FOX News: New Haven Firefighter Reminds Us All of Poor Joe the Plumber

Megyn, Megyn, Megyn. What has gone to the FOX anchor's head? It's one thing to demonize People for the American Way, we kind of expect that. But in an interview with the attorney for the New Haven Firefighter who sued for reverse discrimination (in a case made notable by the involvement of Judge Sotomayor) BAM out of nowhere you compare him to Joe the Plumber? Joe not-a-plumber, Joe who toured with McCain as a prop? Poor Joe, the "innocent" guy who wanted to avoid the public spotlight so vigorously, he hired a Nashville publicist to handle his press requests?
And somehow, stating that the GOP "failed to vet" Joe the Plumber is an unfair smear?
Kudos to the attorney for agreeing quickly with Megyn Kelly as if it were her own idea. You do what you can for your client and your own firm's PR, no matter how divorced from reality your claims might be. Every lawyer knows the value of billable hours, my friends.

to my reading, the crucial statements in Jeffrey Deskovic's interview are,
"When that decision came down, my lawyer moved to reargue the case in front of Judge Sotomayor and her colleague, Rosemary Pooler, and that, too, was denied, and the US Supreme Court did not grant me permission to appeal to them."
And then he says, "They compared the DNA which didn’t match me to the database, and it matched the real perpetrator. Again, it’s really flukish, which is all the more serious as to what the judge’s ruling was. I mean, if he had not committed an unrelated crime, then his DNA wouldn’t have been in the database, and I still would have been in prison."
Tragic that a young man served time for a crime he didn't commit, but I do not see a Sotomayor mistake. She is not psychic, she can only go on what's is front of her. The guys attorney missed a filing deadline, and yet the court still reviewed their brief. The DNA test exonerating the man didn't come until 6 years later. If the ruling was outside the bounds of legitimacy, one would think that SCOTUS would have heard it.
I do not find the case on Lexis, but there is a Deskovic appeal from 1994. That was denied too, and Sotomayor wasn't on the bench.
The only connection between Ricci and Joe might be that they are both spotlight hounds. Opportunist, if you will. No one forced either of them out on the stage.

When Ricci began this suit I don't think he had visions of the spotlight. But now he has won his case and sees an opportunity to grab the spotlight with both hands. Will he be like Joe the whatever and get a book deal? It wouldn't surprise me one bit.
One of the reporters said this morning when Ricci, and the other firefighters who came with him, entered the confirmation room, Judge Sotomayor went over and greeted them and thanked them for coming. Now that is CLASS!

I don't see the point of his testimony now, as the Judge did not personally do anything to him, she simply ruled on his case. Soliciting pity for any hardships the lack of promotion might have resulted in for him is not what these confirmation hearings are all about.

Also, how is it out of bounds to point out that Ricci has a "Litigious" work history. If the guy goes around suing his employers all the time its fair to point that out. Its called presenting the facts so that viewers can make their own conclusions, something Fox talks about but really doesn't understand.

I don't understand how these morons can continue to disparage good investigative journalism into the past behavior of PEOPLE WHO HAVE CHOSEN TO BECOME PUBLIC FIGURES.
If Joe the Plumber, Sara Palin, and now, Frank Ricci don't want their lives scrutinized, then don't put yourself out there for public scrutiny.
- None of these people are private actors who have suffered some invasion of their privacy.
- They are willful Public Figures (and in the case of Palin, a Public Official)
- They want all the benefits of attacking other Public Figures/Officials (i.e., Barack Obama and Sonia Sotomayor) but none of the natural risks that such role obviously presents to the taker.
- Finally, not one thing that has been uncovered about any of these people has ever been proven untrue. NOT ONE THING. But to dingbats like this Fox newscaster and Ricci's attorney, outrage trumps the truth.
If I were Frank Ricci, I'd take this exchange as a huge insult. Whatever you think of his history of lawsuits, by all accounts he's a great and dedicated firefighter. Comparing him to Joe the Plumber is a major putdown on the part of both Fox and his attorney.
