Think Progress caught Fox News using old campaign footage of a McCain/Palin rally from 2008 to make it appear like the crowds she's drawing on her book tour are larger than they are.

Think Progress:

This afternoon, Fox News host Gregg Jarrett proudly announced that Sarah Palin is “continuing to draw huge crowds while she’s promoting her brand new book. Take a look at — these are some of the pictures just coming into us.” But the pictures that the network chose to display on-air appeared to be old file footage of Palin rallies from the 2008 presidential campaign. Individuals in the crowd are seen holding McCain/Palin signs, and others are holding pom-poms and cheering wildly. “There’s a crowd of folks,” an enthused Jarrett observed, referring to the old footage.

Media Matters followed up that report with more facts to support the claim, which in my mind should be called a HOAX.

Earlier, Think Progress caught Fox News showing what was clearly footage of 2008 Sarah Palin campaign rallies but claiming that it was video of "huge crowds" attending Palin's book tour.

But in case the McCain-Palin campaign signs and tee-shirts clearly visible in the footage Fox aired aren't enough to make Fox apologize, here's further proof.

Here's a screenshot of the footage of one of the rallies that Fox's Gregg Jarrett showed today and claimed was "just coming into us" as part of the book tour:

And here's a photo posted last year by Florida TV station CFNews 13 of a November 1, 2008, Palin rally in Ocala, Florida:And here's a video of that same rally that TPM posted way back in 2008 -- when it actually happened.

Fox News is not operating like a news organization. It was busted by Jon Stewart of the Daily Show when Sean Hannity used the same technique to make it seem like a tea party rally was bigger than it actually was. And you know Hannity was told to apologize by "legal" over the "Hoax" he tried to get away with. Inadvertent footage doesn't end up on a network show. That's a bogus explanation.

... I could see this being the case. Although they're slanting the truth, if not telling outright lies, they'd say things along the lines of "the viewers/free market will figure it out" and things like that. I could also easily see conservatives falling back on the First Amendment, at which point the fight gets dirtier and dirtier.

That being said, making a complaint would still be alright and the appropriate thing to do. As long as there are people on the record for showing how Fox News is not being fair or balanced.

I came here to say just that. The FCC won't even address the complaint as they have no power to regulate cable, only advertisers have that power. If you want Fox to stop peddling lies and misinformation the only way is to go after their advertisers.

Anyone knowing anything about video editing and production in television knows it’s next to impossible to make these “errors” repeatedly. Time code runs under the video with the date and time the video was made, used to spice together images from different angles. NO EDITOR would continually misread the date and time of videos – NONE. These “errors” are done on purpose, not accidentally.

As far as I know, the FCC does not regulate the content of cable TV channels, only over the air channels.

In the interest of disclosure, I should tell you that I lifted the following from "TheMedia" over on RAWSTORY.COM's comment boards. I edited it slightly, but the original post is not mine. Here it is: I strongly encourage anyone who is sick of hearing about Fox's lies to file a complaint to the FCC. You can do that here: http://esupport.fcc.gov/complaints.htm The appropriate Complaint Type is "Broadcast (TV and Radio), Cable, and Satellite Issues" and the Complaint Category is "Unauthorized, unfair, biased, illegal broadcasts" (the form states that this includes "Biased or distorted news stories by the media"). We have an avenue to correct this type of falsification and to make change we must make a complaint.

Palin's publisher is owned by News Corp. That's a deceptive infomercial posing as a fake news broadcast.

The best category is false or misleading advertising. There's no reason for Fox to do this except to help Palin sell books. What are the chances that her publisher is a Murdoch company? Let me check . . .

Palin's book of distortion and outright lies has been on shelves at Wal-Mart long enough, that the price has DROPPED. From $29.99 all the way to $8.98. Way to sic em Mrs. Lipstick wear-in Pit-bull'.

where is the store on Wlshre? We lived in Mid City, what is now Korea Town, 3 blocks north the the late Ambassador Hotel, at 4th and Kenmore. This was in 2001-2002 before we moved to Vegas in late 2002. My wife worked in Beverly Hills @ Wilshire and Palm. I used Wilshire and 3rd St. for travel.

it isn't a hoax, it's an act of fraud, and only one in a continuing pattern of fraudulant deceptions. Television fraud is actionable under RICO. If anybody else is considering filing a complaint, it may be useful to point out that FOX seems to have few compunctions aginst routinely indulging in acts that defraud the public. They are in violation of the terms of their FCC licenses that they hold as supposed stewards of OUR airwaves and bandwidth.

