The original post did not make clear the purpose of the hearing. Republicans called the hearing to impeach Commissioner Koskinen, which is why he did not answer that hypothetical directly. Also, the IRS usually doesn't answer those hypotheticals directly. You have to ask them for a letter ruling. - Karoli
