Fox News host Howard Kurtz called out Mollie Hemingway of The Federalist after she suggested President Joe Biden had ordered the arrest of former President Donald Trump.
"I accept the need for the conversation," Kurtz told Hemingway on his Sunday Media Buzz program. "I just think that if you're going to accuse President Biden of personally doing it, there ought to be some evidence."
"To your point, you're saying, well, maybe Joe Biden had nothing to do with imprisoning his top political opponent or whatever is trying to be done," Hemingway argued. "But Merrick Garland did. So Merrick Garland probably needs to have action taken against him if the Republican Party wants to have a future."
"Well, I just would point out that Merrick Garland sort of turned over the investigation to Jack Smith," Kurtz pushed back. "He did have the power to overrule, but he did not."
But Hemingway asserted Smith was a Democratic operative.
"And even that, Jack Smith is a prosecutor who tried to take out a previous Republican presidential candidate," she said. "But Merrick Garland has a world of hurt with all sorts of politicized prosecutions. And Republicans probably want action taken."
"I just add that Jack Smith has investigated Democrats as well," Kurtz replied.