It's in the FCC guidelines.

“Hoaxes. The broadcast by a station of false information concerning a crime or catastrophe violates the FCC's rules if:

· The station licensee knew that the information was false,

· Broadcasting the false information directly causes substantial public harm, and

· it was foreseeable that broadcasting the false information would cause such harm.”

I agree that it's a hoax, but it wasn't "concerning a crime or a catastrophe." Does the Hoax classification relate to any other sorts of stories? If not, it seems that a false advertising complaint would be best, after all it was fabricating "news" footage with the obvious effect being the heightened interest in a book, the sales of which would directly benefit Newscorp. It was an outright fabrication, couched in a veiled advertisement. I don't suppose it would do any harm to file two complaints just in case though. They'll simply reject the one that doesn't apply.

You may recall a few years back Steve Wilson & Jane Akre of FOX news affiliate in Florida did a groundbreaking story about Monsanto's use of rBGH in school milk, were then fired, sued, won then lost under a technicality, and a basis of the judgement was that FOX was NOT obligated to tell the truth (or something like that). Anyway, it's discussed in the film _The Corporation_

I was reminded of the same case. The Florida Appellate Court ruled that the FCC guidelines were just that, not laws, rule or regulations. It gives them a free hand to create the news their viewers want to see. Comfort news.

Presumably, there is something to old adage regarding the squeaky wheel, maybe if enough people complain often enough, something will change.

One question...why is the reference number blurred at the top of the form, but visible at the bottom? Should somebody fix that before 62 million people claim that it is in reference to their complaint? Or somebody withdraws the complaint with that number? Maybe?

I was browsing the magazine section in Walmart today (Rockland, Maine) and noticed Palin's book on two shelves nearby. Well, looked like they must have recently stocked the shelf, as nine were missing, and no one was looking. Might have been the price, it was $19.99, so I guess the shoppers are going to wait until it hits the Bargain Books bin at that price.

And no, I didn't read any of it. And yes, I had the time.

There really is no reason for Fox not to show clips like this.

Yes, they are constantly called out on the internet, but unfortunately we are only preaching to the choir. Showing their undiscerning viewers what they want to see only brings them higher ratings,and thus more money.

In an ideal world the FCC or other governing body would give them a choice of a sizable fine for this purposeful 'mistake' OR force them to admit their wrong doing on air, and admit their dishonesty.
Now, I can already hear Fox's argument. "We made a mistake, but this video shows the same atmosphere. You are trying to suppress our free speech!!" But if this actually were true, shouldn't there be some kind of repercussions for this gross incompetence?
If they are not held responsible for what they say they will continue to do this. Just look at Sean Hannity's lame apology for the incorrect footage of the Bachman rally. He completely lifted the blame off of himself, saying that a mistake was done. That will only continue to happen.

my complaint didn't innumerate shows or times or instances. it merely said FOX as aired seditious, indignant broadcasts so far outside the public mandate, they have violated their license. They and their cohorts have openly incited, even funded strange bedfellows of demonstration, coverage, spin, inflated attendance figures, while said traitors whisper advocation of harm against the highest-ranking members of the Administration, including the President. The facts speak for themselves.

Faux News has been doing this stuff for a while, and it's interesting it took a fake news show to bust them for it. Obviously, Faux doesn't care what kind of garbage it puts on the air or how much it misleads its viewers. They have no shame.

There was a time if a news organization was caught doing this sort of thing EVEN ONCE, it's credibility would have been irreparably damaged. Not with todays media (especially FOX), nossir! Now, because "news" is presented as entertainment, anything goes. Walter Cronkite and Edward Murrow must be spinning in their graves.

The Republican playbook has always been to say whatever you want because once it's out there, the damage is done. For instance, the people who saw that report are typical Fox sheeple who get all their news from Fox. They are not going to see the 2 second apology that Fox throws out there two week from now. Reminds me of the debate between Cheney and Edwards where Cheney said he never met Edwards which made Edwards look like an idiot (front page news). About two weeks later in the paper it came out that they had met (Page 26 news). Damage done.

My complaint is in, fr Fox News, specifically Glenn Beck and Bill O'Rielly:

"Contrary to their "Fair and Balanced" claims, Fox News has a continuing policy of using bias lies, half truths and propaganda. They fail to provide qualified representatives from opposing views and they have used news footage that did not apply to the subject they were covering. They have made seditious statement about our government, and have openly advocated armed insurrection. I request an investigation be made of their practices, and if necessary removal of their broadcast/cable liscense."
