All of those strange occurrences reek of dickie-boy's personal touch.

I too would like too see the details before I get too excited. For starters, JSOC is not a "special wing of our special operations community that is set up independently". It is part of US Special Operations Command and was set up in 1980 after the hostage crisis to better coordinate and control special operations missions.

Then we have "They do not report to anybody, except in the Bush-Cheney days, they reported directly to the Cheney office. They did not report to the chairman of the joint chiefs of staff or to Mr. [Robert] Gates, the secretary of defense. They reported directly to him."
JSOC reports to US Special Operations Command, which reports to the Secretary of Defense. They do not report to the Joint Chiefs because the Joint Chiefs is an administrative, not operational body.

Maybe they've gotten missions directly from the Commander in Chief but that's why he's the Commander in Chief - he can do things like that.

In any case, it's not "an executive assassination ring" - it's a command to oversee all special operations missions, whatever they may be.

It probably would have been better for everyone if Hersh had waited to publish a full report before he said these vague and contradictory things.

I just replied to Wegener (go down just a bit), and I think Hersh could very well be wrong, too.

The JSOC operates under USSOCOM to coordinate the operations between the special ops units of the Army, Navy, Air Force and Marines. So each squad of Navy Seals gets its orders from up the chain of Naval Command, and answers back up that chain. Ditto the Rangers, or the special ops units of the Air Force. But when these teams need to work together JSOC comes in to facilitate cooperation. So JSOC, because it's made up of four separate entities, doesn't report to the military commander of one branch of the service, it reports to the office that covers all four: the President, or to whomever the President delegates the oversight. Follow?

This comment is actually spot on. JSOC and SOCOM, while under SecDef, does occasionally have orders that come straight from the Executive. It's not concern trolling, or anything, it's just a better layout of how things are according to the currently available information.

However, knowing Sy Hersh, there is much more detail behind this that will expand on the seeming contradictions here.

...is that JSOC is simply an office that coordinates the operations of the special operations units of the four branches of the military that have special ops units. The Army, Navy, Air Force and Marines all have units that report up the chain of command, so de jure they report, eventually, to the Joint Chiefs of Staff.

I think that if the POTUS, as C in C, should delegate the authority to a third party, bypassing the oversight of the Joint Chiefs, is the question here.

Kind of. You're exactly right about the purpose of JSOC, they get all the SEALS and Rangers and so on to play well with each other. One thing that isn't well known is that there are two separate chains of command in the military - operational and administrative. The Joint Chiefs are administrative - they are in charge of policy, planning, training, etc. The operational commanders, i.e. PACOM, CENTCOM, STRATCOM, SOCOM are in charge of mission execution and report directly to the SECDEF.

JSOC, as a subordinate to SOCOM, is not operationally responsible to the Joint Chiefs.

That clarifies it for me.

It's not a matter of how they might have assassinated opponets, but if the administration secretly struck down the executive order that prohibits assassination.

I am very interested in reading the full report on this, too. To me, the targets are what make all the difference here. Al Qaeda officer? Fine. Pakistani legislator? Illegal.

We'll see. Hersh was the first or one of the first to break the Abu Ghraib story, and he was correct about that.

Please read " Takeover " by Charlie Savage ! There are many other books I can recommend that will explain the level of secrecy Dick Cheney kept in affairs concerning the Executive branch !

Too much is made of Obama's brief remarks that he wants to look forward. What he really said that matters is, no one is above the law.

What matters is that he's said he won't prosecute the Bush administration for war crimes, even before America and HE know what they did.

The Church Committee on Assassinations was a one-shot deal. Suppression of this kind of transparency and accountability has been a feature of US governance since Ronald Reagan.

They aren't ultimately responsible for the orders they receive, but they are personally responsible for obeying orders to torture and murder. I don't care if they're "troops" or not. If you say they're "the best and the brightest", they oughta be bright enough to know that torture is not only counterproductive, it's also morally and legally execrable. That someone can only be concerned about their own welfare after they've tortured someone until they're clinging to life in a pool of their own blood in unimaginable pain is sickening and ought to be punished. I hope these "special forces" guys get attacked in some of the countries they're infiltrating. They deserve it. Is a sniper who takes out an enemy commander a murderer and assassin? How about one of these special forces soldiers who takes out a terrorist cell commander? Or one who takes out an Al Qaeda financier who doesn't actually fight but supplies the money for weapons? Which is murder, which is assassination, which is legitimate military activity? All of it? Any of it? Who has this "assassin ring" killed and why? Can we actually come to any real conclusions based on the comments in this article alone?

If this is true then this revelation is at the level of a national emergency and needs to be addressed by the Justice department and Senate committee under the glare of the public spotlight straight away.

First question I want to know is is this revelation tied in any way to the weapons grade anthrax that was sent to Sen. Leahy and others that the Bush administration tried so desperately to close just before the election.

The President needs to realize that Bush/Cheney are a suspected of being a "threat from within" and a Special Prosecutor must be appointed directly.

Also, I would put some kind of federal protection around Hersh and his contacts to prevent harm to them.
