The Obama administration was given another win Tuesday, upholding a 2011 EPA regulation that reduces emissions in 28 states to protect air quality for areas located downwind. This 6-2 decision (Justice Samuel Alito recused for unspecified reasons) overturned a lower court’s ruling that the regulation, known as the Cross-State Air Pollution Rule, was not admissible under the Clean Air Act.
This overturning was met with much celebration from residents of the affected areas and environmentalists nationwide. Fred Krupp, president of the Environmental Defense Fund, said:
